HomeMy WebLinkAboutMinutes 2020-08-19 @6:31SAN MINUTES SPECIAL MEETING F ' n U O CITY COUNCIL cgCIFOR��P CITY OF SOUTH SAN FRANCISCO WEDNESDAY, AUGUST 19, 2020 6:31 p.m. Teleconference via Zoom City Council conducted this meeting in accordance with California Governor Newsom's Executive Orders N-25-20 and N-29-20 and COVID-19 pandemic protocols. CALL TO ORDER Mayor Garbarino called the meeting to order at 6:33 p.m. ROLL CALL Present: Councilmembers Matsumoto and Nicolas, Vice Mayor Addiego, and Mayor Garbarino. Absent: Councilmember Nagales recused himself from the meeting due to the discussion of appointing the District 2 candidate at 6:34 p.m. AGENDA REVIEW No Changes. REMOTE PUBLIC COMMENTS — comments are limited to items on the Special Meeting Agenda. 1. Members of the public wishing to participate were encouraged to submit public comments in writing in advance of the meeting to all-cc@ssfnet by 3:31 p.m. on Wednesday, August 19, 2020. The following public comments were received: • Keliana Hui • Eddy • Lillian Rivera • Marcela Rivera • Gustavo Lopez • James Coleman • Olga Perez ADMINISTRATIVE BUSINESS 2. Consideration of whether to appoint the only candidate for City Council in District 2, Mark Nagales, to the office of City Council, District 2, or to proceed with an election in Council District 2 on November 3, 2020. (Sky Woodruff, City Attorney and Rosa Govea Acosta, City Clerk) City Attorney Woodruff presented the report and provided an overview of the City Council District 2 election. On June 10, 2020, the City Council adopted Resolution No. 74-2020 calling for the City of South San Francisco City to hold a General Municipal Election on November 3, 2020 in order to elect City Council members in City Council Districts 2 and 4. The candidate nomination period for City Council candidates was July 13, 2020 through Friday, August 7, 2020 The candidate nomination period was extended and closed on Wednesday, August 12, 2020. Only one qualified candidate was nominated by the electors in City Council District 2. In circumstances where there is only one candidate in a district, California Election Code Section 10229 prescribes that the City Clerk shall present a certificate of these facts to the governing body of the city, who may then at a regular or special meeting before the election, take action to appoint the person to office or take no action and hold the election. Councilmember Matsumoto shared with the community that the City had already held the normal candidate nomination period and requested the City Attorney elaborate on the process of a write-in candidate. City Attorney Woodruff stated that Mark Nagales was the only candidate that submitted paperwork and qualified to run for City Council District 2. He provided an overview of the write-in candidate process and indicated a cost saving for not holding the District 2 election. Assistant City Clerk Avila stated that the estimated cost savings received from the County of San Mateo Elections Division was between $19k and $23k. Vice Mayor Addiego indicated that cost saving amount was minimal and expressed his support with moving forward with District 2 election. Mayor Garbarino shared his experience with being the only candidate and expressed his support with holding the District 2 election. Councilmember Nicolas agreed with Vice Mayor Addiego comments and expressed her support for Mark Nagales representing District 2. She inquired what the deadline was for a write-in candidate to be vetted. Assistant City Clerk stated that the write-in candidate period was from September 7, 2020 to October 20, 2020. Mayor Garbarino inquired whether a motion was required. City Attorney Woodruff stated that no motion was required should Council desired to keep Mark Nagales name on the ballot. The consensus from Council was to take no action.
