HomeMy WebLinkAboutOrd 347-1953 ORDINANCE NOo 3k7 : ~o:~. AN ORDINANCE CREATING THE OFFICE OF DIRECTOR OF PUBLIC WORKS AND DEFINING THE POWERS AND DUTIES OF DIRECTOR OF PUBLIC WORKS. Section 1. The office of Director of Public Works of the City of South San Francisco is hereby created. Said office of Director of Public Works shall not become a part of the classified or civil service system of said city, and shall be filled directly by appointment by the city manager, acting under the direction and control of the city council. The office holder shall be appointed solely on the basis of his executive, administrative, and engineering qualifications. Section 2. In the absence of the Director of Public Works from the city or in the event of his temporary disability to perform the duties of the office, the city manager may appoint some properly qualified person to perform the duties of the director of public works, subject to the approval of at least three (3) members of the city council. Section 3. Upon his appointment to office, the director of public works shall file in the office of the city clerk a bond for the faithful discharge of his duties, to be approved by said city council, in such amount as may be fixed by the city council. Section 4. The director of public works shall be in charge of all public improvement work within the City of South San Francisco. In addition, he shall exercise direct control and supervision over the street and park departments, sewage treatment plant, and department of the building inspector and, further, as an incident to his office, he shall perform all the duties of city engineer and works engineer and all the admin- istrative tasks of the office of superintendent of streets, together with all functions in connection with assessment or public improvement proceedings. Also, he shall perform such other and additional duties as shall reasonably be delegated to him by ordinance or by resolution of said city council. The director of public works shall devote his entire time during customary working hours to the work and interests of the city. Also, he shall attend all meetings of the city council and all meetings of the planning commission or such other commissions or committees as the city manager shall direct, unless he' shall be expressly excused therefrom by the city council or city manager. There shall be appointed by the city manager, with the prior consent of at least three (3,) members of the city council and at such salaries or wages as they shall establish, any and all assistants that the director of public works shall, from time to time, require in order to fully and completely perform all the functions of his office. In this connection, the director of public works may make written recommendations to the city manager, which shall be given due consideration by him. Section 5. Pursuant to the provisions of Section 4, subdivision (2) of Ordinance No. 288, entitled "AN ORDINANCE CREATING THE OFFICE OF CITY MANAGER OF THE CITY OF SOUTH SAN FRANCISCO AND DEFINING THE POWERS AND DUTIES OF CITY MANAGER", adopted by said city council on the 2nd day of May, 1949, the director of public works shall be subordinate to the city manager of said city and shall receive and carry out such instructions pertaining to the duties of the office of director of public works as such city manager shall from time to time give. Section 6. The director of public works shall receive such salary a~..the city council shall, from time to time, fix by resolution or by motion. Section 7. Because the director of public works, which office is hereby created, is required, as an incident to his office, to perform all the duties of the city engineer and works engineer the offices of city engineer and works engineer ! are hereby abolished as being unnecessary. Section 8. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision or decisions shall not affect the validity of the remaining portion of this ordinance. The city council hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, sub- sections, sentences, clauses or phrases may be declared invalid. Section 9. Any ordinance, or portion of an ordinance, in conflict with this ordinance or any part thereof, is hereby repealed. Section 10. This ordinance shall be published once and shall take effect and be in force upon the expiration of thirty (30) days after its passage. * * * * * * * * * * Introduced this 16th day of November , 1953.
