CONTINUED PUBLIC HEARING ITEMS: JOSEPH P. & CLAIRE HAGGARTY/UP-80-563/NEGATIVE DECLARATION NO. 274 (cont'd. from meeting of 12/9/80) Use Permit application to construct a mini-storage unit complex, one caretaker's residential unit and related facilities on vacant property located on the east side of Carter Drive between Meath Drive and Westborough Boulevard in the "P_C" Planned Community Zone District. January 15 Staff Report presented. Applicant's Representative present: Oaniel Modena, Attorney, 421 Grand Avenue Motion-Martin/Second-Bertucelli; Planning Commission to rescind action of December 9, 1980 and reopen the Public Hearing on this matter. - 4327 - January 15, 1981 PUBLIC HEARINGS: JOSEPH P. & CLAIRE HAGGARTY/UP-80-563/NEGATIVE DECLARATION NO. 274 (cont'd. from meeting of 12/9/80) (cont'd.) Unanimously approved. Commissioner Getz arrived at 7:50 p.m. NEFTALI TINOCO/UP-80-573 (Continued from 12/9/80) Proposed Use Permit to build addition to two rooms in an existing non-conforming structure located at 658 Baden Avenue in the R-3 District and maintain a 0" sidegard setback. January 15 Staff Report presented. Applicant present: Neftali Tinoco with representative Ms. DeSoto. Motion-Martin/Second-Mantegani; Planning Commission to rescind action of December 9, 1980 and reopen the Public Hearing on this matter. Unanimously approved. This action was taken due to the fact that Mr. Tinoco was not present at the December 9th hearing on this matter. i~s,. DeSoto stated that Mr. Ti noco was not aware that the perm i t w hi c h he had been granted by the City concerned only the roof of his dwelling. He thought the permit also allowed the building's additions. The Chief Building Inspector, assured the Commission that there was no violation with the roof construction. The room additions which have been completed are, however, in violation of the Uniform Building Code. Motion-Mantegani/Second-Martin; To deny the proposed Use Permit UP-80-573 based on the findings contained in the Staff Report. Unanimously approved. - 4328 - January 15, 1981 PUBLIC HEARINGS: (cont.) MILDRED (HAUN) JOSEPH/V-80-235 Variance application to encroach 2 feet into the required five foot side yard setback on developed property located at 31 Greenwood Drive in the R-l Zone. January 15 Staff Report presented. Applicant present: Mildred (Haun) Joseph, 31 Greenwood Drive The Commission requested that two Special Conditions be added to the report. 1. That the final plans be presented to the Design Review Board. 2. That the drainage is to be checked by the Building Department. Motion-Bertucelli/Second-Getz; To approve V-80-235 based on findings and subject to conditions contained in the Staff Report and as added by the Commission. Unanimously approved. JOHN WARD/UP-80-576 Use Permit application to establish a business for sales and service of small cycles, mopeds, scooters and accessories on developed property located at 105 Rockwood and 161 El Camino Real in the C-l Zone. January 15 Staff Report presented. Letter from Malcolm Cohn in favor of the permit was read into record. Applicant present: John Ward, 1329 Lerida Way, Pacifica. The Commission requested that a Condition be added to the report that, if a nuisance should be created at the site either from noise or public gathering, this Use Permit shall be revoked. The Commission requested that the findings reflect that, due to the uniqueness of the location, on-site parking is not required due to the spaces provided by the public parking lot in close proximity to the site. Motion-Getz/Second-Hoyer; To approve UP-80-576 based on findings and subject to conditions contained in the staff Report as added by the Commission Unanimously approved. MAURICE BROSNAN CONSTRUCTION COMPANY/UP-80-577 Use Permit application to install on-site advertising signs and banners at the Willow and Grand Avenue Condominiums located at 240 Willow Avenue in the RPD-40 Zone. Commissioner Mantegani stepped down during the hearing of this case due to a possible conflict of interest. 0_ 4329 - January 15, 1981 PUBLIC HEARINGS: (cont. ) MAURICE BROSNAN CONSTRUCTION COMPANYjUP-80-577 (cont.) January 15 Staff Report presented. The Commission objected to the installation of banners on the buildings as proposed by the applicant. Applicant1s Representative present: Ms. Judy Jacoby, Foster City, Marketing Specialist Applicant present: Maurice Brosnan, 2969 Churchill Drive, Hillsborough Motion-GetzjSecond-Hoyer; To approve UP-80-577 subject to the elimination of banners based on findings and subject to conditions contained in the Staff Report. Unanimously approved. WILMA CECCHljV-80-235 Variance application to encroach 5 feet into the required 20 foot rear yard setback on developed property located at 317 Rockwood Drive in the R-l Zone. January 15 Staff Report presented. Applicant and Representative present: Wilma Cecchi, 317 Rockwood Quentin Stokes, Contractor The Commission requested that the findings reflect that such variances have been granted to other homes in the area. CITY OF SOUTH SAN FRANCISCOjRZ-80-67jNEGATIVE DECLARATION NO. 296 Rezoning application to rezone from "U" Unclassified to "C-O" Commercial Office certain properties located on the west side of Mission Road from the Colma-South San Francisco line southerly to Oak Street and on the east side of El Camino Real generally from the McClellan Nursery southerly to Arroyo Drive. January 15 Staff Report presented. January 14, 1981 letter read into record from Attorney Del Carlo regarding Cuneo property voicing objection to the proposed rezoning. Motion-ManteganijSecond-Getz; That the Planning Commission adopt Resolution 2278 recommending that the City Council rezone the described area based on the findings contained in the Resolution. Unanimously approved. C. C. CELESTREjUP-80-550 Application to amend Condition No.1 of UP-80-550 to provide overflow parking at 468 Miller Avenue rather than on the southeast corner of Grand and Spruce Avenues - 4330 - January 15, 1981 PUBLIC HEARINGS: (cont.) Staff informed the Commission that the application was incomplete. The applicant was not represented at the meeting. Motion-Mantegani/Second-Martin; To continue PM-80-188 off calendar. Unanimously approved by voice vote. PUBLIC SERVICE EASEMENT VACATION: CITY OF SOUTH SAN FRANCISCOjSA-78-51jRPD-79jlO Proposed vacation of a public service easement of an existing slope easement and two 10 foot drainage easements located southwest of Chestnut Avenue and Hillside Boulevard. Commissioner Mantegani stepped down during the hearing of this case due to a possible conflict of interest. January 15 Staff Report presented. Motion-MartinjSecond-Getz; That the Planning Commission adopt Resolution 2279 recommending to the City Council the vacation of the described easement based on the findings contained in the Resolution. Unanimously approved. TIME EXTENSION REQUEST: ROTARY PLAZAjRPD-79-14 Request for a one year time extension to construct a 55 unit senior citizen annex to - 4331 - January 15, 1981 PUBLIC HEARINGS: (cont.) ROTARY PLAZAjRPD-79-14 (cont.) Rotary Plaza located on the terminus of Blondin Way in the R-3 Zone. January 15 Staff Report presented. Applicant's Representative present: R. Folmer Motion-GetzjSecond-Campredon; To approve the request for a one year time extension on RPD-79-14. Unanimously approved. ITEMS FROM STAFF: A City Council study session regarding the updated Subdivision Ordinance will be scheduled in the near future. Staff recommended that February Commission meeting be changed to February 19, 1981 due to conflict with holiday on February 12,1981. Commission concurred. The Commission was informed that a Neg~tive Declaration has been prepared for the East Grand Avenue grade separation proJect.
