AGENDA ITEMS (PUBLIC HEARINGS) Budget Rent-A-Car, UP-79-499/Mod 2, 177 South Airport Boulevard Use Permit modification application of Budget Rent-A-Car, to modify Use Permit UP-79-499 to allow creation of 2,150 square feet of office space in an existing warehouse space at an existing rental business at 177 South Airport Boulevard in the M-2 Industrial Zone District. April 24, 1986 Staff Report presented. Applicant's Representative: Bill Harmon Wiley Associates 125 E. To approve UP-79-499/Mod 2 subject to and conditions contained in the Staff Vice-Chair Boblitt, Commissioners Commissioner Getz. ABSENT: Quinton Robertson, UP-85-743/Mod 1 and Negative Declaration No. 550, 123 Hickey Boulevard Use Permit Modification of Quinton Robertson and an environmental determination of same to allow occupancy of one of the tenant spaces in Winston Manor Shopping Center by a bakery at 123 Hickey Boulevard in the C-1 Neighborhood Commercial Zone District. April 24, 1986 Staff Report presented. Representing the Prospective Tenants: Mr. David P. Uccelli Attorney at Law 520 El Camino Real San Mateo, CA 94402 Applicant: Dr. Quinton Robertson 95 37th Avenue San Mateo, CA 94403 Mr. Uccelli spoke on behalf of Mr. and Mrs. Walter Spengler, the prospective tenants of the proposed bakery. He stressed the hardship of the Spenglers in that they have spent over $11,000 in lease payments to date and have not been able to gain access to the premises. Mr. Uccelli stated his clients are innocent third parties who have been acting in good faith and that the owner, Dr. Robertson, led them to believe there would not be any problems getting approvals from the city. Dr. Robertson stated he was willing to comply with conditions that dealt with his immediate property but that he was not going to comply with the city's demands that he make improvements along Hickey Boulevard. Commissioner Getz remarked that Dr. Robertson never appealed any of the conditions set forth in the original Use Permit UP-85-743. The Commissioners all agreed that the Spenglers are unsuspecting victims but the Commission has to be consistent with the conditions manifested in October of 1985. Commissioner Terry stated that Dr. Robertson has been taking from the Winston Manor Shopping Center and without putting anything back into it. Commissioner Agee asked if all possibilities have been explored and if there was any way the PC Mtg. 4/24/86 Page 2 of 5 Pages AGENDA ITEMS (continued) way the Spenglers could be accommodated. Director Smith explained that the conditions would have to be amended in order for this to occur. Chair Wendler recalled that at the October 10, 1985 Planning Commission meeting the Commissioners agreed not to allow any new tenants until the shopping center was cleaned up and that the Commission must stand united on this issue. Motion-Getz/Second Terry: To deny UP-85-743/Mod 1 based upon the findings of the Staff Report and based upon the action of the Commission taken on October 10, 1985. Unanimously approved by roll call vote. ABSENT: Commissioner Martin. City of South San Francisco, GP-86-30, ZA-86-34 and Negative Declaration No. 547 continued from Planning Commission meeting of April 10, 1986. 1. Public Hearing for General Plan Amendment application of the City of South San Francisco and an environmental determination of same to amend various sections of text, policies, and exhibits of the Land Use, Circulation and Transportation Elements of the South San Francisco General Plan. 2. Public Hearing for a Zoning Amendment application of the City of South San Francisco and an environmental determination of same to amend and revise Title 20 (Zoning Ordinance and Zoning Map) of the South San Francisco Municipal Code. Speaking with Concern: Dr. Charles Bona 1131 Mission Road Bill Ryan PG&E 1170 Market Street San Francisco, CA 94102 Jim Keegan 1244 Crestwood Drive Louis Dell'Angela 460 Gardenside Avenue Dr. Bona asked questions regarding the proposed Planned Commercial Zone District for the Mission Road area. He asked for clarification on the types of proposed uses that would be allowed. Assistant City Attorney Robert Kasper explained that not all the uses listed in the PC Zone could be approved for the Mission Road/Sunshine Gardens area because of setbacks and other constraints. PC Mtg. 4/24/86 Page 3 of 5 Pages AGENDA ITEMS (continued) (Cassette No.2) Mr. Ryan read a letter dated April 21, 1986 addressed to Deputy City Manager Mark Lewis, responding to the legal questions raised at the April 10, 1986 Planning Commission meeting. Two areas discussed were the contention of PG&E that a conditional use permit cannot be required for the installation of transmission lines and an explanation of the route review process. Mr. Keegan was concerned with the updated information in the General Plan regarding the change in the number of units specified for the Terrabay development and whether the Specific Plan had been modified also. Director Smith informed him that this was printed in the General Plan for informational purposes only and was not a policy. The Habitat Conservation Plan set the maximum of 721 units and all other documents must concur with that number. Mr. Keegan also asked what properties were referred to under Policy 5-2 for Sunshine Gardens. Chair Wendler suggested that Mr. Keegan contact the Planning Division staff with specific properties in question. Mr. Dell'Angela, representing Mr. Dick Noftsger of the Garden Chapel on El Camino Real, requested that the mortuary be retained as a conforming use. Further, as a representative for Fred Bertetta, Jr. he asked for clarification on whether or not Olympic Oil on South Linden Avenue and Georgia-Pacific Truck Depot on East Grand Avenue were conforming or non-conforming uses. Mr. Dell'Angela requested that more consideration be given to the creation of non-conforming uses. He then alluded to other areas of the General Plan and Zoning Ordinance such as fast food restaurants, second hand stores, agricultural uses, and sign amortization. Chair Wendler informed Mr. Dell'Angela that his prior comments were responded to by staff in writing. (Cassette No.3) Motion-Getz/Second Boblitt: To continue the Public Hearing on GP-86- 30, ZA-86-34 and Negative Declaration No. 547 to the first available agenda in May. Unanimously approved by voice vote. ABSENT: Commissioner Martin. Mr. Dell'Angela, as a representative for the Chamber of Commerce, asked for a tentative schedule of the General Plan and Zoning Ordinance workshops, as a bulletin is published for the Chamber's membership and this information would be helpful in alerting the business community. He was told that this item would be continued to the May Planning Commission meetings. Items from Staff Director Smith informed staff that the City Council upheld the Commission's decision to deny Genstar's request for an extension. Items from the Commission Commission Hoyer asked for the status of the Terrabay development. Director Smith informed the Commission that Mr. Dean is working on the grading plan and would probably not start any grading until next year. Commissioner Terry asked if staff could research what areas are designated for manufactured housing in South San Francisco.
