CALL TO ORDER: 7:30 p.m. PLEDGE OF ALLEGIANCE MEMBERS PRESENT: Chairman Terry, Vice-Chairman Zellmer, Commissioners Boblitt, Mantegani, Matteucci and Warren ABSENT: commissioner Wendler ALSO PRESENT: Planning Division Jean T. smith Susy Kalkin Robert Ewing Ron Petrocchi Fred Lagomarsino Deputy City Attorney Police Department Fire Department AGENDA ITEMS: Art-Rise (South San Francisco Unified School District, owner), UP-87-813/Mod 1, 753 Del Monte Avenue Use permit modification to allow an increase in the number of permitted performances and to allow one annual fund-raising festival at an existing school building at 753 Del Monte Avenue. July 28, 1988 Staff Report presented. Applicant's representative: Margaret pierson 204 Rockwood Drive Mrs. pierson submitted a petition signed by several residents who live on Del Monte Avenue and had no objection to any added performances. She also stated that Art-Rise agrees to all conditions included in the staff report. The Commission complimented Art-Rise for its operation and noted that only positive responses to their productions had been received. Sergeant Petrocchi asked that applications for festivals be submitted to the police department 40-50 days in advance in order for fees to be waived and to avoid last minutes problems. Motion-Zellmer/Second Warren: To approve UP-87-813/Mod 1 subject to all conditions and based on the findings contained in the staff report. Unanimously approved by roll call vote. Pak'N Save EIR, EIR-87-11 Consideration of Certification of the Final EIR for a proposed Pak'N Save facility at 2255 Gellert Boulevard. Chairman Terry commented that a recent article in the San Mateo Times, suggesting that the Commission's vote on the EIR certification was predetermined, was inappropriate. July 28, 1988 Staff Report presented. Chairman Terry acknowledged the receipt of a letter from the law offices of Miller, Starr and Regalia but noted the Commission's policy of not receiving written material at meeting time, explaining that it did not give the Commissioners time to absorb its contents. He also informed the public that they were invited to speak on the EIR and concerns will be addressed by the City's consultants. Mr. Falik felt the draft and re-draft EIR'S were extensive documents that identified and analyzed impacts substantially. He further stated that together these documents constitute an adequate Final EIR and asked that it be certified by the Commission. Mr. Valdivia questioned the figure written in the newspaper that Pak'N Save would draw 16,000 customers a day. He also felt that the size of the building commanded a major type business that would draw from outside the immediate neighborhood. Mr. Robinson, manager of the Westborough Square Shopping Center, stated he was representing 27 tenants at Westborough Square who felt threatened by Pak'N Save. He also reported that deliveries have been made to the vacant store. Mr. Minguela, a Westborough Square tenant, complained that the present traffic conditions at the Square were serious and that any additional traffic would intensify it. Mr. Theiss felt the re-draft EIR was comprehensive but was concerned with the trip generation between 12:00 noon and 9:00 p.m, the increase in traffic accidents, and the effect on other businesses in the area. PAGE 3 OF 5 PAGES 7/28/88 PC MTG. AGENDA ITEMS (continued) Mr. Sack informed the Commission of a new development along Sharp Park Road in Pacifica, which he felt would add to the traffic problem. Mr. Waters felt there were still many omissions in the revised draft EIR relating to new residential developments in Pacifica and San Bruno, lack of water and sewage availability in the Westborough area, and truck noise. Ms Sperring was concerned with potential crime that a 24-hour Pak'N Save might bring to the neighborhood and the possibility of truck noise in the late evening. Mrs. Lagomarsino stated that any type of business attracted to this site would increase traffic and Pak'N Save should not be held accountable while other developments were continuing. In response to comments, Mr. Bankston, traffic consultant, reported the trip generation for the project was about 6,100 trips per day, which included both in and out of the store. He also reported that all known developments have been included in the base traffic information counts, including those mentioned by several speakers. At the request of the Commission, Mr. Bankston discussed traffic mitigation measures, such as the moving of driveway #1 one hundred feet north on Gellert, and a signal at the Westborough and Olympic Drive intersection. Mr. Falik informed the Commission that Safeway had moved computer equipment into the facility temporarily due to the fire in Richmond and the closing of a warehouse in Reno. Staff stated a use permit was not necessary since they were not conducting a business and nothing was apparent from the outside. Sergeant Petrocchi discussed the Westborough-Gellert intersection with the Commission and reported that an increase in accidents was not related to an increase in traffic volume. He felt mitigation measures may decrease the number of accidents in the area. (Cassette 2) Deputy City Attorney Ewing informed the Commission that additional mitigation measures could be applied at the use permit hearing. Mr. Churchwell asked if there would be any increase in wear and tear on the street pavement. Mr. Bankston responded that any increase would be insignificant. PAGE 4 OF 5 PAGES 7/28/88 PC MTG. AGENDA ITEMS (continued) commissioner Mantegani asked the applicant to submit an updated letter from the Westborough Water District with respect to water availability at the Pak'N Save site. Motion-Zellmer/Second Warren: To certify that the July, 1988 Final Environmental Impact Report, has been completed in accordance with the California Environmental Quality Act, and that the Final EIR was presented to the Commission and will be considered by the Commission prior to making a final decision on the project. Approved by the following roll call vote: AYES: Chairman Terry, Vice-Chairman Zellmer, Commissioners Mantegani Matteucci and Warren. NOES: Commissioner Boblitt. ABSENT: Commissioner Wendler. ITEMS FROM STAFF Director smith informed the Commission that the city Council upheld the Planning commission's decision of UP-88-820 (Jailhouse Bait & Tackle) and continued UP-84-705/Mod 2 (Rich Diodati) off- calendar. ITEMS FROM THE COMMISSION Commissioner Matteucci reported numerous vehicles parked on lawns on the 200 block of Del Monte Avenue (between Del Paso and EI Campo Drive). In response to Chairman Terry's concern regarding the cement pad being poured at 621 Hillside Boulevard, Director Smith stated the Code Enforcement Officer was aware of it and would be contacting the owner.
