PLEDGE OF ALLEGIANCE MEMBERS PRESENT: Chairman DeZordo, Vice-Chairman Matteucci, Commissioners Boblitt, Mantegani, Warren, Wendler and Zellmer. Morton Steve Carlson Michael O'Toole Jeff Baca Ron Petrocchi Dave Parenti City Attorney Building Division Police Department Fire Department CHAIRMAN COMMENTS APPROVAL OF MINUTES of July 18, 1991 and August 15, 1991 Motion- Warren/Second-Mantegani: To approve the July 18, 1991 minutes as presented, Commission Boblitt abstained from voting since she was not present at that meeting. Unanimously approved by voice vote. Motion-Mantegani/Second-Wendler: To approve the August 15, 1991 minutes as presented. Commissioners Matteucci, Warren and Zellmer abstained from voting since they were not present at that meeting. Unanimously approved by voice vote. ORAL COMMUNICATIONS AGENDA ITEMS - PUBLIC HEARINGS 430-436 N. Canal Street Spruce Business Park (Rich Diodati. Owner. PM-91-287 Tentative Parcel Map to create a single parcel for office/warehouse condominium purposes in the P- I Zone District in accordance with provisions of SSFMC Title 19 and the State Map Act. Motion-Boblitt/Second-Warren: To continue PM-91-287 to the Planning Commission meeting of September 19, 1991. Unanimously approved by voice vote. 235 Tamarack Lane. Elio Piccinini. UP-91-897 Page 1 of 4 Pages PC Meeting of 9/5/91 Use Permit and design review approval to allow construction of a two-story commercial structure in the D-C Zone District within 200" of a residential zone in accordance with provisions of SSFMC Section 20.26.025. September 5, 1991 staff report presented. Representing the applicant: Mark Gaul 59 Ramona Oakland Mr. Gaul accepted the conditions. He questioned the requirement to connect the addition to the building (demonstrated to the Planning Commission on a drawing). He stated the applicant wanted to leave a window on the first floor but staff suggested a sky light. Commissioner Zellmer stated he would support this project with a sky light. Commissioner Warren asked the applicant if he agreed with the Design Review Board suggestions. He answered in the affirmative and agreed that the addition would be fully attached. The Commission inquired why the Parking Place Commission approved a 3-space parking exception. Planner Morton explained that the City was supportive of expansion of commercial extensions downtown. Motion-Zellmer/Second-Matteucci: To approve UP-91-897 based on the findings and subject to the conditions contained in the staff report. It was unanimously approved by the following roll call vote: AYES: Chairman DeZordo, Vice-Chairman Matteucci, Commissioners Boblitt, Mantegani, Warren, Wendler and Zellmer. 1701 El Camino ReaL SpeeDee Oil Change & Tune-up (James Siegler. Owner). UP-91-893. Negative Declaration No. 718 Use Permit, design review and environmental determination of same to establish a quick lube and minor automobile service business with related parking and landscaping in the C-1 (Retail Commercial) Zone District in accordance with provisions of South San Francisco Municipal Code Section 20.22.040( c). September 5, 1991 staff report presented. Applicant: J ames Siegler 229 Sylvan Redwood City Mr. Siegler stated that he had worked on this project for over one year. He eXplained that SpeeDee is a nationwide company and that it is a drive-through lube and tuneup service which is preventive maintenance only, This site would service about forty (40) cars daily at ground level. They do not keep vehicles overnight, inside or outside the building. He explained that Page 2 of 4 Pages PC Meeting of 9/5/91 the oil is stored underground in tanks in concrete beds. He further stated that there would be a low traffic impact. At this time, Mr. Siegler addressed Mr. Simas' objections. He stated he had signed a sublease agreement with Mr. Simas on 11/12/90 which would allow possible development of a portion of the site. However, the sublease has expired. Speaking against the project: Jay Schnack, Atty. #1 Kaiser Plaza, #485 Oakland Mr, Schnack, Mr. Simas' attorney stated that in November, 1990 they entered into a sublease agreement with Mr. Siegler. Mr. Schnack asked the Commission to postpone this project so that both parties could work together to accommodate their mutual needs so that this entire site could be developed. Speaking in favor of the project: Mr. Jim Musser Vice-President, Extra Oil 368 So. Overland Drive San Ramon Mr, Musser stated that Mr. Simas had done little since the sublease agreement and that it had expired. He stated that he understood that Mr. Simas was not ready to proceed with a project. He further stated that Mr. Simas had made no attempt to work with SpeeDee. Commissioner Mantegani asked the City Attorney if the Commission could: 1) ask that no building permits be issued until a contract had been drawn that was agreeable to both the City Attorney and the Chief Planner; or 2) continue this case for 30 days, or 3) approve this project and leave the parties to resolve this issue in court. City Attorney O'Toole replied in the affirmative. Commissioner Zellmer asked Mr. Schnack how much time was needed to work this issue out to which Mr. Schnack responded 30 to 60 days. Commissioner Boblitt agreed to a 3D-day postponement but suggested that the applicant, City Attorney and Chief Planner meet. Commissioner Mantegani asked if this project could be approved with a condition that this be resolved by staff. Planner Carlson stated that a condition could be added. Commissioner Wendler also agreed that the applicant should meet with the City Attorney and Chief Planner and the matter returned to the Planning Commission. Commissioner Zellmer preferred to have the applicant and Mr. Simas mutually agree to a 3D-day extension and have the case return to the Planning Commission. Commissioner Mantegani resented being caught Page 3 of 4 Pages PC Meeting of 9/5/91 in the middle of a legal issue and preferred approving the project with the added condition. Vice-Chairman Matteucci agreed with Commissioner Mantegani. Mr. Siegler agreed to a 3D-day continuance. City Attorney O'Toole suggested proof of the agreement of the parties involved as to the lease be given to the City Attorney and Chief Planner prior to the issuance of building permits. Motion-Zellmer/Second-Matteucci: To continue UP-91-893 to the Planning Commission meeting of October 3, 1991. Unanimously approved by voice vote. Items from Staff Planner Solomon explained the request from Council for a Commissioner to serve on the CHAS committee. He also suggested a study session on October 3 with the topic: Ordinance findings, He also advised the Commission that Esta Kornfeld would be present at the October 3 meeting to be interviewed for the vacant position on the Design Review Board. Planner Solomon advised the Commission of upcoming City Council meetings and the topic of the September 18 City Council study session. Since there were no items from Commission, Chairman DeZordo adjourned the meeting at 8:35 P.M. to September 19, 1991 at 7:30 P.M.
