City Attorney: City Engineer: Fire Department: Police Department: CHAIRMAN COMMENTS CONSENT CALENDAR - AGENDA ITEMS 740 Del Monte Avenue, Alta Lorna Pre-School (Grace Covenant Church, owner), UP-95-996 Use Permit to allow a pre-school accommodating up to 36 children in accordance to the provisions of SSFMC Section 20. 16.030(b). (Continuance requested to November 16, 1995) 2211 Gellert Blvd., Ling Nam Noodle House, UP-93-939/Mod 1 Consideration of Revocation of a Use Permit Modification (allowing for operation of a restaurant during the hours between midnight and 6 a.m.) in accordance with SSFMC Section 20.91.030. (Continuance requested to November 2, 1995) Kaufmann Court, Genentech, mc., Abandonment of Public Street Abandonment of Kaufmann Court, a public street, in the vicinity of the intersection of Forbes and Point San Bruno Boulevards, in accordance with the SSFMC and the California Streets and Highway Code Title 8300, and California Environmental Quality Act Section 15061(b)(3). (Continuance requested to November 16, 1995) 390 Pt. San Bruno Blvd., Genentech, Inc., by James Panek, UP-90-874/Mod 2 and Negative Declaration No. 796 Use Permit, design review and environmental determination of same to allow a new temporary parking lots for 364 automobiles, at 390 Point San Bruno Boulevard, in the Genentech Research and Development/Planned Industrial (GR&D/P-I) Zone District in accordance with provisions of South San Francisco Municipal Code Title 20.39. Motion-Warren/Second-Padreddii: Motion to approve Consent Calendar Items; Item 4 UP-90- 874/Mod2 and Negative Declaration No. 796; and continue Item 2 to November 2nd, 1995 and Items 1 & 3 to November 16th, 1995 Planning Commission Meetings. It was unanimously approved by voice vote. PUBLIC HEARING - AGENDA ITEMS 920 Stonegate Drive, Pacific Bell Mobile Service, (BPO Elks, No. 2091), UP-90-878/Mod 1 Use Permit Modification to allow installation of telecommunication facilities in an R-I-E-P Residential District in accordance with SSFMC Sect. 20. 16.030(b) and 20.91. Chief Planner Solomon presented staff report for the record. Applicant Representative: James R. Calkins, JM Consulting Group, Inc. For Pacific Bell Mobile Services 844 Dubuque Ave., SSF Mr. Calkins agreed with the staff recommendation and Conditions of Approval and asked that Commission approve this application. He is available to answer any questions. Vice-Chairman Warren asked for a description of the antennas. Mr. Calkins noted they were directional/panel type antenna which measures 5 feet tall, 2 1/2 inches deep, 18 to 20 inches wide, not a dish. Discussion continued on the description of location and colors. Motion-Warren/Second-Masuda: Motion to approve UP-90-878/Mod. 1 based on the findings contained in the staff report and subject to the Conditions of Approval. It was unanimously approved by voice vote. 831, 833 & 837 Linden Avenue & 832, 834 & 836 Hickory Place, Robt. M. Martin, applicant/owner, PUD-95-47, Negative Declaration No. 801; and PM-95-315 Planned Unit Development to allow less than required: lot width, lot area, parking, side yards and front yards in a C-I-L Retail Commercial District in accordance with SSFMC Chapter 20.84.050; and Parcel Map to allow a three lot subdivision in accordance with SSFMC Title 19. Interim Planner Kasparowitz presented staff report for the record. He noted a correction to staff report page 2, Zoning Code Analysis item d. should read" 10 foot rear setback" not twenty feet; and that the City received 30 letters in support of this application. He noted that residential uses already exist in the C-l Zone District. Mr. Dell' Angelo introduced Mr. Huge Anton, surveyor and Mr. Bob Martin, applicant and stated that the applicant agrees with staff's recommendations and proposed conditions of approval. Mr. Anton stated he was available to answer any questions regarding the tentative parcel map application. Mr. Martin stated that by offering these properties as owner occupied buildings would promote a better neighborhood, and asked that the Commission approve the applications. Mr. Bugnatto explained the historic background of the property and its existing setbacks. Mr. Valcazar noted that this would be an improvement to the neighborhood and asked the Commission to approve the application. Mr. Gonzalez stated his property's rear yard faces Hickory Place and noted he was one of the founders of the Home Owners and Renters Association which was created to improve properties and include neighborhood watch programs. One of the problems in this area is the absentee homeowners who do not repair their property, with Mr. Martin's proposal the owner will occupy the property. Mr. Saari spoke in favor of the application and asked that the Commission to approve it. Page 3 of 6 Pages PC Meeting of 10/19/95 Speaking with Concern: Michael Horta 149 Escanyo Dr., SSF Mr. Horta asked if a traffic study was done to show effects of additional persons or vehicles in an already crowded lane. He is also the property owner of 818 Olive Avenue. Speaking in favor: Angelina Figeroa and Vilma Gonzales Ms. Figeroa and Ms. Gonzales are renters of Mr. Martin and are in favor of this application. Chairman Lucchesi closed the public hearing. Commissioner Padreddii notes that in reviewing the findings and staff report this item does comply with the General Plan and therefore supports the application. Chairman Lucchesi and Vice-Chairman Warren noted their concerns in creating small lot size and asked the City Attorney for advise on conditions so that in the future others do not propose to build as the rest of the neighborhood was built, this is an "existing condition" and is being divided so that pieces can be sold; these lot sizes are not acceptable, this is action is unique. Assistant City Attorney Seto explained that a condition could specify the unique circumstances of the neighborhood and historical uniqueness of the area, but cautioned the Commission that any time an application is approved someone could use that as a precedence. Discussion continued on the concerns of the Commission regarding the density and setbacks which may set a precedence. Vice- Chairman Warren clarified that actions are based on land use issues and not on applicant's wishes or financial conditions. Chairman Lucchesi explained his concerns and asked staff what had happened with the study on second units and lot splits. Chief Planner Solomon explained it had gone to City Council as an explorative concept but staff did not receive a definitive position from Council. Although some of the Commission's recommendations to Council that are relative to this application were; 1) to allow the conversion of new duplexes, particularly those with separate structures; and that conversions be allowed in the Grand Avenue and Old Town area. Chairman Lucchesi stated this application would provide affordable ownership units, which is needed in the City. Assistant City Attorney Seto noted they could not restrict these units to be owner occupied. Chief Planner Solomon asked that this item be tabled for 10 minutes to allow staff to outline the Commission's concerns. Chairman Lucchesi re-opened the public hearing again. Mr. Bugnatto indicated on the parcel maps how the original lots were intended. Page 4 of 6 Pages PC Meeting of 10/19/95 Chairman Lucchesi commented on the PUD process and asked staff to look at another process to deal with difficult lots. He stated his understanding of a PUD process was used to aggregate, a smaller lot into bigger things, i.e. to create bigger projects; and we are now using the PUD process to chop things up. He then closed the public hearing and called a 10-15 minute recess at 8:45 PM. Meeting called back to order at 9:00 PM. Chief Planner Solomon presented the following revised finding wording as discussed by the Commission: The proposed project and parcel map are uniquely located in a historic district where many lots are similarly situated such that setbacks, lot size, and lot width do not meet present zoning code requirements for the C-l zoning district. The approval of the proposed project and parcel map is specifically limited to the unique physical and historic development of these lots forming this parcel and in the C-l district, in the Old Town Area, and based upon the following circumstances: . Project does not exceed maximum density of the General Plan and the Zoning District. . The lot is currently developed with dwellings that the owner is proposing to retain. . That the proposed project is consistent with the historic pattern of lot widths in the general neighborhood. . The project does not disrupt the harmony of the historic visual context. . This project only creates new lots that front on public streets. Commissioner Masuda asked the applicant if he was in agreement. Applicant replied in the affirmative. Motion-Warren/Second-Padreddii: Motion to approve Negative Declaration No. 801. It was unanimously approved by voice vote. Motion-Warren/Second-Padreddii: Motion to approve PUD-95-47, and PM-95-315 based on the revised findings and subject to the Conditions of Approval. It was unanimously approved by voice vote. Page 5 of 6 Pages PC Meeting of 10/19/95 ADMINISTRATIVE BUSINESS Items from Staff: Chief Planner Solomon gave a summary status report: 1) The Julao PUD Item is going to Council on appeal; 2) Graystone Homes, a large developer, close to acquiring the McLellan site for development of single family homes and triplexes; 3) Terrabay is close to selling Phase. I to Centex Homes; and 4) A reminder that a Joint Meeting with City Council is scheduled on the October 25th, to discuss the open space policies, staff will have a slide presentation of the bay frontage open space. City Engineer, Arthur Wong, is the new City Engineer for the City of South San Francisco and will be attending the Planning Commission meetings with Richard Harmon or Dennis Chuck. The Commission welcome him back to the City. Items from Commission: Commissioner Masuda reported he would be out of town and would not be attending the joint meeting. Chairman Lucchesi asked what was the Council's concern on the open space. Chief Planner Solomon noted they want to identify the bay trail, they want to know what are the areas that need protection. He suggested that the Commission present their objectives of the open space area. Chairman Lucchesi discussed his concerns of the PUD process, he feels it is not being used appropriately; it should not dismantle, it should put smaller pieces together into a bigger plan. Commissioner Padreddii suggested that after the Joint Meeting with the City Council, staff should review the PUD process to coordinate their point of view.
