File No. 509] /) AN ORDINANCE OF THE CITY OF SOUTH SAlq F~NCISCO PROHIBITING A~ PERSON IN A STATE OF DRU~(KENNESS, INTOXICATION, OR I~BRI~TION FROM BEING IN OR NEAR AFY PUBLIC P~CE, M~OR ~HICLE~ OR IN ANY PRIVATE PIECE TO THE Ai'~NOYANCE OF ANY PERSON; PROVIDING PENALTIES ~R VIOLATION; A~D REPEALING O~IFANCES NOS. 155 and 282. The City Council of the City of Soulh San ~'ancisco does ordain as follows: Section 1. It shall be unlawful for any person to be or appear in a stale of drunkenness, intoxication, or inebriation in or .on any public highway, road, streel, sidewalk, lane, alley, public park or other public grounds or place, railroad depol, sladJum, theater, slore, or other place to which the public is admitted or invited. Section 2. Ii shall be unlawful for any person who is under the infl~]ence of intoxicating liquors or narcotic drugs to (~,~/be in or ab~utany automobile, truck, motorcycle, or other motor vehicle (whether or not such person is the owner or operator of such motor vehicle), while such automobile, trucl:, motorcycle, or olher motor vehicle is in or upon any puhlJ_c sireel or thoroughfare, or olher public place in the City of Soulh San ~ancisco. Section 3. It sha!], be u~].awful for any person who is in a state or drunkenness, inioxicatio]~, or inebriation to be in amy private home or in or o~ any private premises lo the disturbance, annoyance, irrilatio~, discomfort, or vexation of any other person or persons. Section 4. Ii shall be unlawful for airy person lo drink any malt, spirilous, or vinous liquor containing more than two percent (2%) of alcohol by volume, while such perso~ is in or upon any public street, highway, road, thoroughfare, s:idewalk, lane, alley, public parks or grounds, public, or civic, building or square, or other public facility or place within the corporate limits of the City of South San Francisco. Section 5. The following ordinances, a~d any and all other ordinances or parts of ordinances in conflict herewith, are hereby repealed: Ordinance ~o. 155 eutitled: :'An Ordinance of the City of South San Francisco Making Drunkenness Unlawful in said City", which ordinance was passed and adopted by the City Council of the City of South San Francisco on the 2d day of February, 1931; Ordinance NOo 282 entitled: ".in Ordinance Making Drunkenness in or Near a Motor Vehicle Unlawful", which ordinance was passed and adopted on the 7th day of February, 1949. Section 6. Any persom or persons violati~g a~y of the provisions of this ordinance shall be guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine of not less than Twenty-Five Dollars ($25°00) or more than Five Hundred Dollars ($500.00), or by imprisonment for a period not exceeding ninety (90) days, or by both such fine and. imprisonment° Section 7.
