They were unanimously approved by voice vote. ABSTENTION: Commissioner Lucchesi (not present at that meeting). Motion-Mantegani/Seconded-Zellmer: To approve the minutes of January 21, 1993 as presented. They were unanimously approved by voice vote. AGENDA ITEMS - PUBLIC HEARINGS 900 Dubuque Avenue. Levitz Furniture (Corporate Property Investors. owner). UP-92-918. Negative Declaration No. 740 Use Permit and environmental determination of same to allow for a use generating 100 or more vehicle trips per day, outdoor storage and exterior modifications to the building, parking lot, and pole sign, at an existing retail facility in the P-C Zone District in accordance with provisions of SSFMC Sections 20.24.060 and 20.24.070( a). Negative Declaration No. 739 Use Permit and environmental determination of same to allow the establishment of a retail/wholesale grocery with related signs in an existing retail building in the C-l Zone District in accordance with provisions of SSFMC Section 20.22.030. Continued from Planning Commission meeting of JanualY 21, 1993. Planner Carlson presented the March 4, 1993 staff report. Applicant: Matt Heslin 1197 7th Street Huntington Beach, CA Mr. Heslin stated that a twelve-week study conducted by Arthur Anderson & Co. concluded that Smart and Final is a retail business. He further stated that he had responded to the Commission's concerns and asked that the Commission make a decision tonight. Mr. Heslin requested the Commission to consider modifications to Planning Conditions 3, 7 and 10. He stated that Smart and Final would bring a tremendous amount of value to the community. Representing the applicant: David Naney Arthur Andersen & Co. 633 West Fifth Street Los Angeles, CA Mr. Naney gave a brief description of the Smart and Final study. He said that Smart and Final's sales and tax data indicated that retail sales represented 80% of the business transactions. Mr. Naney found that there was no deviation from the previous business data submitted by Smart and Final to the City. Commissioner Lucchesi asked the applicant to explain their unloading procedures of tractor- trailer trucks. Mr. Heslin said that trucks are unloaded by forklift which would be stored in the back of the store. Commissioner Lucchesi said he would want restriping of the public parking lot and more landscaping, if possible. Dennis Chuck, Engineering, was questioned regarding relocating some of the six-hour spaces. He said that Smart and Final is willing to pay for the restriping and repaving the lot. Commissioner Lucchesi stated he was in favor of limiting the store hours of operation from 7:00 A.M. to 6:00 P.M., having the trash bin enclosed, and requiring a six-month and one-year review. He stated that the definition of wholesale is still unclear and that wholesale is not a neighborhood serving use. Commissioner Lucchesi said he had visited the Smart and Final store in Mountain View and found that it did not have a lot of traffic and very few people in the store. He stated he had not made up his mind yet. Commissioner DeZordo stated he believed this use is wholesale and does not belong in that shopping center. He was against the project. Commissioner Padreddii stated he had carefully studied the information and made trips to the area. He said he did not see any problem with the parking or the use. He further stated that he always found staff to be very conservative and confident and if they recommended approval he was inclined to concur with them. He stated that the neighborhood wanted a grocery store in Brentwood. He stated that he did not want any parking spaces on Hazelwood eliminated. He said that he thought this was a good operation and that it will help rejuvenate this shopping center. Commissioner Padreddii stated that he supported this application. Page 3 of 7 Pages PC Meeting of 3/4/93 Commissioner Zellmer spoke in regards to Condition 3 (six-month and one-year reviews) and said this is a very sensitive application and we need the review period. He further stated the parking studies and business data studies were both professional and represented a factual opinion that this is a retail use. He said his position on this application had not changed and that he was in favor of the proposed use. Commissioner Mantegani described his visit to the Redwood City Smart and Final store on Monday, February 1, 1993. He explained that the average vehicle count was sixteen cars per hour. He stated cart pickup should be continuous. He asked Sgt. Petrocchi about the proposed loading zone on Hazelwood Drive. Sgt. Petrocchi stated that the Vehicle Code does not limit a truck making a delivery and that they can double park where no loading zone is provided. Commissioner Mantegani said he would prefer the six-month and one-year review periods; 6:00 A.M. to 9:00 A.M. tractor-trailer delivery hours and no deliveries on Saturday or Sunday; continuous cart pickup; the parking area restriped as soon as possible and the store hours to be 7:00 A.M. to 7:00 P.M. Chairman Warren asked Jim Fitzpatrick, Fire Department, about hazardous materials. He stated that this site is classified B-2 occupancy and there are yearly inspections not only by the Fire Department but by the Environmental Health Department and if there were excess hazardous materials they would be required to be removed. Chairman Warren stated that her interpretation of wholesale is buying the product for resale, but the distinction between wholesale and retail is getting slimmer and slimmer. She stated she would have a problem with a 5:00 A.M. delivery. She also agreed on the six-month and one-year review period. In answer to Commissioner Warren's request for clarification of the trash bin, Planner Carlson stated that it should be fully screened and not visible from the street. Planner Carlson advised the Commission that they could modify Condition #7 to include a design approved by the Chief Planner. Commissioner Lucchesi stated that the trash bin should be inside. It was the consensus of the Commission that the trash bin be inside. Dennis Chuck, Engineering, stated that a letter was sent to Smart and Final asking that they pay for the restriping and moving of the signs (designating 1 hour and 6 hour limited parking in the public lot). The applicant had agreed. Commissioner Zellmer recommended that the carts be collected continuously, but not less than on an hourly basis; that it be open from 7:00 A.M. to 7:00 P.M.; that the trash bin be inside; change the 6 hours parking spaces; and that the loading hours be limited from 6:00 A.M. to 9:00 A.M. Motion-Zellmer/Seconded-Padreddii: To approve Negative Declaration No. 739. It was approved by the following roll call vote. AYES: Chairman Warren, Vice-Chaitman Mantegani, Commissioners Zellmer and Padreddii. NOES: Commissioners DeZordo and Lucchesi. Page 4 of 7 Pages PC Meeting of 3/4/93 Motion-Zellmer/Seconded-Mantegani: To approve UP-92-917 based on the findings and subject to the following modified conditions: Condition #5: "The applicant shall store all shopping baskets and hand truck carts in the building and shall collect all baskets and carts on a continual basis, and no less than on an hourly basis. The applicant shall keep the parking lot and on-street parking area free from packaging debris from merchandise sold at the store." Condition #10: "Tractor-trailer tIllck deliveries may only occur only during weekdays and between the hours of 6AM to 9AM." It was approved by the following roll call vote: AYES: Chairman Warren, Vice-Chairman Mantegani, Commissioners Zellmer and Padreddii. NOES: Commissioners DeZordo and Lucchesi. Chairman Warren adjourned the meeting at 9:25 P.M. for a ten-minute recess. Chairman Warren reconvened the meeting at 9:35 P.M. City of South San Francisco. EI Camino Corridor Draft EIR. EIR-92-15 Public hearing to take comments on the Draft EIR for the EI Camino Corridor Project, including the Redevelopment Plan, Amendment of the City of South San Francisco General Plan Land Use and Housing Elements and Annexation of the McLellan Nursery. Senior Planner Morton presented the March 4, 1993 staff report. Planner Morton stated that the consultants were present so that any questions that the public or Commission had could be addressed. She further stated that all concerns would be formally addressed in the final EIR. She introduced the EIR Consultant, John Wagstaff. Mr. Wagstaff spoke briefly about the EIR and the issues which were examined. He introduced the sub-consultants; Mark Crane (traffic section); Terry Bottomly (visual and urban design section); Rodkin (acoustical noise section). Planner Morton stated that the Final EIR would be ready by April 6th. It was noted that this meeting was not the appropriate forum for testimony on aspects of the project; comments should be limited to those on the draft EIR. Mr. Louis Dell'Angela, 460 Gardenside Avenue, SSF, stated that the Commission needed to take a look at the whole density proposal before them. He stated that his concerns were 1) potential impacts on schools; 2) the potential omission loss of the McLellan Nursery as a landmark and focal point; 3) the proposed high density zoning, 4) the potential impacts on City parks; 5) that high density does not fit in on Oak or Mission Road; 6) that the environmental issues such as traffic signals which will go to LOS "F" and sewer deficiencies which are not addressed. Mr. Dell'Angela stated that the City assumed that BART would be built by 2010 but that there is no guarantee about the undergrounding of BART; isn't the City getting ahead on the rezoning? Elaine Costello, Director of Economic and Community Development, stated that if BART is not underground, the City will not pursue rezoning. She further stated that the hearing on the General Plan is on May 6th and that the rezoning hearings have not yet been scheduled. Page 5 of 7 Pages PC Meeting of 3/4/93 Commissioner Mantegani questioned transit-oriented density in the Redevelopment project area; design of BART; the design performance standards; the widening of Chestnut Avenue; the Oak Avenue extension feasibility; and potential noise levels. Commissioner DeZordo commented favorably on the design aspect of the EIR and questioned staff about archeological issues. Planner Morton stated that archeological issues are not addressed in the DEIR. Commissioner Lucchesi had density concerns and would have liked to see models for comparison. Consultant John Wagstaff said they would include models of the different densities in the final EIR. Commissioner Lucchesi stated that no mention was made on the limit of stress of buildings. He was advised that in the General Plan and zoning it would be more specific. Commissioner Lucchesi questioned the visual impacts; the EI Camino Real Parkway concept; density transitions along Oak Street and Grand Avenue, at the McLellan Nursery property and at the two trailer courts; grading; and residential performance standards. City of South San Francisco. Orange Memorial Park Draft EIR. W. Orange/Tennis Drive. EIR-92-16 Public hearing to take comments on the Draft EIR for the Orange Memorial Park Improvement Project. Barry Nagel, Director of Parks and Recreation, presented the March 4, 1993 staff report. Barry Nagel introduced Gaither Lowenstein of Neil Martin and Associates who presented the revised draft EIR. Mr. Lowenstein stated that they had made some extensive revisions and went on to explain those revisions. He further stated that they were seeking authorization from the Planning Commission to prepare a final EIR. Mr. Nagel also advised the Commission that Peter Callander was also present to answer any questions. Chief Planner Solomon informed the Commission that they would accept public comments on the EIR but not comments on the merit of the project itself; simply whether or not the EIR provides information to make that decision at a later date. Ms. Galeotti also questioned surveillance of the park. Ms. Olsen also brought up the issues of operating hours and lighting. She was also concerned that if Kaiser bought the G. F. Atkinson building there would definitely be a traffic impact. Mr. Pons questioned maintaining privacy. He stated that when the Corp Yard moves he would like the cyclone fence to stay. Mr. Allgood again questioned the cleanup of the area behind his home on Mayfair and how will the City keep people from dumping cars in that area? Barry Nagel addressed some of the issues raised. I tems from Staff Chief Planner Solomon gave a brief background on the East of 101 and reviewed the scheduled. He also advised the Commission that if staff is working on three major projects, which represents a very heavy workload, special projects could not be considered. Chairman Warren stated that Commissioner Lucchesi has agreed to join the East of 101 Subcommittee as an alternate to make sure that there is continuity if either she or Commissioner Zellmer cannot attend a meeting. Director Costello advised the Commission that she would be leaving the City the end of March to a position in Mountain View. Items from Commission Chairman Warren asked that someone check out a very big dip in the crosswalk on Sister City Hillside coming from South Airport Boulevard. Motion-Zellmer/Seconded-Mantegani: To adjourn the meeting to March 18, 1993 at 7:30 P.M. It was unanimously approved by voice vote.
