PLEDGE OF ALLEGIANCE MEMBERS PRESENT: Chairman Warren, Vice-Chairman Mantegani, Commissioners Lucchesi and Zellmer. Dancy Steve Padovan Larry Kasparowitz Dick Chiozza Jeff Baca Dennis Chuck Ron Petrocchi Dave Parenti Assistant City Attorney Building Division Engineering Division Police Department Fire Department CHAIRMAN COMMENTS APPROVAL OF MINUTES of August 5, 1993 and September 16, 1993 Motion-Zellmer/Seconded-Lucchesi: To approve the minutes of August 5, 1993 as amended. They were unanimously approved by voice vote. Motion Zellmer/Seconded-Mantegani: To approve the minutes of September 16, 1993 as presented. They were approved by voice vote. ABSTAINED: Chairman Warren since she was not present at the meeting. ORAL COMMUNICATIONS Chief Planner Solomon introduced the new City Manager, Ed Wohlenberg. Mr. Wohlenberg stated that he was aware of the vital and active roll the Commission plays in the community. He further stated that he was always available to them for any questions. At the Chief Planner's recommendation, the Commission changed the order of discussion so that the appeal regarding 1170 Mission Road would be heard first. John Uccelli. owner Appeal of the Chief Planner's decision to require bringing the site landscaping and parking area up to current code requirements. Appellant: John Uccelli 2746 Debbie Court San Carlos Commissioner Warren stated that the appeal had to be cleared first before continuing on to the land use permits. Mr. Uccelli agreed. Mr. Uccelli gave a brief background of the project and presented the Commission with his parking figures versus the staff's parking figures. He further questioned various sections of the staff report but said he was not adverse to the majority of the conditions. Mr. Uccelli's main argument was that they were not inaugurating a new use on this site. Speaking in favor of the appeal: Mark Addiego 320 Evergreen SSF Hen"ash Haboni 1150 Mission Road SSF Speaking against the appeal: Charles Bona 1131 Mission Road SSF Commissioner Zellmer stated that the issues are clear. He felt that the Chief Planner had made the correct call. Both Commissioners Lucchesi and Mantegani agreed with him and concurred with the Chief Planner's decision. Commissioner Warren stated she also supported the Chief Planner's decision; that this application is inaugurating a new use. She further stated that every neighborhood is equally entitled to improvements in their neighborhood. Motion-Mantegani/Seconded-Lucchesi: To deny the appeal. It was unanimously approved by the following roll call vote: AYES: Chairman Warren, Vice-Chairman Mantegani, Commissioners Lucchesi and Zellmer. ABSENT: Commissioners DeZordo and Padreddii. Page 2 of 5 Pages PC Meeting of 1/6/94 Chairman Warren advised the appellant that he could appeal this decision to the City Council. 1170 Mission Road. The Salvation Army (John Uccelli. owner). UP-93-948 Use Permit and Design Review approval to allow secondhand goods sales, related parking, landscaping and sign age improvements and outdoor trailer storage at an existing shopping center in the C-l Retail Commercial Zone District in accordance with the provisions of SSFMC Sections 20.22.040(c) and 20.22.070(a). Senior Planner Dancy presented the staff report. Applicant: Barry Lucas 414 Valleyway Pacifica Mr. Lucas stated he has been looking for a location for over two years but that the Salvation Army does have local volunteers who cany out their work. He explained how the Salvation Army works and was looking forward to having a store in the City that would be an asset to the community. Representing the Applicant: Mara Kopp 68 Country Club Drive SSF Ms. Kopp stated she was an administrator and social worker for the Salvation Army. She explained this store would not be a rehabilitation center but a retail sale service that would bring revenue to the Salvation Army. Chief Planner Solomon explained staff's parking figures in answer to Mr. Uccelli's concern. Mr. Uccelli then went on to explain what he proposed to do to the site; putting durable landscaping on the edge of the property. He then explained the landscaping for the rest of the property. His main concern was not losing further parking spaces. Chairman Warren asked Mr. Uccelli if there were any other conditions that he did not agree to and Mr. Uccelli answered "No." Speaking against the application: Otto Fusaro 253 Westview Drive SSF Page 3 of 5 Pages PC Meeting of 1/6/94 Speaking with concern: Charles Bona 1131 Mission Road SSF Mr. Uccelli asked for a change to Planning Condition #7. He requested sixty (60) days instead of thirty (30) days to submit a Parcel Merger. Mr. Baca, Chief Building Inspector, asked that he be able to go through and inspect the building to be sure it was in a safe condition before issuing a Certificate of Occupancy. If Mr. Uccelli applied for a Building Permit Application, further conditions may be required. Commissioner Lucchesi thought it would be unfair to the rest of the City if they started negotiating landscaping requirements when it is enforced with all Use Permits. Commissioner Zellmer agreed with staff's parking calculations and generally supported this application. Commissioner Mantegani said he preferred to see the Salvation Army at the site rather than an empty building and that the landscaping plan should be left to staff and the City Landscape Architect. Commissioner Warren stated that landscaping was sorely need on this site and asked the applicant for hours of operation. Mr. Lucas said they are proposing from 9:00 A.M. until 8:00 P.M. three (3) days a week and 9:00 A.M. to 6:00 P.M. the other days and closed on Sundays. He also gave the Commission pictures of a Salvation Army store so that they would have an idea of what type of goods are sold. Commissioner Warren questioned the collection trailer. Mr. Lucas said that the trailer on this site would have more supervision than the one at Serramonte. There would be closed gates after store hours. She wanted to condition the collection trailer for a six-month and a one-year review. Mr. Lucas advised that there would be no problem with checking the trailer twice on Sundays. Motion-Zellmer/Seconded-Mantegani: To approve UP-93-948 based on the findings and subject to modified conditions. Planning Conditions modified (changes are in italic) "5. The collection trailer to be maintained on the north side of the store shall be screened by a gate across the access. Said gate shall be locked during non business hours. The appropriateness of the siting of the collection trailer shall be subject to a six-month review. 7. Within 30 days of the date of approval the property owner shall submit an Application for a Parcel Merger to combine the two contiguous parcels into one. If the lots are in separate ownerships, the property ownel; within sixty days of the date of approva~ shall submit a Record of Mutual Access and Parking Easements to the Chief Planner for review and approval." and a new condition "8. The hours of operation shall be 9:00 A.M to 8:00 P.M three days a wel;k, 9:00 A.M to 6:00 P.M three days a week and closed on Page 4 of 5 Pages PC Meeting of 1/6/94 Sundays. " It was unanimously approved by the following roll call vote: AYES: Chairman Warren, Vice-Chairman Mantegani, Commissioners Lucchesi and Zellmer. ABSENT: Commissioners Lucchesi and Padreddii. ADMINISTRATIVE BUSINESS Chairman Warren suggested that the discussion of the non-conforming use policy be tabled until there all the Commissioners were present. Mr. Lou Dell'Angela, 460 Gardenside, stated that it would be advantageous to have a proposal before the Commission when discussing the non-conforming use policy. He further discussed rezoning areas and said industrial districts should be re-examined. He suggested that instead of 6-month lapse between uses it should be increased to two years. Mr. Dell' Angela explained how the City should make the application process easier on the applicant and that there should be more administrative decisions. It was the Commission's consensus not to have several study sessions on this subject and to add another "bullet"; have some sort of life span on a permit. Chairman Warren suggested a "sunset clause. " Itel1ts frol1t Staff - Chief Planner Solomon advised the Commission that staff had received the final EIR and Area Plan on the East of 101 and that there would be a joint Planning Commission and City Council meeting in the near future.
