HomeMy WebLinkAboutOrd 406-1956 O1~ INANCE NO. 406 AN ORDINANCE OF TI~ CITY QF SOUTH SAN ~CIS~ PROHIB~ING T~ ~YING ~F 3WlTC~~E WITHIN ~ CITY WHI~ IN ~R P~LIC P~S~ 6R AT PUBLIC ~T~RINGS~ ~ ~~ING T~ 3~ WITHIN The C~ty ~uncll of the City,of South San Francisco does ordain ss follo~: Section 1, For the purposes of th~s ord~nsnce~ the term "switchblade kn~ves~ shall ~nclude, but sh~ll not necessarily l~ted to, the foll~w~ng: All spr~n~-blade kn~ves~ switchblade knives~ snap-blade kn~ves~ or other s~m~lar ty~ knlves; all kn~ves of which any blade - regardless of the length thereof - ~s released automstlcslly by · spr~ng mechan~s~ or other mechanical dev~ce~ or relessed by ~ny type of mechen~sm whetsoever, Section 2, It shall be unlawful for s~yone who has upon h~s person or w~th~n h~s ~edlste physical possess~on or control - whether the se~e be visible or concealed - say switch-blade kn~fe~ ss described ~n Sectlen 1 hereof, any knife wlth ~ blade t~ee ~nches (3~) or more ~n leagth~ aay ~ce p~ck, awl, dlrk, ds~ger, stiletto, or~s~lar sharp stabbing to~l~ shy straight-edged rez~r, razor blsde f~tted to · handle, razor w~th sn uaguarded blade, or shy cutting, stsbb~ng~ or bludgeoning weapon or device ~ntended to be used club or capable of ~nfl~ct~ng grievous bodily h~rm~ to loaf or lo~ter upon any public street, way, sidewalk, alley, or st shy athletic event, dsnce, or other such gstherlng to which the public, or number thereof, are e~tted, or ~n or s~ut s public park, beech, other recreational ares, school, or say other public build~ng or piece, or to wander about from place to pla~ w~th no lawful bus,ness thereby to ~rform~ or to h~de~ lurk, or lo~ter upon or shout the premises of another, Section 3. It shall be unlawful for anyone who has upon his person or within his immediate physical possession or control - whether the same be visible or concealed - any switch-blade knife, or dangerous or deadly weapon, as described in Sections 1 and 2 her.arm to engage in any fight or to participate in any riotm uprising, or other type of disorderly conduct upon the premises of another or upon any public street, way, sidewalk, alley~ or in or about a public park, beach, other recreational area, school, or any other public building or place, or at any athletic event, dance, or other such gathering to which the public, or a number thereof, are admitted. Section 4. It shall be unlawful for anyone who has upon his person or within his immediate physical possession or control any switch-blade knife, or dangerous or deadly weapon~ as described in Sections 1 and 2 hereof, to loiter about any place where alcoholic beverages are sold or any other place of public resort. Section 5. The foregoing restrictions shall not be deemed to prohibit the possession or control of ordinary tools or equipment carried in good faith for the purpose of honest work, trade, or business, or for use in a legitimate sport or recreation. Section 6. Notwithstanding any provision in this ordinance to the contrary~ no person shall sell, offer for sale, expose for sale~ keep, carry, possess, loan, transfer, or give to any other person any switch-blade knife. Section 7. ~y person, firm, or corporation, whether as a principal, agent, employee, or otherwise, violating or causing the violation of any of the provisions of this ordinance shell be guilty of a misdemeanor, and shall, upon conviction thereof, be punished by a fine of not less then Fifty Dollars ($50.00) nor more than Five Hundred Dollars ($500.00), or by imprisonment in the county jail for · period of not less than thirty (30) days nor more than six (6) months, or by both such fine end imprisonment. . Section 8. If any section, subsectio~ sentence, clause, or phrase of this ordinance is for any reason held by a court of competent jurisdiction to be unconstitutional or otherwise invalidw such decision shall not affect the validity of the remaining portions of this ordinance° The City Council hereby declares that it would have passed this ordinance, and each section, subsectionw sentence, clause, and phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared~nvalido Section 9. No sentence imposed hereunder shall be suspended. Section 10. Nothing in this ordinance shall prohibit police officers, special police officers, peace officers, or other law enforcement officers from carrying any wooden club, baton, or any equipment authorized by the properly constituted authorities for the enforcement of law in the City of South San Francisco. Section 11. This ordinance is hereby declared to be an urgency measure and, as such, shall take effect immediately upon its adoption, a statement of the urgency being as follows: Within the general vicinity of the City of South San Francisco there have recently occurred upon public streets and other public areas, and at places of public gatherings, such as, athletic contests and dances, a number of outbursts of violence in which switch-blade knives and other dangerous weapons, as hereinbefore defined, were employed with the result that some persons suffered severe bodily injuries and others sustained serious damage to property. Because several athletic contests and other public events are scheduled to take place within the City of South San Francisco within the very next few days, at which it is anticipated that persons carrying dangerous weapons, such as, switch-blade knives and the like, may be in attendance, the public welfare and safety will be jeopardized unless this ordinance shall,~thout any delay, become effective upon adoption. 3. Section 12. This ordinance shall be published once in the manner required by law and, being an urgency measure, shall take effect immediately upon its adoption. Introduced this15th day of October 1956.
