File No. 548] OR1) ININCE NO. 420 AN OR1)INANC~ OF TI~ CITY OF SOIJTH ~AN ~CISCO APPROVING AND ORDERING THE ANNEXATION OF ~PINEVIKW CREST" TO THE CITY OF SOUTH SAN FRANCISCO. The City Council of the City of South San Francisco does ordain that, WHEREAS the 'City Council of the City of South San Francisco did, on the 14th day of August 1956, receive a written petition from WALTER NEUGEBAUER and IDA NEUGEBAUER, his wife, requesting said City of South San Francisco to annex as uninhabited territory all the real property hereinafter particularly described; and WHEREAS the real property hereinafter particularly described is the territory sought,~ in said petition, to be included within the confines of said City of South San Francisco and is in f~ct uninhabited territory and is contiguous to said City; and WHEREAS, on the llth day of September 1956, said City Council did pass its certain resolution giving notice of the proposed nnnexation of the uninhabited territory hereinafter described to said City of South San Francisco and did, in said resolution, fix Monday, the 15th day of October 1956, at the hour of 8:00 o'clock p.m., and the Council Chambers in the City Hall of said City of South San Francisco as the time and place when and where any persons owning real property within the territory hereinafter described, and so proposed to be annexed, and having any objections to the proposed annexation of said territory may appear before said City Council and show cause why said territory should not be so annexed, and did, in said resolution, find that said WALTER NEUGEBAUEE and IDA NEUGEBAUER, his wife, sro the owners of land comprising more than one-fourth (1/4) of the area of the territory hereinafter described and representing more than one-fourth (1/4) of the assessed value of said territory, according to the lest preceding equalized assessment roll of the County of San Mateo; and said City Council did, in said resolution, direct that the City Clerk of said City cause a copy of said resolution to be published once a week for two (2) successive weeks at least twenty'(20) days prior to the 15th day of October 1956, in the South San Francisco Enterprise-Journal, a weekly newspaper of general circulation published in said City of South San Francisco, and in the San Mateo Times, a newspaper of general circulation published and circulated in the County of San Mateo, in which county the territory hereinbefore referred to is located; and WBEREAS said resolution was published in said South San Francisco Enterprise-Journal on the following dates: September 13, 1956 and September 20, 1956; and in the San Mateo Times on the following dates: September 13, 1956 and September 20, 1956; and WHEI~EAS the aforesaid petitioners, namely, said WALTER NEUGEBAUER and IDA NEUGEBAUER, his wife, are the sole owners of all the territory hereinafter particularly described and, as such, have given and executed their written consent that the same shall, upon annexation, be subject to taxation to pay a proportionate share of any and all preexisting indebtednesses or liabilities of said City of South San Francisco, which written consent is presently on file with the Clerk of said City; and WBEREAS the public hearing before referred to has been held, as required by law, and no person_ has filed or made written or other protest against the proposed annexation of said territory, or any part thereof, to said City of South San Francisco, NOW, THEREFOI~, it shall be, and it hereby is, ordered by the City Council of said City of South San Francisco as follows: Sectian 1. Said City Council does hereby find and determine that WaT.TER NEUGEBAUSR and IDA NEUGEBAUBR, his wife, are the owners of land comprising more than one-fourth (1/4) of the area of the territory hereinafter particularly described and representing more than one-fourth (1/4) of the assessed value of said territory, according to the last preceding equalized assessment roll of the County of San Mat.o, and that said land is in fact uninhabited territory and is contiguous to said City of South San Francisco. Section 2. Said City Council does here declare that any and all protests against such proposed annexation shall be, and they hereby are, overruled. Further, said City Council does here approve the proposed annexation and, accordingly, does hereby order that the hereinafter particularly described territory shall be, and the same hereby is, annexed to the City of South San Francisco, and that upon being so annexed it shall be known as "PINE¥IEW CREST~ and shall be subject' to taxation to pay a proportionate share of any and all preexisting lndebtednesses and liabilities of said City. Said uninhabited territory is situate in the County of San ~ateo, State of California, and is particularly described as follows: BI, GINNING at the most westerly corner of that annexation to the corporate limits of the City of South San FrancisCo adopted by the City Council of South San Francisco August 19, 1946 as Ordinance No. 249, thence proceeding north- westerly along the northeasterly right-of-way line of Junipero Serra Boulevard, as said right- of-way line was established by deed from Flood Realty Co., a Corporation, to Joint Highway District No. 10 of the State of California, a public corporation, dated November 9, 1938 and recorded November 28, 1938 in Book 810 of officia~ records at page 396, to the intersection of the aforesaid northeasterly right-of-way line with the northwesterly line of the property firstly described in deed from L. M. Fruhling to California Pacific Title and Trust Company, a Corporation, recorded May 26, 1941 in Book 954 of official records at page 427; thence leaving the northeasterly right-of-way line of Junlpero Serra Boulevard and proceeding North 60'25'38~ East along the last mentioned northwesterly boundary line 1230.92 feet more or less, to an angle point therein marked by the concrete monument ~LoSo 1894"; thence South 23'28' East along the boundary line of the property described in deed to California Pacific Title and Trust Company 657.29 feet to a point on the most westerly corner of Lot 22, Block 6, Avalon Park No. 3, map of which was filed in the office of the Recorder of San ~ateo County July 28, 1954 in Volume 39 of ~aps at pages 46 and 47, last mentioned point also being. a point on the westerly corporate limits line of the City of South San Francisco as established bY aforementioned Ordinance No. 249; thence pro- ceeding along the southwesterly boundary line of aforementioned Avalon Park No. 3, said line being also the corporate limits line of the City of South San Francisco as established by afore- mentioned Ordinance No. 249; thence proceeding along the southwesterly boundary line of afore- mentioned Avalon Park No. 3, said line being also the corporate limits line of the City of South San Francisco as established by afore- mentioned Ordinance No. 249, South 31'15' East 357.12 feet to a point which is the most northerly corner of Lot 14, Block 6,, Avalon Park No. 2; thence proceeding along the northwesterly boundary line of aforementioned Avalon Park No. 2, said line being also the corporate limits line of the City of South San Francisco, as established by aforementioned Ordinance No. 249, South 58* 45' West to the Point of Beginning. Section 3. This ordinance shall be published once, and shall take effect and be in force from and after the expiration. of thirty {30) days following its adoption. Introduced this 15th day of October 1956.
