HomeMy WebLinkAbout0005_2_09.09.2020 Regular CC Minutes CALL TO ORDER Mayor Garbarino called the meeting to order at 7:00 p.m. ROLL CALL Present: Councilmembers Matsumoto, Nagales, and Nicolas, Vice Mayor Addiego, and Mayor Garbarino. AGENDA REVIEW City Manager Futrell requested agenda items #8 and #9 to be continued to September 23, 2020 after opening the public hearings. ANNOUNCEMENTS FROM STAFF Economic Development Coordinator Lucero provided an update on the City’s Small Business Relief fund. The fourth round of funding was currently open and closed on Friday, September 11th. Eligible businesses could apply for a $10k or $15k loan that may be forgiven after 90 days. The city has currently approved 36 small business loans totaling $490k. Vice Mayor Addiego inquired about the verification process for the program. Economic Development Coordinator Lucero indicated the funding was Community Development Block Grant with multiple layers of verification and provided an overview of the verification process. Councilmember Matsumoto complimented City staff and the South San Francisco Chamber of Commerce for all their efforts. Economic and Community Development Director Greenwood provided an update on the Outdoor Dining Program and shared a list of restaurants with outdoor dining. Councilmember Matsumoto shared that the South San Francisco Chamber of Commerce assisted with securing a grant from Genentech and the City Council recently passed a 15% cap on third party delivery services and 10% on pickups. Vice Mayor Addiego provided feedback from the business community pertaining to the third party caps. He shared that Gunter’s Restaurant and JoAnn’s Café were also providing outdoor dining. MINUTES REGULAR MEETING CITY COUNCIL CITY OF SOUTH SAN FRANCISCO WEDNESDAY, SEPTEMBER 9, 2020 7:00 p.m. Teleconference via Zoom City Council conducted this meeting in accordance with California Governor Newsom’s Executive Orders N-25-20 and N-29-20 and COVID-19 pandemic protocols. REGULAR CITY COUNCIL MEETING SEPTEMBER 9, 2020 MINUTES PAGE 2 PRESENTATIONS 1. Presentation of a proclamation recognizing September 15 - October 15 as National Hispanic Heritage Month in South San Francisco. (Richard Garbarino, Mayor) Councilmember Nicolas read into the record a proclamation recognizing September 15 - October 15 as National Hispanic Heritage Month in South San Francisco. Cultural Arts Commissioner Teresa Avelar accepted the proclamation and thanked the City Council for their support. 2. REMOTE PUBLIC COMMENTS –Members of the public wishing to participate were encouraged to submit public comments in writing in advance of the meeting to all- [email protected] by 4:00 p.m. on Wednesday, September 9, 2020. None COUNCIL COMMENTS/REQUESTS Councilmember Nagales invited the community to participate in the Census event on Saturday, September 12th. He informed the community of the Wi-Fi expansion in Westborough Park and thanked staff for their efforts. Councilmember Matsumoto provided an update on the ridership for various transit agencies and discussed the importance of Measure RR on the ballot for the upcoming election. Councilmember Nicolas acknowledged all the firefighters battling the major wildfires statewide and looking forward to their safe return. She provided an update on the Mayor’s Commission on Racial and Social Equity. Given all the feedback received she requested patience from the community during the initial informational gathering phase. Vice Mayor Addiego encouraged residents to bring their different perspectives in meetings and commended Councilmember Nicolas for chairing the meetings. Mayor Garbarino shared the below market condominiums available for sale at 200 Linden Avenue. He shared that HIP Housing had rooms available for rent and requested the meeting be adjourned in the memory of Luis Perra and Teresita Santos. Mayor Garbarino shared with the community that the city donated an ambulance filled with supplies to their Sister Cities of Atotonilco El Alto, Mexico. He requested an Adhoc committee be formed to review the City’s investments and appointed Councilmember Matsumoto and Vice Mayor Addiego. Councilmember Matsumoto shared her experience with visiting the Sister Cities of Atotonilco El Alto. CONSENT CALENDAR The City Clerk duly read the Consent Calendar, after which Council voted and engaged in discussion of specific item as follows: Item #5, #6 and #7 was pulled by Vice Mayor Addiego and Councilmember Matsumoto for further discussion. Report regarding Resolution No. 110-2020 authorizing the acceptance of $8,000 in grant funding from the Silicon Valley Community Foundation (SVCF) to support the South San Francisco Public Library’s 2020 Voter Education project and approving Budget Amendment 21.008. (Adam Elsholz, Assistant Library Director) 5. Report regarding Resolution No. 111-2020 authorizing the acceptance of $5,146 in funding from San Mateo County Registration and Elections Division to support a 30-Day Early Vote Center at the Main Library for the November 3, 2020 Presidential General Election and approving Budget Amendment 21.010.(Adam Elsholz, Assistant Library Director) 6. Report regarding a Resolution No. 112 -2020 authorizing the acceptance of $22,500 in grant funding from the County of San Mateo to support the City of South San Francisco’s Census 2020 outreach and canvassing in hard-to-reach neighborhoods and approving Budget Amendment 21.009. (Kathy Blandón Escobar, Census 2020 Program Manager) 7. Report regarding Resolution No. 113-2020 authorizing the appointment of Deputy City Treasurer(s). (Frank Risso, City Treasurer and Janet Salisbury, Director of Finance) Item 5 – Vice Mayor Addiego requested clarification about the Main Library Vote Center and frequently of ballot pickups. Library Director Sommer provided an overview of the Main Library’s process for allowing in person voting, October 5th through Election Day, Tuesday November 3rd. City Clerk Acosta provided information of other possible ballot drop-off locations and an overview of the ballot pickup schedule. Item 6 – Councilmember Matsumoto shared the importance of community participation in the census. Vice Mayor Addiego inquired about the recent census count; Census 2020 Program Manager Blandon provided an overview of the current responses and indicated were responses were low. Councilmember Matsumoto indicated that undocumented residents have fear of responding to the census. Item 7 – Councilmember Matsumoto expressed her concerns with the resolution and formatting. PUBLIC HEARING Public Hearing opened: 7:45 p.m. 8. Report regarding consideration of a Use Permit Modification, Design Review Modification, Development Agreement Amendment and Addendum to the 2012 Environmental Impact Report to alter the site plan and exterior appearance of a previously entitled project at 475 Eccles Avenue to construct two new five-story office/R&D buildings totaling 262,287 square feet, and a five-level parking structure on a 6.1 acre site and to expand the area of property covered by the entitlements to include the adjacent rail spurs. Report regarding an Ordinance approving the Second Amendment to the Second Amended and Restated Development Agreement to the Gateway Business Park Master Plan Project between the City of South San Francisco and BMR Gateway of Pacific I LP, BMR Gateway of Pacific II LP, BMR Gateway of Pacific III LP, and BMR Gateway of Pacific IV LP to make minor modifications to the previously approved Development Agreement, and determining that the certified 2009 Environmental Impact Report continues to serve as the environmental document and there are no changes in circumstances that would require additional environmental review. ADMINISTRATIVE BUSINESS 10. Report regarding a resolution authorizing the City Manager to execute a professional services contract with Traffop Corp of Scottsdale, Arizona to procure an automated traffic signal performance measures (ATSPM) system for the East of 101 Traffic Signal Improvements Project (Project No. tr1902) in an amount not to exceed $278,410. (Bianca Liu, Senior Engineer) Senior Engineer Liu presented the report and provided an overview of the automated traffic signal performance measures (ATSPM) system for the East of 101 Traffic Signal Improvements Project. The East of 101 Traffic Signal Improvements Project (Project No. tr1902) proposes to improve arterial operations and enhance safety at signalized intersections throughout the City starting with the East of 101 area by deploying an Automated Traffic Signal Performance Measures system. The project would deploy an ATSPM system at 33 signalized intersections along several corridors in South San Francisco that either parallel US 101, or feed into it. The corridors are critical to the City and region considering they serve as de facto bypass routes to the I-380 and US 101 freeways in the event of incidents or major congestion. In addition to this project, the City is implementing other transportation technology enhancements in the project area aimed at moving traffic more efficiently through these corridors. Councilmember Matsumoto indicated she would like to award local business with the contract; rather than out of state companies. She expressed concerns with the report and requested a template for these type of projects. Public Works Director/City Engineer Kim provided an overview of the selection process. Councilmember Matsumoto requested additional information in order to make a decision. REGULAR CITY COUNCIL MEETING SEPTEMBER 9, 2020 MINUTES PAGE 5 Vice Mayor Addiego agreed with Councilmember Matsumoto’s comments and expressed his concerns with the selection process. Mayor Garbarino expressed his concerns with the lack of data and information presented to City Council in reports that are necessary to make an informed decision. City Manager Futrell indicated that the report indicates companies applied without a cost breakdown due to the type of contract. He would work with staff to provide additional information. Vice Mayor Addiego expressed his desire to postpone the item due to lack of information. City Manager Futrell suggested that City Attorney Woodruff provide an overview of the process and information that can be provided to City Council. He indicated that a consultant contract is not a low bid situation and City Attorney would need to guide the City. Councilmember Matsumoto restated her concerns with the lack of data that was being presented to City Council for approval. Vice Mayor Addiego expressed his desire to postpone the item due to lack of information. City Attorney Woodruff indicated that the staff recommendation was based on a set of judgements and qualities of applicants. He would provide the City Council the factors considered similar across vendors with information on the City’s policy and the legal constraints for City Council consideration. Councilmember Nicolas requested software upgrade information in the next presentation. The consensus of City Council was to continue the item with additional information. Report regarding an ordinance amending Section 4.04.040 of Chapter 4.04 of the South San Francisco Municipal Code to permit utilization of cooperative purchasing processes between public agencies for public works projects (Eunejune Kim, Public Works Director) Deputy Director of Public Works Bockhaus presented the report and provided an overview of the proposed ordinance. In particular, Section 4.04.040 authorizes the City to “piggyback” on other governmental contracts, provided the agency uses a quote or bid process that substantially conforms to state law-mandated procedures and provisions of Chapter 4.04. This provision is derived from California Government Code section 6500 et. seq., which permits California and out-of-state public agencies to jointly exercise any power common to them, including their purchasing powers. However, Section 4.04.040 of the Municipal Code excludes “public projects” as defined by the Uniform Public Construction Cost Accounting Act (Public Contract Code section 22000 et seq.) (“Act”) from being able to piggyback on such contracts. REGULAR CITY COUNCIL MEETING SEPTEMBER 9, 2020 MINUTES PAGE 6 Amending the Purchasing Procedures under the Municipal Code would permit the City to utilize the Sourcewell JOC process for public works projects. This would be efficient and economical for the City if it takes advantage of this national cooperative contract-purchasing program. Sourcewell contracts are formally, competitively bid by using pricing and construction data tailored to the local regions where the contracts would ultimately be awarded. This entity competitively bids construction tasks with pre-set unit prices and specifications for the underlying public work, including material, equipment, and labor costs. The bid submissions are then reviewed according to the specifications for Sourcewell to compile a list of competitive and qualified bidders. Vice Mayor Addiego requested clarification on the types of contracts the City can piggyback on. Deputy Director of Public Works Bockhaus indicated that any potential contract as long as the company meets the bid requirements. Councilmember Nicolas inquired about the piggyback process, potential delays and cost of using Sourcewell. Deputy Director of Public Works Bockhaus provided an overview of the process and indicated that there was no cost to using Sourcewell. Motion— Vice Mayor Addiego/Second – Councilmember Nicolas: to introduce an ordinance amending Chapter 4.04.040 of the South San Francisco Municipal Code relating to Cooperative and Inter-Governmental Agency Procurement Processes, and waive further reading, by roll call vote: AYES: Councilmembers Matsumoto, Nicolas, and Nagales, Vice Mayor Addiego and Mayor Garbarino; NAYS: None; ABSENT: None; ABSTAIN: None. ITEMS FROM COUNCIL – COMMITTEE REPORTS AND ANNOUNCEMNTS Councilmember Matsumoto shared her displeasure of tonight’s meeting with staff not providing sufficient information to City Council. She explained the importance and responsibility that City Council has when approving items.
