HomeMy WebLinkAboutOrd 505-1964 ORDINANCE NO. 505 AN ORDINANCE OF THE CITY OF SOUTH SAN FR~INCISCO CALL- ING A SPECIAL ELECTION TO BE HELD ON THE DAY OF AUGU~ , 19 64, PERTAINING TO THE ANNEXATION OF THE '~WESTBOROUGH-lr~BITED AREA~ TO THE CITY OF SOUTH SAN F~INCISCO 'I,~EREAS, by Resolution No. 3928, the City Council of the City of South San Francisco declared its intention to call a special election to be held on the llth day of An~ns~ , 19 64 , in certain inhabited territory contiguous to said city proposed to be annexed to the city, for the purpose of submitting to the qualified electors residing in said territory the question whether or not the territory shall be annexed to the city; and WHEREAS, a copy of said resolution was published as required by law; and V~EREAS, at a time not later than the hour set by said reso- lution for hearing objections to the proposed election protests were not made by the owners or by public and private owners equal to one-half of the value of the territory proposed to be annexed; and WHEREAS, all proceedings have been had in accordance with said resolution and the Annexation Act of 1913, reference thereto hereby being made for further particulars. NOW, THEREFORE, the City Council of the City of South San Francisco ordains as follows: 1. A special election is hereby called to be held on the llth day of August , 1964 , in the territory hereinafter described and proposed to be annexed to the City of South San Francisco for the purpose of submitting to the qualified electors residing in said territory the question whether or not such territory shall be annexed to, incorporated in, and made a part of said City of South San Francisco, and whether or not the property in said territory shall, after such annexation, be subject to taxation, equally with the property 'within the City of South San Francisco, to pay the entire bonded indebtedness of the City of South San Francisco outstanding or authorized at the date of the first publication of the notice of election for the acquisition, construction or completion of municipal improvements. Said territory is described as follows: WESTBOROUGH INI~ABITED AREA ANNEXATION All that certain real property situate in the County of San Mateo State of Califor~ia, being Tracts 796, 798, 802 and 808 Westboroughmore particularly described as follows: BEGINNING at the most easterly corner of Lot 12 in Block 15, as said Lot and Block are shown on the map entitled "TRACT NO. 808, ~ESTBOROUCHUNIT NO. 2, SAN MATEO COUNTY, CALIFORNIA", filed September 14, 1962 in Book 56 of Maps at Pages 43, 44 and 45, San Mateo County Records; thence along the general north- easterly boundary of the subdivision shown on said map, the followin~ 8ou~ourses: N 60°55~ W 90.00 feet, N 29005' E 78.22 feet, N 55 28~ W 925.61 feet; thence tangent to the preceding course northwesterly along the arc of a curve to the right . having a radius of 490.00 feet and a central angle of 13u53', an arc distance of 118.73 feet; thence tangent to the preced- ing curve N 41035' W 472.82 feet; thence tangent to the pre- ceding course northwesterly along the arc of a curve to the right having a radius of 300.00 feet and a central angle of 67015', an arc distance of 352.12 feet; thence ~angent to the prec~ding curve N 25°40' E_264.53 feet, N 64020 ~o150.00 feet, S 25v40~ W 5.00 feet, N 64°20~ W 559.75 feet, N 76 39~51'' W 154.82 feet, and from a ~ngent that bears N 6°15' W, along the arc of a curve to the left having a radius of 530.00 feet and a central angle of 19°40'46'', an arc distance of 182.04 feet to the most northerly corner of Parcel C in Block 23, as said Parcel and Block are show~ on said map; thence along the northwesterly line of said Parcel C, Block 23, S 59012' W 80.09 feet, and tangent to the preceding course southwesterly along the arc of a curve tOothe right having a radius of 745.00 feet and a central angle of 0 12'13", an a~c distance of 2.65 feet to the north- easterly corner of ~he subdivision shown on the map entitled "TRACT NO. 802, WESTBOROUGH UNIT NO. lC, SAN MATin COUNTY, CALIFORNIA", recorded May 1, 1962 in Book 56 of Maps at Pages 14 and 15, San Mateo County Records; thence along the general northerly line of said subdivi~ion the following courses: from a tangent that bears S 59~24'13'' W, along the arc of a curve to th8 ri~ht having a radius of 745.00 fee= and a central 13 24~7'' angle of , an arc distance of 174.41 feet~ thence S 17°11' E 14.00 feet, S 73057' W 30.02 feet, N 14 55' W 14.00 feet, thence from a tangent that bears S 75005' W along tn. :he arc of a curve to the right having a radius of 745.00 feet and a central angle of 44°50~31'', an arc distance of 583.07 feet, thence N 60°04~29" W 115.02 feet to the northeasterly corner of the subdivision shown on the map entitled "TRACT NO. 798, WESTBOROUGH UNIT NO. lB, SAN MATEO COUNTY, CALIFORNIA", re- corded September 13, 1961 in Book 5~ of Maps at Pages 16 and 17, San Mateo County Records; thence along the genera~ northerly line of said subdivision the following courses: N 60v04'29'' W 79.13 feet; thence tangent to the preceding course nc~thwesterly along the arc of a curve to th~ left having a radius of 955.00 feet and a central angle of 18v54'21'', an arc distance of 315.12 feet; thence tangent to the preceding curve north- westerly along the arc of a curve to the le~t having a radius of 1210.00 feet and a central angle of 33°19'10'', an arc distance of 703.66 feet; thence S 67042' W.49.9.89 feet to the northwesterlycorner of said TRACT NO. 798, thenCeoal,ong the general southwesterly line of last sai~ Tract S 22 18 E 262.50 feet, S 67°42' W 100.00 feet, and S 22 18' E 250.00 feet to the northwesterly corner of the subdivision shown on the map titled "TRACT 796, WESTBOROUGH UNIT NO. lA, SAN MATEO COUNTY, CALIFORNIA", recorded August 3, 1961 in Book 55 of Maps at Pages 2 and 3, San Mateo County Records; thence along the sout_hwesterly line of said TRA~T 796, S 22018, E 300.00 feet, N 67042' E 2.00 feet, and S 22018' E 217.50 feet to the south- westerly corner thereof, last said point being a point on the corporate limits line of the City of San Bruno as established by Ordinance No. 688 (Misc. Ord. No. 53) adopted by the City Council of the City of San Bruno on July 11, 1956 in the annexation of the territory known as "PACIFIC HEIGHTS"; thence along the corporate limits line of San Bruno and the general southerly line8 of said tracts 796, 80~ and 808 the following courses: N 67 42' E 696.00 feet, S 56v02'46'' E 2608.59 feet S 55028'22" E 865.?8 f~et, S 75051'23" E 62.59 feet, N 89°08~17" E 98.19 feet, and N 89u07'53'' E 90.73 feet to a southerly corner of said Tract 808; thence leaving the corporate limits line of San Bruno and along the general easterly line of said Tract 808 the following courses: NORTH 103.82 feet, EAST 125.00 feet, North 60.0~ feet, N 6o19'12.' E 90.89 feet, N 33037'53'' E 88.77 feetA N 40 20'52" E 115.79 feet, N 26°~3'16'' E 126.29 feet, and N 16v03'23'' E 110.17 feet to the Point of Beginning and con- taining 123.51 acres of land more or less. 2. The polls at said election shall be opened at 7:00 o'clock a.m. of the day herein fixed for the holding of said election and shall be kept open until 7:00 o'clock p.m. of the same day, when the polls shall be closed. 3. Upon the ballots to be used at said election there shall be printed the words: SHALL THE WESTBOROUGH INHABITED AREA BE ANNEXED TO THE CITY OF SOUTH SAN FRANCISCO, AND THE PROPERTY IN SUCH TERRITORY BE, AFTER SUCH ANNEX- ATION, SUBJECT TO TAXATION EQUALLY WITH THE PROPERTY ~THIN THE CITY OF SOUTH SAN FRANCISCO, TO PAY THE ENTIRE BONDED INDEBTEDNESS OF THE CITY OF SOUTH SAN FRANCISCO OUTSTANDING OR AUTHORIZED AT THE DATE OF THE FIRST PUBLICATION OF THE NOTICE OF ELECTION, FOR THE ACQUISITION, CONSTRUCTION OR COMPLETION OF MUNICIPAL IMPROVE- MENTS?~' Opposite these words there shall be printed the words ~'yes~' and ~no~', and to the right of each of these last two words there shall be a voting square. If an elector shall stamp a cross (~) in the voting square after the printed word ~yes~, the vote of such elector shall be counted in favor of the annexation of said territory to the City of South San Francisco; and if an elector shall stamp a cross (r) in the voting square after the printed word ~no~', the vote of such elector shall be counted against such annexation. In all particulars not herein recited, said election shall be held in conformity, as near as may be, with the laws of the State of California concerning general elections and with said Annexation Act of 1913. 4. (a) For the purpose of said election there hereby is established in the territory described herein two (2) voting pre- cincts, which shall include all of said territory. The following are the polling places of said election precincts and the following named persons hereby are named officers of election and shall constitute the board of election for such election precincts: WESTBOROUGH NO. 1 Polling Place: Drye Family Room - 3130 Dublin Drive Inspector: Mrs. Roberta J. Drye, 3130 Dublin Drive Judge: Mrs. Geraldine Matlock, 3120 Dublin Drive Judge: Mrs. June P. Grainger, 3090 Dublin Drive Judge: Mrs. Gretchen E. Toby, 2570 Bantry Lane CONSOL WESTBOROUGH NO. 2 and NO.3 Polling Place: Abold Garage - 2790 Tipperary Avenue Inspector: Mrs. Doris M. Abold, 2790 Tipperary Avenue Judge: Mrs. Carmen B. Calavano, 2421 Shannon Drive Judge: Mrs. Judith B. Levin, 2701 Shannon Drive Judge: Mrs. Mildred J. Ross, 2625 Shannon Drive (b) For their services in connection with said election, said in~pectom shall receive $ 18.00 and said judges $ 15.00 each; and the person in possession of the polling place named herein shall receive for the use of such premises in connection with said election the sum of $ 12.OO · 5. The City Clerk shall publish a notice of said special election as required by the Annexation Act of 1913, at least once a week for the four (4) weeks prior to the date of the election on 4. August 11 , 19~4 , in the Burlingame Advance Star, a newspaper of general circulation printed and published out- side of the City of South San Francisco but in the, County of San Mateo, California. 6. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be published once in the Enterprise-Journal, a newspaper of general circulation published in the City of South San Francisco· Introduced this 9th day of June , 196~ .
