AN ORDINANCE REPEALING ORDINANCE N0,348 OF THE CITY OF SOUTH SAN FRANCISCO, AND THE ADOPTION THEREBY OF THE ELECTRICAL CODE OF THE COUNTY OF SAN MATEOi; PRO- VIDING FOR THE ISSUANCE OF CERTIFICATES OF COMPE- TENCY OF PERSONS ENGAGED IN THE MAINTAINING AND EX- TENSIONS OF ELECTRICAL WIRING IN PLANTS; REQUIRING A PERMIT FOR THE INSTALLATION OR ALTERATION OF ELEC- TRIC WIRING, ELECTRIC SIGNS, AND EQUIPMENT; PROVID- ING FOR A BOARD OF ELECTRICAL EXAMINERS AND PRESCRIB- ING THEIR DUTIES; DEFINING CERTAIN TERMS; ESTABLISH- ING MINIMUM REGULATIONS FOR THE INSTALLATION OR ALTER- ATIONS OR ADDITIONS OR REPAIRS OF ELECTRICAL WIRING SYSTEMS AND THE INSPECTION THEREOF; PROVIDING PENAL- TIES FOR VIOLATIONS; AND ADOPTING BY REFERENCE THE ELECTRICAL CODE OF THE COUNTY OF SAN MATEO PASSED AND ADOPTED THE 14~]1 DAY OF JANUARY, 1964, AND THE NATION- AL ELECTRICAL CODE, 1962 EDITION, INCORPORATED BY REFERENCE THEREIN THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO does or- dain as follows: SECTION I. REPEAL OF ORDINANCE NO.348: Ordinance No.348 of the City of South San Francisco, passed and adopted on the 21st of December, 1953, is hereby repealed. SECTION II. ADOPTION OF THE ELECTRICAL CODE OF THE COUNTY OF SAN MATEO, CALIFORNIA: Definitions. That certain Ordinance entitled "Ordinance No.1630, Board of Supervisors, County of San Mateo, State of California: 'AN ORDIN- ANCE REPEALING SECTIONS 8200 THROUGH 8213, INCLUSIVE, OF THE SAN MATEO COUNTY ORDINANCE CODE AND ADOPTING THE "ELECTRICAL CODE OF THE COUNTY OF SAN MATEO", PROVIDING FOR THE ISSUANCE OF CERTI- FICATES OF COMPETENCY OF PERSONS ENGAGED IN THE MAINTAINING AND EXTENSIONS OF ELECTRICAL WIRING IN PLANTS; REQUIRING A PERMIT FOR THE INSTALLATION OR ALTERATION OF ELECTRIC WIRING, ELECTRIC SIGNS, AND EQUIPMEb~f; PROVIDING FOR A BOARD OF ELECTRICAL EXAM- INERS AND PRESCRIBING THEIR DUTIES; DEFINING CERTAIN TERMS; ESTAB- LISHING MINIMUM REGULATIONS FOR THE INSTALLATION OR ALTERATIONS OR ADDITIONS OR REPAIRS OF ELECTRIC WIRING SYSTEMS AND THE IN- SPECTION THEREOF; PROVIDING PENALTIES FOR ITS VIOLATION; AND INCORPORATING BY REFERENCE THEREIN THE NATIONAL ELECTRICAL CODE, 1962 EDITION", effective February 14, 1964, and hereinafter some- times referred to as "Electrical Code", is hereby adopted as an Ordinance of the City of South San Francisco, providing that the words and phrases in said Electrical Code, hereinafter respective- ly set forth, shall have the respective meanings next herein speci- fied: (a) "Unincorporated territories of the County of San Mateo" as set forth in Section 2, and "Unincorporated area of the County of San Mateo" as set forth in Article l(a) shall mean "Unincorporated area of the City of South San Francisco". (b) "Board of Supervisors of the County of San Mateo" shall mean "City Council of the City of South San Francisco". (c) "County of San Mateo", "San Mateo County" and/or "County" as set forth in Article l(a); Article 2 SeZion 1, Section 14 and 17(a), (b); Article 3 Section 1; Article 215 Section 2; Article 320, 328, 334, 336, 338, 339, and 342, shall mean "City of South San Francisco". (d) "Superintendent of Building Inspection" as set forth in Article 2 Section 2. and Section 13. shall mean "Chief Building Inspector". (e) "County Manager" as set forth in Article 2 Section 15. shall mean "City Manager". (f) "County Official" as set forth in the title to Article 3 Section 4. shall mean "City Official". SECTION III. COST OF PERMIT: Section 20. of Article 2 is hereby amended so that the text as therein written shall be designated as Subsection (d), and'Sub- sections (a), (b) and (c) shall be added thereto, which Subsections shall read as follows: COST OF PERMIT Section 20. (a) At the time of the issuance of the Building Permit, the Building Inspection Department shall, in conjunction with the collection of the Building Permit fee, require the payment of the Electrical Permit fee. (b) Should~the nature of the electrical work not be known at the time of the issuance of the Building Permit, the minimum Permit fees may then be based on the valuation of the proposed construction (Section 20(c)), pro- vided further that prior to the Building Inspector making a final inspection, the Electrical Permit shall be revised by computing the Permit fees, said fees to be as those set forth me in Section 20(d), and any additional or Electrical Per- mit fees shall then be paid to the Building Inspection Department by the electrical contractor. (c) Electrical Permit Fee Schedule Of Flat Rates. Building Valuation: For building valuation to and including $1,OOO.OO ..... $ 5.00 For additional $1,0OO.OO or fraction thereof, to and including $25,000.00 ....................... 75 For additional $1,OOO.OO or fraction thereof, to and including $1OO,OOO.OO ...................... 50 For additional $1,OOO.OO or fraction thereof, more than $1OO,OOO.OO ............................ 25 (d) Provisions as set forth in the Electrical Code of San Mateo County, Section 20. SECTION IV. PENALTY FEE FOR LATE APPLICATION: Whenever an Electrical Permit fee is required, by this Ordin- ance to be paid prior to starting electrical work, and such work is started prior to obtaining a Permit, a double fee for each Permit shall be charged. Whenever the double Permit fee is less than Twen- ty Dollars ($20.00), the charge shall be the same as the standard Permit fee and inspection fee, plus Ten Dollars ($10.OO). SECTION V. VIOLATION AND PENALTIES: It shall be unlawful for any person, firm or corporation to violate any provision, or fail to comply with any of the requirements, of this Ordinance, or any portion which incorporates the Electrical Code of the County of San Mateo into this Ordinance, or said parts of the Electrical Code of the County of San Mateo incorporated in- to this Ordinance. Any person violating any of the provisions, or failing to comply with any of the mandatory requirements of this Ordinance, or any portion which incorporates the Electrical Code of the County of San Mateo into this Ordinance, or said parts of the Electrical Code of the County of San Mateo incorporated into this Ordinance, shall be guilty of a misdemeanor, and upon conviction shall be punished by a fine of not less then Twenty-Five Dollars ($25.00) and not exceeding Five Hundred Dollars ($500.00), or by imprisonment for not exceeding six months, or by both such fine and imprisonment. SECTION VI. LEGISLATIVE AUTHORITY NOT GRANTED: The provisions of this Ordinance are not intended to and do not grant any legislative authority to the Chief Building Inspector and any grant of discretion or authority to him contained herein shall be construed as limiting his powers to the determination of facts as to whether or not the rules laid down in this Ordinance have been complied with. SECTION VII. VALIDITY OF ORDINANCE: If any section, subsection, sentence, clause or phrase of this Ordinance or any portion which incorporates the Electrical Code of the County of San Mateo into this Ordinance, or said incorpor- ated part of the Electrical Code of the County of San Mateo into this Ordinance is for any reason held t° be unconstitutional, such decision shall not affect the validity of the'remaining portion of this Ordinance or any portion which incorporates the Electrical Code of the County of San Mateo into this Ordinance, or said parts of the Electrical Code of the County of San M~teo incorporated into this Ordinance. The City Council of the City of South San Francisco hereby declares it would have passed this Ordinance or any portion which incorporates the Electrical Code of the County of San Mateo into this Ordinance, or said parts of the Electrical Code of the County of San Mateo incorporated into this Ordinance, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, clauses or phrases are declared unconstitutional. SECTION VIII. EFFECTIVE DATE AND PUBLICATION: This Ordinance shall be in full force and effect thirty (30) days after the date of final passage and approval. The City Clerk shall certify to the passage of this Ordinance and cause same to be published in the Enterprise-Journal, a newspaper of general circulation published in the City of South San Francisco, as re- quired by law.
