HomeMy WebLinkAboutOrd 525-1965 ORDINANCE NO. 525 AN ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL, DEMOLITION, CONVERSION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA AND MAINTENANCE OF ALL BUILDINGS AND STRUCTURES IN THE CITY OF SOUTH SAN FRANCISCO; PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THERE- FOR; PROVIDING PENALTIES FOR THE VIOLATION THERE- OFg- DECLARING AND ESTABLISHING FIRE ZONES; REPEAL- ING ORDINANCE N0.469 OF THE CITY OF SOUTH SAN FRAN- CISCO AND ALL OTHER ORDINANCES IN CONFLICT THERE- WITH, AND ADOPTING BY REFERENCE THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS' UNIFORM BUILDING CODE 1964 EDITION (AND APPENDIX) VOLUME I AND CODES THEREIN ADOPTED THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS: SECTION I: Adoption of Uniform Building Code 1964 Edition except for certain sections, subsections and parts of sections: All of the provisions of the Uniform Building Code 1964 Edition Volume I (and Appendix) and codes therein adopted, approved at the Forty-First Annual Business Meeting of the International Conference Of Building Officials, September 3Oth - October 4th, 1963, except the following sections, sub- sections and parts of sections, are hereby adopted and made part of this Ordinance as though fully set forth herein: Section Exception Section Exception 204 - Ail of the section 303(a) - Only Table 3-A of Subsection (a) 205 - Ail of the section 303(b) - Only Subsection (b) of the section Section Exception Section Exception 1045(a) - Only the last paragraph 5101(d) - Only the third of Subsection (a) paragraph of Subsection (d) 2508 (2) - Only Subsection (2) of the Section 5107(o) - All of Subsec- tion (o) 2806(b) - Only Exception 3 of Subsection (b) 6003 - All of the Section 3103 - Only the last paragraph 6004 - Ail of the Section of the Section Chapter 70 4203(1) - Only Subsection (1) (Appendix) All of the Chapter of the Section Three copies of said codes Volume I (and Appendix) and codes therein adopted, certified to be true copies, shall be filed in the office of the City Clerk in the form and at the times prescribed by law and kept there for public inspection during the time this Ordinance is in effect, except that after adoption of this Ordinance one of said copies may be kept in the office of the Chief Building Official instead of the City Clerk's office. The City Clerk shall maintain a reasonable supply of copies available for purchase by the public as required by law. SECTION II: Sections, subsections and parts of sections added: The following sections, subsections and parts of sections, which shall read as hereinafter stated, are hereby adopted and added to the Uniform Building Code 1964 Edition, which was adopted by reference in Section I of this Ordinance: me Section Addition Section Addition 205 - A new Section 2806(h) - Subsection (h) to said Section 303(a) - Table 3A to Sub- section (a) 3103 - A third paragraph 303(b) - Subsection (b) to 4203(1) - Subsection (1) to said Section said Section 1405(a) - A fourth paragraph 4710(f) - Subsection (f) to said Section 1503 - An exception 5101(d) - A third paragraph 2508(2) - Subsection (2) to to said subsection said Section 2517(a) - A third paragraph 6003 A new Section 2629 - A second paragraph 6004 A new Section 2806(g) - Subsection (g) to said Section 205. Violations and Penalties: It shall be unlawful for any person, firm or corpor- ation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy or maintain any building or structure in the city, or cause the same to be done, contrary to or in violation of any of the provisions of this Code. Any person, firm, or corporation violating any of the provisions of this Code shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the ® provisions of this Code is committed, continued, or permitted, and upon conviction of any such violation such person shall be punishable by a fine of not less than Twenty-Five Dollars ($25.00) and not exceeding Five Hundred Dollars ($500.00) or by imprisonment for not exceeding six (6) months, or by both such fine and imprisonment. 303(a). Table 3A - Building Permit Fees: TOTAL VALUATION FEE Less than $10.00 ........ . . . . Plan Checkin~ Fees: When a plan is required to be submitted by Subsection (c) of Section 301, a plan checking fee shall be paid to ® the Building Official at the time of submitting plans and specifications for checking, should the Building Official determine that any costs will be incurred in having the plans checked. Said plan checking fee shall be equal to one half of the building permit fee as set forth in Table 3A. Upon completion of the plan check, should the cost incurred be less than one half of the building permit fee as set forth in Table No.3A, the difference shall be refunded. 1405(a). Windows. Addition of fourth paragraph: Required windows shall open on a court, yard or street. Required windows shall not open through a roofed porch (or similar roofed areas) unless the porch: a. Abuts a street, yard or court. b. Has a minimum clear height of not less than seven (7') feet measured between the floor and the lowest underside portion of the roofed porch, and a depth of not more than seven feet (7') measured at right angle from the window to the edge of roof, and is designed and constructed with oneside or end at least fifty percent (50%) open and unobstructed, except for the usual rails, balustrades or similar necessary struc- tural features, but such openings shall be equal to not less than one-third (1/3) of the perimeter of the exterior walls. Openings shall be maintained directly under the roof, and shall be maintained within twelve feet (12') of required windows. EXCEPTION: Depth may be increased to ten feet (10') providing one side and one end is at least fifty percent (50%) open, both such ~peniJgs shall be equal to not less than two-thirds (2/3) of the perimeter of the ex- terior walls, and depth may be increased to twelve feet (12') providing one side and one end is one hundred per- cent (100%) open or at least fifty percent (50%) open on three sides. 1503. Location on Property. Addition of Exception: EXCEPTION: Exterior walls of any structure of any Group J Occupancy' in a residential zone, the area of which structure does not exceed one hundred fifty (150) square feet and the use of which is not for garag- ing of boats or any motor vehicles and which structure is located on the rear half portion of the lot need not be of a one-hour fire-resistive construction. 2508(2). Firestops: In all stud walls and partitions, including furred space~ so placed that the maximum dimension of any con- cealed space is not over seven feet (7'). 2517(a). Foundation Ventilation. Addition of third paragraph: Minimum clearance between bottom of heating ducts and the ground beneath shall be twelve inches (12"). 2629. Minimum Slab Thickness. Addition of second paragraph: Following are the requirements for concrete slabs on ground used as a finish floor or as a base for other floor finish in dwellings or habitable rooms. 1. A minimum thickness of reinforced concrete, three and one-half inches (3~"), with 6" x 6" x 10 gauge wire mesh. 2. Membrane water-proofing or water-proofing accept- able to the Building Inspector shall be provided so as to extend to the exterior walls or beyond the limits of habitable rooms and turn up to top of slab. 3. A granular fill of proper consistency and thick- ness shall be provided directly under concrete slab to retard capillary action and shall be approved by the Building Inspector. 4. The elevation of the floor slab shall be main- tained at one foot (1') above sidewalk level. EXCEPTION: If one foot (1') elevation above sidewalk leVel cannot be maintained due 'to the slope of a lot or location of the building on a lot, the Building Inspector shall approve an alter- nate, provided, however, that in all cases a one- foot (1') elevation shall be maintained above fin- ished grade level. 5. A method to eliminate water seepage through stucco walls from flowing in upon concrete slab shall be provided in every case and shall be approved by the Building Inspector. 2806(g). Rat Proofing: Every building or portion thereof, shall be made rat- proof by covering all otherwise exposed earth within the foundation walls with a concrete covering having a mini- mum thickness of two inches (2"). 2806(h). Reinforcing in Foundation: For Group H and I Occupancies: A minimum of two (2) half-inch (½") steel reinforcing rods shall be placed in continuous foundation. 310~. Wood Floors. Addition of a third paragraph: An eighteen inch by twenty-four inch (18" x 24") ac- cess crawl opening shall be provided to the under floor spac~ and in an exterior wall. 0 4203(1). Application of Controlled Interior Finish: When walls and ceilings are required by any provision in this Code to be of fire-resistive or in- ' ?i' combustible construction, the finish material of any class shall be applied directly against such fire-resistive construction or to furring strips not exceeding one a,d three-fourth inches (1-3/4") applied directly against such surfaces. The inter- vening spaces between such furring strips shall be filled with inorganic or Class I material or shall be fire-stopped not to exceed seven feet (7') in any direction. 4710(f). Exterior PlasterinR Backing: Building paper providing as follows: Anything in Section 4710 or elsewhere in this Code to the con- trary notwithstanding, in all cases where plastering or stucco is applied to the exterior of a wood frame building, the building paper required shall be applied on sheathing or similar backing, and never on wires stretched horizontally across the stud frame. 5101(d). Installation. Addition of a third paragraph: Gas appliances generating a glow or flame capable of igniting flammable vapors may be installed in a garage provided the pilots and burn~rs are at least twenty-four inches (24") above the floor level. 6003. Repeal of Prior Ordinances: Ordinance No. 469 and ordinances amendatory thereof are hereby repealed except that this repeal shall not affect or prevent the prosecution or pun- ishment of any person for any act done or committed in violation of any Ordinance hereby repealed prior to the effective date of this Ordinance. 6004. No Grant of Legislative Authority: The provisions of this Ordinance are not in- tended to and do not grant any legislative authority to the Building Official, and any grant of discretion- ary authority to the Building Official, contained herein, shall be construed as limiting his powers to the determination of facts as to whether or not tbe rules laid down in the Code have been complied with. SECTION III: Provision for double fees: Where work for which a Permit is required by the Uniform Build- ing Code 1964 Edition and the terms of this Ordinance is started or proceeded with prior to obtaining said Permit, the fees spe- cified in said Code and Ordinance shall be doubled, but the pay- ment of such double fee shall not relieve any person from fully complying with the requirements of said Code and Ordinance in the execution of the work nor from any other penalties prescribed therein. 10. SECTION IV: Effective Date and Publication: This Ordinance shall be in full force and effect thirty (30) days after the date of final passage and adoption. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published in the "Enterprise-Journal" as required by law. Introduced this 15%h day of March , 19 65 .
