AN ORDINANCE OF TIlE CITY OF SOUTH SAN FRANCISCO REGULATING THE INSTALLATION AND MAINTENANCE OF HEATING, VENTILATING, COMFORT COOLING AND REFRIG- ERATION SYSTEMS IN THE CITY OF SOUTH SAN FRANCISCO PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES TtIEREOF; PROVIDING PENALTIES FOR THE VIOLA- TION THEREOF; AND ADOPTING BY REFERENCE THE INTER- NATIONAL CONFERENCE OF BUILDING OFFICIALS' UNIFORM MECHANICAL CODE 1967 EDITION, UNIFORM BUILDING CODE VOLUME II. THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS: SECTION. I: Adoption of the Uniform Mechanical Code 1967 Edition Uniform Building Code Volume II, except for certain sections, subsections and parts of sections: Ail of the provisions of the Uniform Mechanical Code 1967 Edition, Uniform Building Code Volume II printed in one volume and published by the International Conference of Building Offici9ls, except the following sections, subsections, and parts of sections are ,hereby adopted and made part of this Ordinance as though fully set forth herein: Section Exception 201(c) Only Subsection (c) of the Section 202 Ail of the Section 203 Ail of the Section 304 Only items 6, 7, 13, 16, 17, 18, 19, 20, a.d 21 Three copies of said codes, Uniform Mechanical Code 1967, Uniform Building Code Volume II certified to be true copies, shall be filed in the office of the City Clerk in the form and at the times prescribed by law and kept there for public inspection during the time this ordinance is in effect, except that after of this Ordinance one of said copies may be ~<,~,t [. t~,~. the Chief Building Official instead of the Ciny Clerk's office. SECTION II: Sections, Subsections, and parts of Sections added: The following sections, subsections and parts of sections, which shall read as hereinafter stated, are hereby adopted and added to the Uniform Mechanical Code 1967 Edition, Uniform Building Code Volume ii, which was adopted by reference in Section I of this Ordinance: Section 201(c) 2O2 3°4 Addition Subsection (d) 1, 2a, 2b, 2c and 3 A new Section izem 13, 18 and 19 to said Section 201(c) Right of Entry: (1) Permit Inspections: Upon presentation of proper credentials the Building Official or his duly-authorized representa- tive may enter at reasonable times any building, s~ructure, or premises in the City wherein or whereon construction, repairs and/or other acts are being performed pursuant to a permit issued pursuant to the provisions of this Code, to perform any duty imposed upon him by this Code. (2) Routine Inspections: The Building Official or his authorized repre- sentatives shall not enter any building or premises without the consent of the owner or occupant thereof, 2. unless he possesses a reasonable search warrant authorizii~g entry ~,~,I searct~ ~f tl'~ ~re,,~l~,~ c~,-i,t in the following instances: (a) Entry of a building or premises for the purpose of investigating the existence of suspected or reported.damage or defects which constitute an immediate danger to human life or an immediate hazard to public safety or health which shall be interpreted to mean an emergency situation. (b) Inspection of a portion.of commercial structures or areas ordinarily open to the public. (c) Reasonable inspection of non-public portions of commercial establishments as a condition of reiicensing. (3) Interference with Building Official: No person shall hinder or prevent the Building Official or his authorized representative, while in the performance of the duties herein described, from entering upon and into, as hereinbefore set forth, any and all premises under his jurisdiction at all reasonable hours, for the purpose of .inspecting the same to determine whether or no~ the provisions of this Code and all other applicable laws or ordinances pertaining to the protection of persons or property, are observed therein. 202 304 13. Violation and Penalties: it ~.i,;,li be ~]..awf~J! for any corpo~atio~ to erect, install, alter, repair, relocate, add to, replace, use, or maintain heating, ventilating, comfort cooling, or refrigeration equipment in the jurisdiction, or cause the same to be done, contrary to or in violation of any of the provisions of this Code. Maintenance of equipment which was unlawful at the time it was installed and which would be unlawful under this Code if installed after the effective date of this Code, shall constitute a continuing violation of this Code'. Any person, firm or corporation violating any of the provisions of this Code shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Code is committed, continued, or permitted, and upon conviction of any such violation such person shall be punishable by a fine of not more than $500.00, or by imprisonment for not more than six months, or by both such fine and imprisonment. Permit Fees: 'For each fan unit over 1,000 CFM. to and including 10,000 CFM, including ducts attached thereto . . . . . $3.00 18. SECTION iV: Effective Date and Publication: This Ordinance shall be in full force and effect ~30~ days after the date of final passage and adopCion.
