HomeMy WebLinkAboutOrd 579-1968ORDINANCE NO. ~7~ AN ORDINANCE ORDERING REMOVAL OF OVERHEAD STRUCTURES, WIRES AND FACILITIES AND INSTALL LATION OF UNDERGROUND WIRES AND FACILITIES IN UNDERGROUND UTILITY DISTRICT NO. 1. THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS: SECTION I. FINDINGS: The City Council finds and determines as follows: A. A public hearing was duly called and held on August 5, 1968, at the hour of 8:00 p.m. in the Council Chambers in the City Hall of South San Francisco to ascertain whether the public necessity, health, safety or welfare required the removal of poles, overhead wires and associated overhead structures;and .the underground installation of wires and facilities for supplying electric, communication or similar or associated services in Underground Utility District No. ii and that notice of such hearing was given to all affected property owners as shown on the last equalized assessment rol~ and utilities concerned in the manner and for the time required by law; and all persons were given an opportunity to be heard. B. The public necessity, health, safety and welfare requires the removal of poles, overhead wires and associated structures, and the underground installation of wires and facilities for supplying electric, communication or similar or associated service in Underground Utility District No. l, which consists of a portion of Camaritas Avenue from E1 Camino Real to Arroyo Drive as hereinafter described. C. The under§roundin§ to be accomplished pursuant to this Ordinance will void or elimi,ate any unusually heavy concentration of overhead distribution facilities. D. The streets, roads or rights-of-way in the District are extensively used by the general public and carry a heavy volume of pedestrian or vehicular traffic. E. The said streets, roads or ri§hts-of-way adjoin or pass through or near a civic area, a public recreation area and an area of unusually scenic interest to the general public. SECTION II. ESTABLISHMENT OF UNDERGROUND UTILITY DISTRICT NO. l: Underground Utility District No. 1, consisting of the parc,~l ~' delineated on the plat marked Exhibit "A", hereby incorporated in and made a part of this Ordinance, is hereby established. SECTION III. REMOVAL OF OVERHEAD FACILITIES; TIMES THEREFOR: The Council hereby fixes October 7, 1968, as the date on which affected property owners must be ready to receive underground service and does hereby order that all poles, overhead wires and associated overhead str~ctures be removed and underground installations made in said Underground Utility District within the following times: A.' Underground installation by utility companies and property owners and reconnections not later than November 4, 1968; B. Removal of poles, overhead wires and other associated overhead structures not later than November 4, 1968. SECTION IV. NOTICE The City Clerk is hereby instructed to notify all affected utilities and all persons owning real property within Under- ground Utility District No. 1 of the adoption of this Ordinance within ten (10) days after the date of such adoption. The City Clerk shall further notify said property owners of the necessity that, if they or any person occupying such property desire to continue to receive electric, communication or other similar or associated service', they or such occupant shall, by the date fixed in this Ordinance provide ali,,necessary facility changes on their premises so as to receive such service from the lines of the supplying utility or utilities at a new location, subject to applicable rules, regulations and tariffs of the respective utility or utilities on file with the Public Utilities Commission of the State of California. The notification shall be' made by mailing a copy of this Ordinance together with a copy of Ordinance No. 566 to the affected property owners as such are shown on the last equalized assessment roll and the affected u~ilities. SECTION V. ADOPTION PURSUANT TO ORDINANCE NO. 566 This Ordinance is adopted pursuant to Ordinance No. 566 of the City of soUth San Francisco which ordinance was passed 0 and adopted on the seventh (7th) day of August, 1967. SECTION VI. EFFECTIVE DATE AND PUBLICATION This Ordinance shall be in full force and effect thirty (30) days from and after the date of final passage and approval. The Clerk shall certify to the passage of this Ordinance and cause the same to be published in the Enter- prise-Journal as required by law. AYES, Introduced this 9th day of August , 19. 68 .
