HomeMy WebLinkAboutOrd 588-1969WJML:KIJ:dao 1/27/69 1Sc ORDINANCE NO. 588 AN ORDINANCE PROVIDING FOR THE ISSUANCE OF BONDS CITY OF SOUTH SAN FRANCISCO, CALIFORNIA $150,000 SEWER REVENUE BONDS OF 1969 SOUTH AIRPORT BOULEVARD AREA The City Council of the City of South San Francisco does ordain as follows: Section 1. Sewer revenue bonds of the City of South San Francisco in the principal amount of ~$150,000 shall be issued pursuant to Chapter 5, Part 3, Division 5 of the Health and Safety Code of the State of California (common- ly referred to as the Sewer Revenue Bond Act of 1933), subject to all of the provisions of Resolution No. 5045 , A Resolution Providing for the Issuance of Sewer Revenue Bonds, Fixing the Form of the Bonds and Providing Covenants for Their Protection, adopted by the City Council of the City of South San Francisco on February 17, 1969, on file in the office of the City Clerk of said City, all of the terms of which are hereby referred to and incorporated here- in by reference. Section 2. This Ordinance shall take effect and be in force thirty days from and after its adoPtion. Section 3. The City Clerk shall certify to the pas- sage of this Ordinance and cause the same to be published in the Enterprise-Journal, a newspaper of general circula- tion published and circulated in said City, as required by law within fifteen days after passage. at a regular San Francisco this 3rd vote: AYES, COUNCILMEN Introduced this 17th day of February, 1969. Mayor ORDINANCE NO. ,589 AN ORDINANCE ORDERING REMOVAL OF OVERHEAD STRUCTURES, UIRES AND FACILITIES AND INSTAL- LATION OF UNDERGROUND }?IRES A~fD FACILITIES IN UNDERGROUND UTILITY DISTRICT NO. 2 - PHASE A & B THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS: SECTION I. FINDINGS: The City Council finds and determines as follows: A. A public hearing was duly called and held on February 17, ~969, at the hour of 8:00 p.m. in the Council Chambers in the City Hall of South San Francisco to ascertain whether the public necessity, health, safety or welfare required the removal of poles, overhead wires and associated Overhead structures; and the underground installation of wires and facilities for supplying electric, communication or similar or associated services in Underground Utility District No. 2 - Phase A & B; and that notice of such hezring was given to all affected property owners as shown on the last equalized assessment rolls and utilities concerned in the manner and for the time required by law; and all persons were given an opportunity to be heard. B. The public necessity, health, safety and welfare requires the removal of poles, overhead wires and associated structures~ and the underground installation of wires and facilities for supplying electric, communication or similar or associated service in Underground Utility District No. 2 - Phase A & B, which consists o£ El~Camino Real - from the South C~rporate Limit ~Line at Noor Avenue to the North Corporate Limit Line as hereinafter described~ The undergrounding to be accomplished pursuant to this Ordinance will void or eliminate any unusually heavy concentration of overhead distribution £acilitiesj D'~ The streets~ roads or ri~hts-o£-way in the District are extensively used by the general public and carry a heavy volume o£ pedestrian or vehicular traf£ic. E.' The said streets~ roads or rights-of-way adjoin or pass through or near a civic area, a public recreation area and an area of unusually scenic interest to the general publicj SECTION II. ESTABLISPR~ENT OF UNDERGROUND UTILITT DISTRICT NO. 2 - PHASE A & B Underground Utility District No~ 2 - Phase A & B, consisting of the parcels delineated on the plat marked Exhibit "A~, hereby incorporated in and made a part of this Ordinance, is hereby establishedj SECTIOM III. RENOVAL OF OVERHEAD FACILITIES: TI~ES THEREFOR: The CounCil hereby fixes July l, 1~8~ as the date on Which affected property owners in .Phase A of District Noj 2~ South City Corporate Limit Line to Second Street, must be re~dy, to roceive underEround service and doos hereby order that all poles~ overhead wires and associated overhead structures be removed and underground installations made in said Underground Utility District No. 2~ Phase A, within the following times: 2' A. Underground installation by utility companies and property owners and reconnections not later than January l, 19?O; B. Removal of poles, overhead wires and other associated overhead structures not later than February l, 1970; C. Removal of existing overhead £acilities and underground installation by utility companies and property owners on the remaining portion o£ District No. 2, Phase B, Second Street'to the North City Corporate L~t Line, is tentatively scheduled £or mid-19?2 on completion o~ the remaining portion o£ E1Camino Real. Dates concerning £ixed times £or this portion shall be £ixed~ revised, or altered at disclosure of the construction schedule by the Division of Highways~ and utility companies and property owners shall be noti£ied accordingly. SECTION IV. NOTICE The City Clerk is hereby instructed to notify all a££ected utilities and all persons owning real property within Under- ground Utility District No. 2 - Phase A ~ B, of the adoption o£ this Ordinance within ten (10) days a£ter the date of such adoption. The City Clerk shall £urther noti£y said property owners of the necessity that, if they or any person occupying' such property desire to continue to receive electric, c~mmunication or other similar or associated service, they or such.occupant shall, by the date fixed in this Ordinance provide all necessary £acility changes on their premises so as to receive such service £rom the lines of the supplying utility or utilities at a new location, subject to applicable rules, regulations and tari££s of the ~espective utility or utilities on file with the Public Utilities Commission of the State of Cali£ornia, The notification shall be made by mailing a copy of this Ordinance together with a copy of Ordinance No. 585 to the affected property owners as such are shown on the last equalized assessment roll and the affected utilities~ SECTION V. ADOPTION PURSUANT TO ORDINANCE NO. $88 This Ordinance is adopted pursuant to Ordinance No. $88 of the City of South San Francisco which ordinance was passed and adopted on the seventh (?th) day o£ August, 1987~ SECTION VI.
