HomeMy WebLinkAboutOrd 700-1976 ORDINANCE NO. 700-76 AN ORDINANCE OF THE CITY 0F SOUTH SAN FRANCISCO PROVIDING FOR THE PAYMENT OF SALARIES TO MEMBERS OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO. The City Council of the City of South San Francisco does ordain as follows: SECTION 1. PURPOSE. This 0rdinanee is enacted pursuant to Section 36516 of the Government Code~ as added by Chapter 1378 of the Statutes of 1974~ formerly Government Code Section 36514~ added by Statutes~ First Executive Session 1966: Chapter 12~ authorizing the Council to provide by Ordinance that each member of the Council shall receive a prescribed salary~ the amount of which is based upon the population of the City as determined by estimates made by the State Department of Finance~and Section 36516.2 of the Government Code~ and related seetions,~authorizing an increase in said salaries not exceeding an amount equal to Five percent (5%) for each calendar year from the operative date of Ordinance No. 539~ adopted November 15: 1965. SECTION 2. POPULATION AND OPERATIVE DATE OF SALARY IN EFFECT, As of the date of passage of this 0rdinance~the latest esti- mate of population of the City of South San Francisco made by the Department of Finance is forty-seven thousand six hundred fifty. December 15~ 1975~ was the operative date of Ordinance No. 539 entitled "An Ordinance of the City of South San Francisco provid- · ing for The payment of salaries to members of the City Council of the City of South San Francisco" adopted November SECTION 3o SALARIES. Each member of the Council of-the City of South San Francisco shall receive as salary the-following: 3.1. The sum of Two hundred dollars ($200) per month, as prescribed in said Section 36516 of the Government Code for cities over thirty-five-thousand up to and including fifty thousand in population, which shall be payable from and after the operative date of this Ordinance at the same time and in the same manner as salaries are paid to other officers and employees of the City of South San Francisco; and 3.2. An increase in The salary authorized by Section 3.1 hereof, equailing but not exceeding Five percent (5%) for each calendar-year cumulatively from January 1, 1966, the first calendar year after the operative date of Ordinance No. 539, described in Section 2 hereof, said cumulative sum totalling One hundred dollars ($100) per month and resulting in a total' salary of Three hundred dollars ($900) per month, which shall be payable from and after the operative date of this Ordinance, at -the same time and in the same manner as salaries are paid to other officers and employees of the City of South San Francisco. SECTION 4. INCREASE OR DECREASE. The salaries herein provided may be increased or decreased as follows upon authorization by whichever of the following is applicable, the adoption of an ordinance or a majority of the electors voting at any municipal election therefor, except that the salaries as so increased or decreased shall become payable only on and after the date upon which one or more members of the Council become eligible therefor by virtue of beginning a new term of office following a general municipal election held in the City of South San Francisco. 4.1. Following any new and later estimate of population made by the Department of Finance, plac- ing the City of South San Francisco in a population group other than that set forth in Section 2 hereof, the salary hereby payable to each member.of the Council may be increased or decreased accordingly to equal the sum prescribed for that population group in Section 36S16 of the Government Code, as added by Chapter 1378 of the Statutes of 1974. 4.2. An amount equal to Five percent (5%) for each calendar year from the operative date of the last adjustment of the salaries in effect, in accordance with Government Code Section 36S16.2. 4.3. In accordance with Government Code Sections 3651q and 36516, by a majority of the electors voting at any municipal election. SECTION 5. REIMBURSEMENT. The salaries prescribed herein are and shall be exclusive of any amounts payable to each member of the Council as reimburse- ment for actual and necessary expenses incurred by him in the performance of official duties for the City of South San Francisco. SECTION 6. OPERATIVE DATE. This Ordinance shall become operative only on and after the date upon which one or more members of the Council of the City of South San Francisco become eligible for the salary prescribed herein by virtue of beginning a new term of office following the general municipal election next succeeding its effective date, and prior to said operative date Councilmen's salaries shall be Two hundred dollars ($200) per month. SECTION 7. SEPARABILITY. It is the intention of the City Council that this Ordinance and every provision thereof, shall be considered separable, and the invalidity of any section, clause, provision, or part or por- tion of any section, clause or provision of this Ordinance, shall not affect the validity of any other portion of this Ordinance. SECTION 8. REPEAL OF ORDINANCE NO. 539. Ordinance No. 539, adopted November 15, 1965, entitled "An Ordinance of the City of South San Francisco providing for the payment of salaries to members of the City Council of the City of South San Francisco" is hereby repealed. SECTION 9. PUBLICATION AND EFFECTIVE DATE. This Ordinance shall be published once in the Enterprise- Journal, as prescribed by law, and shall take effect and be in force thirty (30) days from and after the date of its adoption.
