OR._ THE CITY OF SOUTH SAN FRANCISCO,"AND REPEAL- ING ORDINANCE NO. 216 AND ALL INCONSISTENT ORDINANCES. THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS: SECTION 1. Amendment of Section 4. Section 4 of Ordinance No. 449, adopted March 21, 1960, is hereby amended to read: Section 4. Personnel Board Establ,ishment; Members; Chairman and Secretary; Place of Meetin.q; Compensation; and Related Matters... ~ 4.1. 4.2. Board Establishment; Members and Appointment. The South San Francisco Personnel Board is hereby established, consisting of five (5) members who are electors of the City, and are in sympathy with the merit principles of public employment, except that no person shall be appointed to the Board who holds any salaried public office. Terms; Limitation ;and .Vacancy. 4.2.1. Term. The term of each member of the Board shall be four (4) years and until a successor has been appointed and qualified, except that commencing Board Member No. I Board Member No. 2 January 1, I977, the first term shall be two (2) years for Board members Nos. 1 and 2, and four (4) years for Board members Nos.. 3, 4 and 5, as described below, which description establishes the base dates for future appointments. The Council may designate the respective Board members presently serving or appointed prior to Jan- uary 1, 1977, to fill each of the Board offices described below, and until so designated the Board members presently serving or appointed prior to January 1, 1977, shall continue in their respective offices unless a successor has been appointed and qualified. Two (2) years commencing January 1, 1977, and ending December 31, 1978.. Two (2) years commencing January 1, 1977, and ending December 31, 1978. Board Member No. 3 Board Member No. 4 Board Member No. 5 Four (4) years commenc- ing January 1, 1977, and ending December 31, 1980. Four 14) years commenc- ing January 1, 1977, and ending December 31, 1980. Four 14) years commenc- ing January 1, 1977, and ending December 31, 1980. 4.3 4.2.2. Limitation, Com~ncing on January 1, 1977, Board Members shall be limited to two (2) consecutive terms. 4.2.3. Vacancy. Upon a vacancy occurring on the Personnel Board for any reason, including but not limited to (1) resig- nation, (2) Council declaration of vacancy for a Board members's failure to attend four (4) consecutive regular meetings, without excuse by the Board, and (3) removal by majority vote of the Council, a successor shall be appointed by the Council to fill the unexpired portion of the term.. Chairman, Chairman Pro Tem and Secretary. On the 30th day of January of each year, the Board shall elect a chairman, chair- Il I i lin[ man pro tem and appoint a secretary and sec- retary pro tern. The term of said offices shall be one (1) year. The chairman pro rem and secretary pro tem shall serve in the absence of the chairman and secretary. 4.4. Place of Meetings. 4.4.1. If a meet- ing is set for said regular meeting place of the Board, or duly noticed for an alternate meeting place, and be- m Illl IT" Ii ] !lit 4.4.2. cause of necessity or emergency the Board is required to meet in another place within the corporate limits of the City of South San Francisco, then the secretary shall appear at the regular or'alternate meeting place, whichever is the case, at the time set for the meeting, and publicly. announce the new meeting place and post a notice of same on the door of the regular meeting place. Notices of all meetings, except regular meet- ings, shall be served on each Board member and to each person who has requested notice in writing of such meetin§s, at least twenty-four (24) hours prior to the time specified for the proposed meeting, and said notices shall comply with the Government Code Section 54950, et seq., also referred to as the Ralph M. Brown Act or Secret Meeting Law. Holidays. If the day designated as a regular, adjourned regular, special or study meeting falls upon a legal holiday 1'1111 the Board shalll meet-upon the next succeeding day which is not a holiday, unless otherwise ordered by the Commission. 4.5. Compensation. The Board members and secretary shall receive the compensation established by the City Council pursuant to reso)ution or ordinance. 4.6. Clerk's Maintenance of Records and Notice to Counci 1. 4.6.1. Record Maintenance. The City Clerk shall establish and maintain a record of the names, addresses, telephone numbers, dates of appointment and dates of termination of each Board Member and the names of the chairman, chairman pro rem,and the dates of their election and termination of service in those offices. 4.6.1. Notice to Council of Term Expiration. The Clerk shall give the Council written notice of the expiration of a Board member's term sixty (60) days prior thereto. · IIn 4.7. Eligibility for Employment. A Board member shall not be eligible for appointment to a salaried position with the City of South San Francisco for a period of two (2) years from and after the date of his termination as a member of the Board. SECTION 2. Publication and Effective Date. This ordinance shall be published once.in the Enterprise- Journal, a newspaper of general circulation in the City of South San Francisco, as required by law, and shall become effective thirty (30) days from and after adoption, and operative on December 31, 1976, at twelve o'clock (12:00) p.m. Introduced this 18tn day of Aucust , 1976.
