HomeMy WebLinkAboutOrd 709-1976 ORDINANCE NO. 709-76 AN ORDINANCE ESIABLISHING A PARKING PLACE COMMISSION PURSUANI TO STREETS AND HIGH~,;AYS CODE SECTION 35550, ET SEQ. SECTION 1. Commission Establishment; Members; and Appointment. The. South San Francisco Parking Place Commisson ~s hereby established, consisting of three (3) members who are residents and quali- fied electors of the City, andwhose business experience and ability reasonably assure that the affairs of the district will be administered in the interests of the district. The Commissioners shall be appointed by the Mayor, subject to confirmation by the CityCouncil. SECTION 2. Terms; Limitation; and VacancX. 2.1. Terms. The term of each member of the Commission shall be three (3) years and until a successor is appointed and qualified, 'except that commencing January 1, 1977, the first term shall be one (1) year for Commissioner No. 1, two (2) years for Commissioner No. 2, and three (3) years for Commissioner No. 3, as described below, which description establishes the base dates for future appoint- ments. The Commissioners~first appointed on and after January 1, 1977, shall classify themselves by lot so that one member holds Commission office No. 1, one member holds Commission office No. 2 and one member holds Com- mission office No. 3, and until such determination the Commissioners presently serving or appointed prior to January 1, 1977, shall continue in their respective IIII "IT' I[ I !iig~ offices unless a successor has been appointed and quali fi ed. Commissioner No. 1 Co'mmissioner No. 2 Commissioner No. 3 One (1) year commencing Janu- ary 1, 1977, and ending December 31, 1977.' Two (2) years, commencing January 1, 1977, and ending . December .31,'1978. Three (3) years, commencing January 1, 1977, and ending December 31, 1979. 2,2, 2.3, Limitation. Commencing on January 1, 1977, CommisSioners shall be limited to two (2)consecutive terms. Vacancy. Upon a vacancy occurring in a Parking Place Commission office for any reason, including but not limited to (1) resignation, (2) COuncil declaration of vacancy for a Commissioner's failure to attend~four con- secutive regular meetings without excuse by the Commis- sion, (3) removal by a four-fifth (4/Sth) vote of the Council, and (4) removal on petition by the owners of real property in the district in accordance with Streets and Highways Code Section 35557, a successor shall be appointed by the Council to .fill the unexpired portion of the term. ~ll 1" II I IIII i ' SECTION 3. Chairman,_ Chairman Pro Tem and Secretary. On the third Wednesday in January of each year, the Commission shall elect a chairman, chairman pro tem and appoint a secre- tary and secretary pro rem. The term of said offices shall be one (1) year. The chairman pro tem and secretary pro tem shall serve in the absence of the chairman and secretary. SECTION 4. Place of Meetings. 4.1. Regular Meetings, Adjourned Regular Meetings, Special Meetings and Study Meetings. The Commission shall meet on the third Wednesday of each month at thr~e o'clock p.m., in the Council conference room, 400 Grand Avenue,.South San Francisco, California,except in case of necessity or emergency the chairman or two (2) commissioners may designate an alternate meeting place within the corporate limits of the City of South San Francisco, with legal .notice thereof to be given at least twenty-four (24) hours prior to the time of said meeting. If a meeting is set for said regular meeting place of the Commission, or duly noticed for an 'alternate meeting place, and because of necessity or emergency the Commission is required to meet in another place within the corporate limits of the City of South San Francisco, then the secretary shall appear at the regular or alter- nate meeting place,whichever is the case, at the time IIII T II I Illa~ set for the meetin§, and publicly announce the new meet- ing place and post a notice of same on the door of the regular meeting place. Notices of all meetings, except regular meetings, shall be served on each Commissioner and to each person who has requested notice in writing of such meetings, at least twenty-four (2'4) hours prior to the time specified for the proposed meeting, and said notices shall comply with Government Code Section 54950, et seq., also referred to as the Ralph M. Brown Act or Secret Meeting Law. 4.2. Holidays. If the day designated as a regular, adjourned regular, special or study meetin9 falls upon a legal hol- iday, the Commission Shall meet upon the next succeeding day which is not a holiday, unless otherwise ordered by the Commission. SECTION 5. Compensation. The Commissioners and secretary shall receive the compensation established by the City Council pursuant to resolution or ordinance. SECTION 6. Clerk's Maintenance of Records and Notice to Council. 6.1. Record Maintenance. The City Clerk shall establish and maintain a record of the names, addresses, telephone numbers, dates of appointment and dates of termination of each Commissioner, and the names of the chairman, chairman pro tem, and the dates of their election and 6.2. termination of service in those offices. Notice to Council of Term Expiration. The Clerk shall give the Council written notice of the expiration of a Commissioner's term sixty (60) days prior thereto. SECTION 7. Powers and Duties. 7.1. The Parking Place Commission shall exercise the powers set forth in Chapter 4, Part 4, Division 18, Streets and Highways Code of the State of California, and such other powers as they are duly authorized by law to carry oUt under the terms of said provisions. 7.2. Secretary. The secretary shall keep a correct record of all proceedings and meetings. The minutes of each meeting of the Parking Place Commission shall be signed by the chairman and secretary, and in the absence of the chairman and secretary, ~y the chairm pro tem and secre- tary pro tem. SECTION 8. Repeal of Ordinance No. 459. The following ordinance shall ~t~ndrepealed on December 31, 1976, at twelve o'clock (12:00) p.m., except that commissioners serving pursuant to said ordinance shall continue to so serve until the Council has designated said commissioners to fill one of the Commission offices described in Section 2, or appointed a new commissioner for said office: Ordinance No. 459, adopted March 20, 1961, entitled "An Ordinance of the City of South San Francisco Pursuant to Section 35550 of the Streets and IIll · Il '1 iilnl " Highways Code Providing for the Appointment, 2emoval, Qualifications, Term of Office and Number of Members of the Parking Place Commission for South San Francisco." SECTION 8. Publication and Effective Date. This ordinance shall be published once in the'Enterprise- Journal, a newspaper of general circulation in the City of South San Francisco, as required by law, and shall become effective thirty.($O) days from and after adoption, and operative on December 21, 1976, at ~elve (12:00) p.m. * * * Introduced this 18th day of Au~ust__ , 1976..
