HomeMy WebLinkAboutOrd 718-1976ORDINANCE NO. 718-76 AN ORDINANCE ESTABLISHING MINIMUM REGULATIONS FOR ELECTRICAL SYSTEMS; ADOPTING BY REFERENCE THE NATIONAL ELECTRICAL CODE, 1975 EDITION; AND REPEALING ORDINANCE 507. THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS: SECTION I. ADOPTION OF THE NATIONAL ELECTRICAL CODE, 1975 EDITION, AS PUBLISHED BY THE NATIONAL FIRE PROTECTION ASSOCIATION, EXCEPT FOR CERTAIN ARTICLES AND PARTS OF SECTIONS. All provisions of the National Electrical Code, 1975 Edition (copy- righted 1974 by the National Fire Protection Association), except the follow- ing Article or Section, are hereby adopted and made part of this Ordinance as though fully set forth herein. Article/Section Section 336-3 Article 338 Exception All of the Section All of the Article Three copies of said National Electrical Code, certified to be true copies, shall be filed in the office of the City Clerk in the form and at the times prescribed by law and kept ~here for public inspection during the time this Ordinance is in effect, except that after adoption of this Ordinance one of said copies may be kept in the office of the Chief Building Official instead of the Clerk's office. The City Clerk shall maintain a reasonable supply of copies available for purchase by the public as required by law. SECTION II. ARTICLES AND PARTS OF SECTIONS ADDED. The following articles, sections and parts of sections which shall read as hereinafter stated, are hereby adopted and added to said National Electrical Code, 1975 Edition, as amended by the exceptions stated, which was adopted by reference in Section I of this Ordinance. The Administrative Authority having jurisdiction for administering and enforcing this Code shall be the Chief Building Inspector. He shall, upon application, grant or deny permits for the installation or alteration of electrical wiring, devices, appliances and equipment. He shall deny permits in cases where any of the following, or the method by which any of the following is accomplished, is reasonably determined by him to be hazardous or dangerous to persons or property because the method of installation or construction or manufacture results in a con- dition which is hazardous or dangerous to persons or property, or because such electrical wiring, devices, appliances or equipment is defective or defectively installed. He shall have the authority to make inspections and reinspections of the installation, maintenance and repair of all electrical wiring, connections, fixtures, appliances, apparatus, machinery, equipment and work inside, outside, overhead, or underground within his jurisdiction. He shall be the official representative of this jurisdiction to the code- making body of this code. 90-9 Dangerous Electrical Equipment. When any electrical equipment, or method of installation or manufacture of electrical equipment is found by the Administrative Authority to be hazardous or dangerous to persons or property because the method of installation or construction or manufacture or main- tenance results in a condition which'is hazardous or dangerous to persons or property, or because it is defective or defectively installed, the person, firm, or corporation responsible for the electrical equipment shall be noti- fied in writing and shall make any changes or repairs as required by the sections of this Code pertaining to electricity or other laws to place such equipment in a safe condition. If such work is not completed within fifteen e ('15) days or longer periods, as may be specified by the Administrative Authority, said Administrative Authority shall have the authority to order the discontinuance of electrical service to said electrical equipment, and any person, firm or corporation or political subdivision ordered to discon- tinue such electrical service shall do so within twenty-four (24) hours or such other reasonable time set by the Administrative Authority, and shall not reconnect or allow it to be reconnected until notified to do so by the Admin- istrative Authority. 90-10 Interpretation of Code - Additional Provision. In cases where development in the application and use of electricity, or methods of installa- tion, construction, or manufacture of electrical conductors, connectors or other electrical equipment or materials, or special or unusual methods of building construction, creates problems or conditions which are not clearly contemplated by sections of this code pertaining to electricity, and makes literal application of the rule, or rules, impracticable, the Administrative Authority is hereby empowered to make an interpretation which practically safeguards persons and property from hazards arising from the use of elec- tricity wherever there is a question as to motive or method or manner in which material shall be installed. In making the interpretations he may obtain an interpretation from the chairman of the Interpretation Committee, National Electrical Code, National Fire Protection Association, 470 Atlantic Avenue, Boston, Massachusetts 02210, or submit to said chairman for evaluation the interpretation he originated, provided, however, that any person who feels himself aggrieved by any such interpretation made by the Administrative Author- ity in accordance with the foregoing shall, within thirty (30) days from the effective date thereof, have the right to appeal to the City Manager of the City for a review and determination of the reasonableness thereof. The determination of the City Manager shall be final. 90-11 Application for Permits. Written applications for electrical permits shall describe the work to be done, and shall be made on the forms provided. The application for electrical permits for installation-of elec- trical wiring or equipment shall be accompanied by such plans, specifications, and schedules as may be necessary to determine whether the installation will be in conformity with the requirements of this Code. If it is found that the installation will conform to all legal requirements and if the applicant has complied with the provisions of this Code, a permit for such installation may be issued. No deviation may be made from the installation described in the permit without the approval of the Administrative Authority. If it is found by the Administrative Authority that the electrical equipment is defective or defectively installed, or that such equipment or installation or the method of installation of such is a hazard or danger, or will cause a condition which is a hazard or danger to the safety of persons or property, a permit for such equipment or installation shall be denied by the Administrative Authority. 90-12 Listing or Labeling. Listing or labeling, as conforming to the standards of the Underwriter's Laboratories, Inc., as approved by the United States Bureau of Standards, or other similar institutions of nationally- recognized standing, shall be prima facie evidence of conformity with approved standards of safety to life and property. 90-13 Authority to Condemn and Reject Work. The Administrative Author- ity shall have the authority to condemn and reject all work done, or being done, or materials used, or being used, which do not in all respects conform to the provisions of this Ordinance and amendments thereto, and shall order such changes in workmanship and/or materials as will make the same conform thereto. 90-14 Conformance. It shall be unlawful to perform any electrical work in or on any buildings, or other structures, pumping plants, exterior elec- trical wiring on private property or similar installations within the City of South San Francisco without conformance to the provisions of this Code. 90-15 License Required. It shall be unlawful for any persons, firm or corporation, except as hereinafter provided, to perform, construct, maintain or repair any electrical equipment in or on any building or structure, or exterior electrical wiring on private property, without a valid State of California Contractor's License C-10 for such work or unless such firm or corporation is exempt under the Contractor's License Law of the State of California. 90-16 Approval Required Prior to Energizing; Temporary Permission. It shall be unlawful to energize or cause or permit to be energized any elec- trical wiring coming under the provisions of this Ordinance, until such elec- trical wiring shall have been inspected and approved in writing by the elec- trical inspector, provided, however, that the Electrical Inspector may give written temporary permission to furnish electric current to, or the use of electric current through, any electrical wiring for a length of time not exceeding thirty (30) days, if it appears to said Electrical Inspector that such electrical~wiring may be used safely for such purpose, and that there exists an urgent necessity for such use. o 90-17 Permits Required. (a) It shall be unlawful for any person to install, remove, alter, repair -or replace or cause to be installed, removed, altered, repaired or replaced any electrical work, any electrical fixture or electrical fixed appliance in a building or premises without first obtaining a permit to do such work from the Administrative Authority. (b) A separate permit shall be obtained for each building or structure. (c) No person shall allow any other person to do or cause to be done any work under a permit secured by a Permittee except persons in his employ. 90-18 Application for Permit. Any person legally entitled to apply for and receive a permit shall make such application on forms provided for that purpose. He shall give a description of the character of the work proposed to be done, and the location, ownership, occupancy and use of the praises in connection therewith. The adminiStrative Authority may require plans, specifications or drawings and such other information as he may deem necessary. If the Administrative Authority determines that the plans, specifica- tions, drawings, descriptions or information furnished by the applicant are in compliance with this Code, he shall issue the permit applied for upon pay- ment of the required fee as hereinafter set forth. 90-19 Expiration of Permit. Every required electrical permit issued by the Electrical Inspector shall expire by limitation and become null and void if the electrical work authorized by such permit is not commenced within sixty (60) days from date of such permit, or if the electrical work authorized by such permit is suspended or abandoned at any time after the work is com menced for a period of one hundred twenty (120) days. Before such work can o be recommenced, a new permit shall first be obtained to do so, and the fee therefor shall be one-half the amount required for a new permit for such work, provided no changes have been made or will be made in the original plans and specifications for such work; and provided, further, that such suspension or abandonment has not exceeded one year. 90-20 Work Not Requiring a Permit. No electrical license or permit shall be required for the performance of the following electrical work: (a) Any electrical work done by an employee of a public utility in connection with rendering of electric service to any building or structure by said public utility. (b) The ordinary care and maintenance of an established installation of electric equipment by the owner, operator or user thereof, except that ordi- nary care and maintenance shall not be construed as including additions to such.installations or other work such as the repair or replacement of any electric wiring, appliance or apparatus which is a fixed part of such instal- lation. The replacement of lamps and fuses, plugging-in apparatus and similar work shall be construed as ordinary care and maintenance. (c) The repair of appliances, apparatus, and materials which are not a fixed part of an established installation of electric equipment or which have been detached from such an installation for the purpose of repair. 90-21 Permit - No Authority to Violate Code. The issuance or granting of a permit shall not be deemed or construed to be a permit for, or approval of, any violation of the provisions of this Code. No permit purporting to give authority to violate or cancel the provisions of this Code shall be valid. 90-22 Liability. The owner and/or his contractor, when installing electrical equipment or systems in or on the owner's premises in the City of 8. South San Francisco, shall install same in compliance with the National Elec- trical Code, as amended, and in such a manner as to practically safeguard persons and property from hazards arising from the use of electricity. The owner with respect to his premises shall maintain and use all electrical work and systems located in or on his premises in compliance with the National Electrical Code, as amended, and in such a manner as to practically safeguard persons and property from hazards arising from the use of electricity. The provisions of this Code lodging authorizations with the Administrative Author- ity to do any and all of the acts therein provided, shall not relieve the owner or the contractor from said responsibilities, and neither the Administrative Authority, his agents or employees, nor the City of South San Francisco and its elected and appointed officers and employees assume said responsibility or any part thereof, nor shall any of their actions in any way relieve the owner and/or his contractor of such responsibility. This Code shall not be construed as imposing upon the Electrical Inspec- tor any liability or responsibility for damage resulting from defective elec- trical work or installation thereof, nor shall the Electrical Inspector or any official or employee thereof be held as assuming any such liability or responsibility by reason of the inspection authorized herein. 90-23 Penalty. Any person violating a provision or failing to comply with a mandatory requirement of this Ordinance shall be guilty of an infrac- tion. Any person convicted of an infraction is punishable by (a) a fine not exceeding Fifty Dollars ($50) for a first violation, (b) a fine not exceedin~ One Hundred Dollars ($100) for a second violation within one (1) year, and (c) a fine not exceeding Two Hundred Fifty Dollars ($250) for each additional violation within one (1) year. Each such person shall be guilty of a sepa- rate infraction for each and every day during any portion of which a viola- tion or failure to comply with a mandatory requirement is committed or con- tinued. 90-24 Permit Fees. With Electric Heat .020¢ per sq. ft. Square footage: outside walls of the living area. Garages up through 3,000 sq.ft, are included in the fee schedule for the basic unit. The fee schedule shall also include yard or corridor lighting, etc. Garages over 3,000 sq.ft, to be considered commercial, and fees are to be charged at .002¢ per sq. ft. *Minimum fee is not to be added to the total calculated fee. If calculated fee is $9.00, fee is NOT $7.50 plus $9.00. $ 1.00 4.00 .25 10.00 10.00 1.00 1.00 7.50 90-25 Late Application Penalty. Whenever an electrical permit is required by this Code and such work is started prior to obtaining a permit, the fee for said late permit shall be the basic fee described in Section 90-24, plus a penalty equal to said fee. 90-26 Approval of Materials. All materials used in the installation, alteration, or repair of electrical distribution systems shall bear approval of the Underwriter's Laboratory or other approved agency, be free from defects and shall be of the minimum approved standards specified for such type of materials provided for in this Ordinance. 11. 90-27 Voltage Tests. Dielectric and voltage tests under load may be made by the electrical contractor on request of the Electrical Inspector. 90-28 Right of Entry. The E~ctrical Inspector shall carry an official identification of office, and upon exhibition thereof shall have the right of entry into and upon all buildings and premises in the City of South San Francisco for the purpose of making inspections, reinspections, or otherwise performing such duties as may be necessary in the enforcement of the pro- visions of this Ordinance and amendments thereto. 90-29 No Grant of Legislative Authority. The provisions of this Ordi- nance are not intended to and do not grant any legislative authority to the Building Official who is the enforcing officer, and any grant of discretionary authority to said official contained herein shall be construed as limiting his powers to the determination of facts as to whether or not the rules set forth in the Code have been complied with. Article 100 Definitions. Person - The term "Person" as used in this Code shall be deemed to mean and include corporations, associations, partnerships, agents and individuals. Electrical Equipment The term "Electrical Equipment'~ as used in this Code shall be deemed to mean and include all wires, wiring, connections, appliances, signs, neon installations, apparatus and material used for or in connection with the transmission or use of electricity for light, heat or power. Electrical Work - The term "Electrical Work" as used in this Code shall be deemed to mean and include the installation, construction, maintenance and repair of electric wiring and equipment. 12. Apartment House - The term "Apartment House" as used in this Code is any building or portion thereof which is designed, built, rented, leased, let or hired out to be occupied, or which is occupied as the home or resi- dence of three or more families living independently of each other and doing their own cooking in the said building, and shall include flats and apart- ments. Assembly Building The term "Assembly Building" as used in this Code is a building used, in whole or in part, for the gathering together of per- sons for such purposes as deliberation, worship, entertainment, amusement, or awaiting transportation. Dwellin§ - The term "Dwelling" as used in this Code is any building or portion thereof which is used for living purposes but is not an apartment house or a hotel as defined in this Code. Electric or Electrical Wiring. The term "Electric or Electrical Wiring" as used in this Code means the installation or the alteration of any material, fixture, device, appliance or equipment in or on any building, structure or premises, used or designed or intended to be used to generate, transmit, transfer or utilize electric energy. Hotel - The term "Hotel" as used in this Code is any building containing six or more rooms intended or designed to be used, or which are used, rented or hired out to be occupied, or which are occupied for sleeping purposes by guests. Maintenance - The term "Maintenance" as used in this Code means the ordinary care of an installation of electrical equipment, the replacement of lamps and fuses, the plugging-in of apparatus or equipment in or on any building, structure or premises, used or designed or intended to be used 13. to generate, transmit, transfer or utilize electric energy. This would include moving a piece of existing apparatus that was plugged into an existing bus duct system. Section 210-5(d) Branch Circuit Color Code. In addition to the requirements for a color code in this Section, the system described below shall be identified as follows: 120/208V 115/230V 277/480V Wye Black, red, blue and white. Delta Black, red, orange, and white Wye Brown, yellow, purple, and white/grey Section 300-23 Commercial and Industrial Building Type Wiring. All types of buildings for occupancies other than dwellings, as permitted by Section 336-3, shall be wired in electric metallic tubing or rigid conduit, except that flexible metal conduit may be permitted only in a concealed sp~ce. Section 336-3 Uses Permitted or Not Permitted. Type NM and Type NMC cable shall be permitted only in one-family dwell- ings, two family dwellings and multi-family dwellings which do not exceed three floors above grade, and buildings accessory thereto, and use of said cable shall be limited to circuits which do not exceed an ampacity of twenty (20) or two hundred (20Q) volts. (a) Type NM. This type of nonmetallic sheathed cable shall be per- mitted to be installed for both exposed and concealed work in normally dry locations. It shall be permissible to install or fish type NM cable in air voids in masonry block or tile walls where such walls are not exposed or subject to excessive moisture or dampness. 14. Type NM cable shall not be installed where exposed to corrosive fumes or vapors; nor shall it be imbedded in masonry, concrete, fill or plaster; nor run in a shallow chase in masonry or concrete and covered with plaster or similar finish. (b) Type NMC. Type NMC cable shall be permitted for both exposed and concealed work in dry, moist, damp or corrosive locations, and in outside and inside walls of masonry block or tile. (c) Uses Not Permitted for Either Type NM or NMC. Types ~IM and NMC cables shall not be used as (1) service-entrance cable, (2) in commercial garages, (3) in theaters and similar locations, except as provided in Article 518, places of assembly, (4) in motion-picture studios, (5) in storage battery rooms, (6) in hoistways, (7) in any hazardous location, (8) embedded in poured cement, concrete, or aggregate.- SECTiON III. SEPARABILITY. It is the intention of the City Council that this Ordinance and every provision thereof, shall be considered separable, and the invalidity of any section, clause, provision, or part or portion of any section, clause or provision of this Ordinance, shall not affect the validity of any other portion of this Ordinance or the Code adopted by reference. SECTION IV. REPEAL OF PRIOR ORDINANCE. Ordinance No. 507, entitled "An Ordinance Repealing Ordinance No. 348 of the City of South San Francisco, and the Adoption Thereby of the Electri- cal Code of the County of San Mateo; Providing for the Issuance of Certif- icates of Competency of Persons Engaged in the Maintaining and Extensions of Electrical Wiring in Plans; Requiring a Permit for the Installation or Alter- ation of Electric Wiring, Electric Signs, and Equipment; Providing for a 15. Board of Electrical Examiners and Prescribing Their Duties; Defining Cer- tain Terms; Establishing Minimum Regulations for the Installation or Altera- tions or Additions or Repairs of Electrical Wiring Systems and the Inspection Thereof; Providing Penalties for Violations; and Adopting by Reference the Electrical Code of the County of San Mateo Passed and Adopted the 14th Day of January, 1964, and the National Electrical Code, 1962 Edition, Incorporated by Reference Therein," adopted July 20, 1964, is hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of said Ordinance prior to the effective date of this Ordinance. SECTION V. PUBLICATION AND EFFECTIVE DATE.
