(9/71) EXHIBIT A AMEND~F~NT TO C0h~RACT B~%~EN TPr~ BOARD OP AL~.~INISTRATION PUBLIC A~.[PLOYEES" RET IRE~L~T SYSTE~ AND THE CITY C OD/~C I~ OP THE CITY OP SOUTH SAN FRANCISCO The Board of Administration, Public Employees' Retirement System~ hereinafter referred to as Board and the CITY COUNCIL of the CITY OF SOUTH S~2; FRANCISCO, hereinafter referred to as Public Agency, having entered into a contract under date of September 12, 1945, effective September 1, 1945, and as amended effectiv~ September 1~ 1949~ December 1, 1953, Jenuary 1, 1960, Jsmuary 1, 1963, February1, 1967~ January 1, 1968, January 1, 1969, November 1, 1973, April 19, 1974, and January ~1, 1977, which provides for participation of Public Agency in said System, Board and Public Agency hereby agree as follows: Paragraphs I through 8 are hereby stricken from said contract as executed effective November 1, 1973, and are hereby replaced by the following paragraphs numbered I through 10 inclusive: All words and terms used herein which are defined in the publiC Employees' Retirement Aaw shall have the meaning as defined therein unless otherwise specifically provided. "Normal retirement age" shall mean age 60 for miscellaneous members and age 50 for local safety members. Public Agency shall participate in the Public Employees' Retirement System from and after September 1, 1945, making its employees as hereinafter provided, members of said System subject to all provisions of the Public Employees' Retirement Law except such as apply only on election of a contracting agency and are not provided for herein and to all amendments to said Law hereafter enacted except such as by express provision thereof apply only on the election of contracting agencies. .Employees of publicAgency in the following classes and groups shall become members of said Retirement System except such in each such class and group as are excluded by law or this agreement: a. .Local firemen (herein referred to as local safety members); b. Local policemen (herein referred to as local safety members); c. Employees other than local safety members (herein referred to as miscellaneous members). In addition to the employees excluded from membership by said Retirement ~aw, the following employees shall not become members of the Retirement System: PERSONS ~HO ARE C~PENEATED 0N AN HOURLY BASIS WHO ARE K~PL~ JANUARY 1, 1965 GR AFTER. Ret. Form 702-1 4. The fraction of final compensation to be provided for misce~L~aneous members for each year of credited prior and current service shall be that provided in Section 21251.13 subject to the reduction provided therein for servi~e on or after January 1, 1955 for members whose service has been included in the ~ederal Social 'Security System. 5. The fraction of final compensation to be provided for each year of credited prior and current service as a safety member shall be determined in accordance with Section 21252.01 of said Retirement ~aw. 6. Public Agency, in accordance with Section 20750~ Government Code~ shall cease to be an "employer" for the purposes of Chapter 6 of the Public Employees' Retirement I~w effective as of the effective date of this amendment to this contract. Accumulated contributions 'of the Public Agency as of the date of such amendment shall be fixed and determined as provided in Section 20759~ .Government Code, and such accumulated contributions and contributions hereafter made shall be held by the Board as provided in Section 20759, Government Oode. The following provisions of the Public EmplOyees' Retirement Taw which apply only on the election of a contracting agency shall apply to the Public Agency and its employees: as Section 21380-21388 (providing for allowan~,es for survisors of members covered under the 1959 Survivorts ~rogram upon the member' s death before retirement). Section 21222.1 (providing for increases in allowances to which the annual cost-of-livingprovisions apply~ payable for time commencing on the first day of the calendar month coinciding with or next following the effective date of this amendment to or on account of persons retired or members deceased on or prior to December ~1, 1970). Sections 21263 and 21263.1 (providing upon the death of a member who retired for service or disability for contin~ce of a post-retirement survivor allowance to certain survivors). · d. Section 20930.3 (providing for service credit underthe provisions of Chapter 830~ Sta~s. 1976~ for up to four years of continuous military or merc~ntmarine service for persons who are members because of employment by Public Agency) for miscellaneous. Public Agency shall contribute to said Retirement System as follows: ~ithrespect to miscellaneous members~ the agency shall contribute the following percentages of monthly salaries earned as misc- ellaneous members of said System: (1) 0.069 percent until June 30, 1980 on account of the liability for prior service benefits. . · (2) 10.856 percent on account of the liability for current service benefits. (5) 0.110 percent until November 1, 1983 to provide the benefits under Section 21222.1 of the Government Code. Ret. ~orm702-2 With respect ct local safety members, the public agency shall contribute the following percentages of monthly salaries earned as local safety roe. tubers of said System: (1) O.102 percent until June 30, 2000 on account of the liability for prior service benefits. (2) 25.864 percent on account of the liability for current service benefits. 0.150 percent until November 1, 1985 to provide the benefits under Section 21222.1 of the Government Code. 0.047 percent on account of the liability for the 1959 survivor'program. · Cs A reasonable amount per annum, as fixed bythe Board to cover the costs ofa.dministering said System as it affects the employees of Public Agency, not including the costs of special valuations or the periodical investigation and valuation required by law. A reasonable amount as fixed by the Board, payableinone instal- lment as the occasions aris% to cover the costs of special valuations on account of employees of Public Agency, and costs of the periodical investigation and valuation required by law. 0ontributions required of Public Agency and its employees shall be subject to adjustment by Board on account of amendments to the Public Employees' Retirement System,-as determined by the periodical investigation and valuation required by said Retirement I~w. 10. Contributions required of Public Agency and its employees shall be 'paid by Public Agency to the Retirement System with~ thirty days after the end of the period to which said contributions refer. If more or less than the correct amount of contribution is paid for any period, proper adjustment shall be made in connectionwith subsequent remittances, or adjustments on account of error in payments between the employee and Board. Payments by Public Agency to Board may be made in the form of warrants, b~ checks, bank drafts, certified checks, money orders, or cash.
