HomeMy WebLinkAboutOrd 765-1978 ORDINANCE NO. 765-78 AN ORDINANCE AMENDING ORDINANCE NO. 661 ADOPTED APRIL 1, 1974, ENTITLED "AN ORDINANCE REGULATING WASTE DISCHARGES" THE CITY COUNCIL OF THE CITY OF souTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS: SECTION 1. AMENDMENT OF SECTIONS 2.25, 2.28, 3.1, 4.1(a), 4.2(a), 5.1, 5.2, 5.3, 5.5, 5.8, 5.9, 7.1, 8.3(b) and 8.5. Subsections 2.25, 2.28, 3.1', 4.1(a), 4.2(a), 5.1, 5.2, 5.3, 5.5, 5.8, 5.9, 7.1, 8.3(b) and 8.5 of Ordinance No. 661, adopted April 1, 1974, entitled "An Ordinance Regulating Waste Discharges," are hereby amended to read: 2.25 Standard Methods - The latest United States Environmental Pro- tective Agency approved edition of Standard Methods for the Examination of Water and Wastewater prepared and published jointly by American Public Health ASsociation, American Water Works Asso- ciation, and the Water Pollution Control Federation on methods deemed equivalent by the Superintendent and the Water Quality Control Board for the San Francisco Bay Region, herein referred to for definitions, laboratory procedures of analysis, tests (including test samples) and measurements. 2.28 Waste - Sewage and any and all other waste substances, liquid, solids, gaseous, or radioactive, associated with human habita- tion, or of human or animal origin, or from any producing, manufacturing, personal service industry, or processing opera- tion of whatever nature. imm i i SECTION 3. USE OF PUBLIC SANITARY SEWERS GENERALLY 3.1 Sanitary Sewage Discharge Requirement 3.2 Waste Disposal Prohibition 3.3 Obstructions to Sewers Prohibited 3.4 Use of Sanitary or Domestic Sewers 3.5 Use of Privies, Septic Tanks, Cesspools Prohibited 3,6 Radioactive Wastes 3.1 Sanitary sewage shall be discharged to public sanitary sewers, except as hereinafter provided. 4.1 Application Procedure; Sewer Uses Defined. (a) All users of public sewers shall make application for con- nection on a form .furnished by the Superintendent. 4.2 Permits Required. (a) No industrial user shall make connection to or discharge wastewater into the public sewer system without first having obtained a wastewaterdischarge permit from the Superinten- dent. SECTION 5. No person shall discharge wastewater in which daily flow, gases, grease, pH, sulfides or temperature exceeds the limits herein- after described: ~1 ,i I · i Iml 5.1 5.3 (a) Daily Flow: 2% of the average daily flow at the Sewage Treatment Plant. (b) Grease: 100 milligrams per liter. (c) pH: Not less than 5.5 nor more than 10.5. (d) Sulfides: 1 milligram per liter. (e) Temperature: 150° Fahrenheit Gases. No person shall discharge into any public sewer, either directly or as part of wastewater, any noxious or malodorous gas or any other substance which may create a public nuisance. Gasoline, Benzene, Naphtha. No person shall discharge into any public sewer, either directly or as part of wastewater, any gasoline, benzene, naphtha, fuel oil, or other flammable or explosive liquid, solid, or gas. 5.5 ·Sand, Cement. No person shall discharge into any public sewer, either directly or as part of wastewater, sand, cement, cinders, ashes, metal, glass, or other heavy solids; any straw, shavings, animal hair, feathers, paunch, manure, or other fibrous matter, any tar, asphalt, resins, plastics, or other viscous substance; or any other matter of such a nature which obstructs the flow in sewers or causes other interferences with the proper operation of the sewage works. 5.8 Wastewater Concentration Limitations. No person shall discharge or cause to be discharged any wastewater into the public sanitary sewers if the concentration of any of the following constituents of the wastewater exceeds the fol- lowing limits, except that the Superintendent of Sanitation may grant a variance annually if the limitation cannot be achieved under the best practiCable pre-treatment technology currently available: Constituent Maximum Permissible Concentration (mg/1) Aluminum Ammonia (expreSsed in nitrogen) Antimony Arsenic Barium Beryllium Bromine, Chlorine, Iodine (total) Cadmium Chlorine Chromium (total) Cobalt Copper Cyanide "~ Fluoride Formaldehydes Iron Lead Manganese Mercury Nickel Nitrites Phenols ,Selenium Silver Nalogenated organic compounds (except pesticides) Zinc 5.0 20.0 5.0 1.0 10.0 1.0 10.0 0.10 2.0 0.50 1.0 1.0 1.0 2.0 5.0 15.0 1.0 1.0 0.10 1.0 1.5 1.0 5.0 O. 050 1.0 3.0 5.9 Other Limitations. No person shall discharge into any public sewer, either directly or as part of wastewater, material which by nature or concentra- tion thereof deleteriously affects the public sewer system or portions thereof, treatment and disposal facilities or portions thereof, or receiving waters. 7,1 Sewer Connection Fees. A connection charge shall be paid by the discharger or parcel owner for connection to a public sanitary sewer or appurtenance thereof and for change in class or subclass of an existing con- nection as shown in the following schedule. If there is an existing connection for a residential class and additional dwel-' ling units are made, the connection charge for the additional units shall be paid as shown in the following schedule. If there is an existing connection for an institutional, commercial or industrial class and additional fixture units are made, the connection charge for the additional fixture units shall be paid as shown in the following schedule. User's Classification Fee (Per Connection) (a) Residential Class Si ngl e- Family Dwel 1 i ng $100.00 per dwelling (b) Multi-Family Dwelling (Duplexes, flats, apartments, auto courts, motels, trailer courts, and similar class of users) Institutional Class (Schools, hospitals, colleges, cemeteries, rest homes, clubs, lodges and similar class of users) $100.00 per dwelling unit $100.00 plus $15.00 per fixture unit over ten (10) fixture units* (c) Commercial Class (Legal, financial, real estate, insurance offices, buildings, warehouses, hotels, restaurants, stores and similar class of users) $220.00 plus $15.00 per fixture unit over ten (10) fixture units* (d) Industrial Class (Manufacturers, processers, producers, laundries, photo- finishers, painting services, packagers, electrical services and similar class of users) $220.00 plus $15.00 per fixture unit over ten (10) fixture units* ~l i i · i lmm 8.;) 8.5 *Fixture units shall be determined by the Building Inspector in accordance with the Uniform Plumbing Code of San Mateo County. Fixtures include but are not limited to kitchen sinks, bathtubs, water closets, washbasins, laundry tubs, urinals, cellar drains, shower baths, dishwashers, washing machine connections, garbage grinders, garage drains, floor drains. Appeals (b) Written Appeal to Director. The Superintendent's original decision, action or determination and action taken after review may be appealed to the Director .by a written request ~or appeal by the discharger within ten (10) days after notice of the action taken by the Superintendent. The written appeal shall state all pertinent aspects of the matter, including the original decision, action or determina- tion, request for rev.iew, and subsequent action of the Super- intendent. Within thirty (30) days after the written appeal is received, the Director shall hold a hearing after notice of not less than ten (10) days to the appJllant-discha~ger. The Director shall make a final ruling on the appeal within ten (10) days after the clQsing of the appeal. Decision of the Director shall'be submitted to the City Manager for review. The City Manager shall within ten (10) days affirm, modify or reject the ruling and give notice thereof to the discharger and/or parcel owner. The City Manager's action shall be deemed final. Criminal Penalties Any person violating a provision of this Ordinance or failing to comply with a mandatory requirement of this Ordinance shall be e guilty of an infraction and upon conviction such person shall be punishable by a fine of not less than Fifty Dollars ($50.00) and not exceeding Five Hundred Dollars ($500.00). SECTION 2. PUBLICATION AND EFFECTIVE DATE This Ordinance shall be published once in the Enterprise-Journal, a newspaper of general circulation in the City of South San Francisco, as required by law, and shall become effective thirty (30) days from and after its adoption. at a regular San Francisco this vote: AYES: NOES: ABSENT: Introduced this 3rd day of Mag , 1978.
