ORDINANCE NO. 799-79
ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF SOUTH SAN FRANCISCO APPROVING AND AUTHORIZING
THE EXECUTION OF A FACILITY LEASE WITH CITY OF SOUTH
SAN FRANCISCO PUBLIC FACILITIES CORPORATION
WHEREAS, the City of South San Francisco (the "City"), proposes to lease
from City of South San Francisco Public Facilities Corporation (the
"Corporation") the real property described in Exhibit A to the form of lease
presented to this Council and entitled "Facility Lease", dated for convenience
as of October 1, 1979 (the "Facility Lease");
The City Council of the City of South San Francisco does ORDAIN as
follOws:
Section 1. The form of Facility Lease presented to this Council is
hereby approved. The City Clerk of the City is directed to file a copy of
said form of Facility Lease in the office of said City Clerk, and the Mayor of
the City is hereby authorized to execute and the City Clerk of the City is
hereby directed to affix the seal of the City to add to attest the Facility
Lease in substantially the form hereby approved or with any changes that
hereafter become necessary in the interests of the City, which changes do not
materially affect the substance or materially increase the obligations of the
City; provided, however, that the Base Rental figure contained in said form of
Facility Lease may be reduced as required by bids received for the City of
South San Francisco Public Facilities Corporatio'n 1979 Bonds proposed to be
issued by the Corporation, and the Advance Rental figure contained in said
form of Facility Lease may be reduced as required by bids for said bonds and
for the construction of the facilities leased pursuant to the Facility Lease.
Section 2. The City Attorney is authorized to make such changes as may
be required in the interests of the City to conform all documents for final
signature by the parties to the Facility Lease, including, without limitation,
alteration of Exhibit A to said form of Facility Lease to conform to any title
insurance requirements.
Section 3. This ordinance is subject to the provisions for referendum
applicable to the City Council of the City of South San Francisco pursuant to
Section 54241 of the California Government Code.
Section 4. The City Clerk of the City ds hereby directed to publish
this ordinance once in the SOUTH SAN FRANCISCO ENTERPRISE-JOURNAL, a newspaper
of general circulation published in the City, within fifteen (15) days after
passage and adoption hereof, pursuant to Section 54242 of the California
Government Code.
Section 5. This ordinance shall become effective upon the commencement
of the thirty-first day after the day of passage and adoption hereof.
