HomeMy WebLinkAboutOrd 800-1979ORDINANCE NO. 800-79 AN ORDINANCE PROHIBITING CONVERSION OF MULTIPLE RESIDENTIAL USE STRUCTURES PENDING COMPLETION OF ZONING PROPOSAL STUDIES THEREFOR. THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO HEREBY FINDS: 1. Numerous multiple residential use structures including, but not limited to, duplexes, triplexes, apartments, hotels and motels exist in the City of South San Francisco. 2. In the last several months inquiries have been received regarding the proposed conversion of apartments and other structures to condominiums as defined by Civil Code Section 783, community apartment projects as defined by Business and Professions Code Section 11004 and stock cooperatives a~ defined by Business and Professions Code Section'llO03.2, and applications are pending or expected. 3. Such conversion, unless adequately regulated and equitably scheduled in accordance with General Plan standards, will deplete the rental premises availability below the standard established by Policy No. 30 of the draft Housing Element of the General Plan which was approved by the City Council on July 18, 1979 in Resolution No. 81-79, and will further cause severe financial and relocation problems for existing tenants. 4. The City Council, the Planning Commission and staff are pursuing studies to develop new zoning and related legislation regulating such conver- sions in the interest of t~e public health, safety and welfare. 5. Further conversion, prior to completion of the studies, will hinder,. impede and hamper such studies; the effects of such conversion during the study period will be largely irreversible; and the results and recommendations of such studies may well be made moot by conversions during the period of such studies. THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS: SECTION 1. For four months from the effective date of this ordinance, no existing multiple residential use structures including, but not limited to, duplexes, triplexes, apartments, hotels and motels shall be converted to con- dominiums, community apartment projects or stock cooperatives as herein before defined. No permits, subdivision maps or parcel maps shall be accepted, processed or approved for such conversions during said four month period. SECTION 2. This ordinance is declared to be an urgency measure based on the findings heretofore set forth in that it is for immediate preservation of the public, peace, health and safety and protects the public health, safety and welfare. This ordinance is adopted pursuant to the provisions of Govern- ment Code Sections 36937 and 65858. SECTION 3. Those conversions for which appeals are pending before the City Council as of September 19, 1979 are excepted from provisions of this ordinance. SECTION 4. This ordinance shall be published once as required by law in the ENTERPRISE-JOURNAL, a newspaper of general circulation in the City of South San Francisco, and shall take effect as an urgency measure immediately upon its adoption.
