Under the amended rules, the City will not provide a physical location .for members of the public to participate in the teleconference meeting. CALL TO ORDER Mayor Nagales called the meeting to order at 6:00 p.m. ROLL CALL Councilmember Addiego, present in Council Chambers Councilmember Coleman, present in Council Chambers Councilmember Flores, present in Council Chambers Vice Mayor Nicolas, present in Council Chambers Mayor Nagales, present in Council Chambers PLEDGE OF ALLEGIANCE Mayor Nagales led the pledge. AGENDA REVIEW No changes. ANNOUNCEMENTS FROM STAFF None. PRESENTATIONS Proclamation Recognizing September as National Preparedness Month. (Mark Nagales, Mayor) Vice Mayor Nicolas read the proclamation recognizing September as National Preparedness Month. Fire Department Deputy Chief Matt Samson accepted the proclamation and thanked Council for the recognition. Councilmember Addiego requested information about the city's efforts in fire services. Deputy Chief Samson provided an overview. 2. Presentation from California Department of Insurance (CDI). (Tonya Martin, Supervisor, Community Relations, and Outreach Branch) Tonya Medrano-Martin, Supervisor for the Department community relations and outreach branch, provided an overview of CDI resources. 3. Presentation from Star Vista on 988 Suicide & Crisis Lifeline (Taylor Georgina Coutts, ASW, Program Manager - Crisis Intervention and Suicide Prevention Hotline) A nationwide federal effort called 988 is being launched to enhance the nation's disaster response infrastructure. The Crisis Intervention and Suicide Prevention Center at StarVista will start taking 988 calls in San Mateo County on July 16, 2022. Councilmember Flores provided an overview of the services and noted that they would be offered in English and Spanish, noting that residents can request assistance via text. He introduced Taylor Coutts of StarVista, who provided an overview of the services available to the community. Councilmember Flores invited the community to attend the unveiling event of Josh's Benches, a bench to promote suicide prevention and mental health resources, on Tuesday, September 6, 2022, at 11:00 a.m. at Linden and Pine Avenue. Parks and Recreation Director Mediati informed the community that an additional bench would be installed on Mission Road and Chestnut Avenue in the near future. Economic and Community Development Management Analyst Lazzo provided an overview of the services available and noted that Council would receive an update at the upcoming September 14, 2022, Council meeting. REGULAR CITY COUNCIL MEETING AUGUST 10, 2022 MINUTES PAGE 2 COUNCIL COMMENTS Mayor Nagales informed the community that school is now back in session and reminded motorists to be vigilant of children crossing near schools. He noted that all National Night Out events were very successful and thanked the participants. Vice Mayor Nicolas invited the community to join Movie Night in the Park at Martin Elementary on Friday, August 19, 2022, featuring Disney's Encanto. She requested to adjourn the meeting in memory of Richard Irli, former South San Francisco employee, and Josefina Palafox, mother of South San Francisco Library employee Anita Palafox. Councilmember Coleman attended the National Night out and thanked the community organizers for hosting the events and the community for attending. Councilmember Flores announced that the Silicon Valley Bicycle Coalition selected South San Francisco's Every Kid Deserves a Bike program as the 2022 Program of the Year. He thanked the staff for their support and noted that the city would consider expanding the program in the future. Councilmember Addiego attended the National Night Out event at Paradise Valley and recognized the organizers for their efforts in bringing the community together. He expressed condolences to Barbara Irli, wife of former Public Works Supervisor and community advocate Richard Irli. He requested to adjourn in memory of David Carelli, longtime South San Francisco police reserve Captain. CONSENT CALENDAR The City Clerk duly read the Consent Calendar, after which Council voted and engaged in discussion of specific item as follows. Item No. 6 was pulled by Councilmember Addiego for further discussion. 4. Motion to approve the Minutes for the meeting of July 11, 2022. (Rosa Govea Acosta, City Clerk) 5. Report regarding Ordinance No. 1641-2022 amending the South San Francisco Zoning Map (RZ20-0001) to create a Planned Development District to allow the construction of a multi -family residential development consisting of 292 units on 40 Airport Boulevard. (Christopher Espiritu, Senior Planner and Tony Rozzi, Chief Planner) 6. Report regarding a resolution authorizing the City Manager to execute an amendment to the consulting services agreement with MuniServices, LLC to extend its terms for an additional two-year period ending on June 30, 2024, for access to the Sales Tax Analytics & Reporting and Forecasting Services and Sales and Use Tax Audit Services and a resolution authorizing the examination of sales or transactions and use tax records by MuniServices, LLC. (Karen Chang, Director of Finance) 6a. Resolution No. 131-2022 authorizing the City Manager to execute an amendment to the consulting services agreement with MuniServices, LLC to extend its terms for an additional two-year period ending on June 30, 2024, for access to the Sales Tax Analytics & Reporting and Forecasting Services and Sales and Use Tax Audit Services. Resolution No. 132-2022 authorizing the examination of sales or transactions and use tax records by MuniServices, LLC, and authorizing the City Manager to execute a contract amendment with MuniServices, LLC. Report regarding Resolution No. 133-2022 authorizing submission of the 2022 Infill Infrastructure Grant (IIG) Program to the California State Department of Housing and Community Development. (Ernesto Lucero, Acting Deputy Director, Economic and Community Development Department) 8. Report regarding Resolution No. 134-2022 to continue conducting City Council and advisory body meetings remotely due to health and safety concerns for the public and making related findings (Sky Woodruff, City Attorney) 9. Report regarding approval of Resolution No. 135-2022 authorizing the acceptance of $3,200 in donation funding from the Stanford Gardner Center to support Healthy Places for a Healthy City, and approving Budget Amendment #23.005. (Tamiko Huey, Management Analyst II) 10. Report regarding Resolution No. 136-2022 approving Amendment No. 23 to the Professional Services Agreement with Meyers Nave. (Mike Futrell, City Manager) 11. Report regarding Resolution No. 137-2022 authorizing the City Manager to execute a First Amendment to the banking services agreement with JPMorgan Chase Bank N.A. for an additional two-year term ending on August 31, 2024. (Karen Chang, Director of Finance) 12. Report regarding adoption of Ordinance No. 1642-2022 authorizing the City of South San Francisco to develop, construct, or acquire affordable, low -rent housing units pursuant to Article XXXIV of the California Constitution. (Sky Woodruff, City Attorney) Item No. 6: Councilmember Addiego requested additional information in a Thursday memo to Council regarding the city's use of sales tax. Motion — Councilmember Addiego /Second – Vice Mayor Nicolas: To approve Consent Calendar 4-12, by roll call vote: AYES: Councilmembers Addiego, Coleman, and Flores, Vice Mayor Nicolas, and Mayor Nagales; NAYS: None; ABSENT: None; ABSTAIN: None. ADMINISTRATIVE BUSINESS 13. Report regarding Resolution No. 138-2022 authorizing up to two members of the City Council to submit an argument in favor of a proposed ballot measure seeking voter authorization for the City of South San Francisco to develop, construct, or acquire affordable, low -rent housing units pursuant to Article XXXIV of the California Constitution and to submit a rebuttal argument if an argument against the measure is filed. (Sky Woodruff, City Attorney and Mike Futrell, City Manager) City Attorney Woodruff presented the report and indicated that the resolution authorizes the City Council to provide an argument (and a rebuttal, if required) through up to two members. Up to five people may sign the argument, any combination of whom may be a member of the City Council, duly authorized representatives of bona fide associations, or persons entitled to vote on the proposal. He also noted that when the City Clerk chooses an argument to be included in the voter information guide, the City Council will be given preference. REGULAR CITY COUNCIL MEETING AUGUST 10, 2022 MINUTES PAGE 4 Motion — Councilmember Coleman /Second – Councilmember Addiego: To approve Resolution No. 138-2022 authorizing Councilmember Addiego and Coleman to submit an argument in favor of a proposed ballot measure seeking voter authorization for the City of South San Francisco to develop, construct, or acquire affordable, low -rent housing units pursuant to Article XXXIV of the California Constitution and to submit a rebuttal argument if an argument against the measure is fled, by roll call vote: AYES: Councilmembers Addiego, Coleman, and Flores, Vice Mayor Nicolas, and Mayor Nagales; NAYS: None; ABSENT: None; ABSTAIN: None. 14. Report regarding approval and support of Assembly Bill 2407 (O'Donnell), Assembly Bill 1740 (Maratsuchi), Assembly Bill 2682 (Gray), Senate Bill 986 (Umberg), and Senate Bill 1087 (Gonzalez) to combat catalytic converter thefts (Tamiko Huey, Management Analyst I7) City Manager's Office Management Analyst Tamiko Huey provided an overview of the report, and Niccolo de Luca, Townsend Public Affairs, presented the Assembly and Senate bills for the Council's consideration. Motion — Councilmember Flores /Second – Vice Mayor Nicolas: To approve, by motion, letters of support for Assembly Bill 2407, Assembly Bill 1740, Assembly Bill 2682, Senate Bill 986, and Senate Bill 1087, by roll call vote: AYES: Councilmembers Addiego, Coleman, and Flores, Vice Mayor Nicolas, and Mayor Nagales; NAYS: None; ABSENT: None; ABSTAIN: None. 15. Report regarding adoption of an ordinance adding Chapter 10.74 to Title 10 (Public Peace, Morals and Safety) of the South San Francisco Municipal Code to prohibit the unlawful possession of used catalytic converters in the City and adoption of an urgency ordinance to immediately establish a temporary prohibition of the unlawful possession of used catalytic converters and establishing penalties for violation. (Sky Woodruff, City Attorney) Police Chief Campbell presented the report and noted that an urgency ordinance is necessary because of the volume of stolen catalytic converters in South San Francisco. Given the detrimental economic impact and safety hazards associated with the substantial number of catalytic converter thefts in the city, an urgency ordinance would assist the South San Francisco Police Department in implementing it immediately. According to California Government Code Section 36937, the City Council may initiate and enact an ordinance at the same meeting if a majority approves it of at least four-fifths of the council members are present and vote in favor. City Attorney Woodruff provided an overview of the ordinance and clarified two exceptions in the ordinance. Motion — Councilmember Flores /Second – Mayor Nagales: To introduce on first reading, an ordinance adding Chapter 10.74 to Title 10 (Public Peace, Morals and Safety) of the South San Francisco Municipal Code to prohibit the unlawful possession of used catalytic converters in the City and adoption of an urgency ordinance to immediately establish a temporary prohibition of the unlawful possession of used catalytic converters and establishing penalties for violation, by roll call vote: AYES: Councilmembers Addiego, Coleman, and Flores, Vice Mayor Nicolas, and Mayor Nagales; NAYS: None; ABSENT: None; ABSTAIN: None. 15b. Urgency ordinance No. 1643-2022 of the City of South San Francisco temporarily adding Chapter 10.74 to Title 10 (Public Peace, Morals and Safety) of the South San Francisco Municipal Code to prohibit the unlawful possession of used catalytic converters in the City and establishing penalties for violation. REGULAR CITY COUNCIL MEETING AUGUST 10, 2022 MINUTES PAGE 5 Motion — Vice Mayor Nicolas /Second – Vice Mayor Nicolas: To approve urgency ordinance No. 1643-2022 of the City of South San Francisco temporarily adding Chapter 10.74 to Title 10 (Public Peace, Morals and Safety) of the South San Francisco Municipal Code to prohibit the unlawful possession of used catalytic converters in the City and establishing penalties for violation, by roll call vote: AYES: Councilmembers Addiego, Coleman, and Flores, Vice Mayor Nicolas, and Mayor Nagales; NAYS: None; ABSENT: None; ABSTAIN: None. 16. Report regarding receipt of an Impact Report on a Citizens Initiative Ordinance of an Annual Parcel Tax on Some Commercial Office Properties for Early Care and Education and Childcare and Development Programs and adoption of Resolution No. 139-2022 Calling for the submission to South San Francisco voters of an Initiative Ordinance to Enact an Annual Parcel Tax on Some Commercial Office Properties for Early Care and Education and Childcare and Development Programs at the General Municipal Election of November 8, 2022, establishing the schedule for submission of Ballot Arguments, and Authorizing the County of San Mateo Elections Division to Conduct the election. (Mike Futrell, City Manager; Sharon Ranals, Assistant City Manager; Sky Woodruff, City Attorney) City Manager Futrell presented the report and indicated that the Council requested a 9212 Impact Report assessing the Initiative's effects in accordance with Elections Code Section 9212. To give a professional and unbiased review of the impact of the Initiative should it pass, the City hired two economic consulting firms with specialized knowledge. The revenues and commercial effects of the parcel tax component were assessed by Strategic Economics, which also worked on the study for the Shape SSF General Plan and specialized in market and development feasibility analysis, fiscal and economic implications, and public finance. Brion Economics is working on the San Mateo County Child Care Needs Assessment and has expertise in economic research and childcare planning. Staff asked Brion Economics to use the revenue projections provided by Strategic Economics and estimate the number of children eligible for preschool and the estimated number to be served. The Council engaged in questions and received responses from staff and the consultants. Council discussion on designation of voting delegates and alternates for the League of California Cities Annual Conference & Expo on September 7-9, 2022. (Mark Nagales, Mayor) Mayor Nagales said he would attend the League of California Cities Annual Conference and requested Council input on voting delegates. The Council appointed Mayor Nagales as the voting delegate and Vice Mayor Nicolas as the alternate.
