HomeMy WebLinkAboutOrd 881-1981ORDINANCE NO. 881-81 AN ORDINANCE ADDING CHAPTER 2.16 ENTITLED "MUNICIPAL ELECTIONS" TO THE SOUTH SAN FRANCISCO MUNICIPAL CODE, REPEALING THE PRIOR CHAPTER 2.16 AND ORDINANCE NO. 635 ENTITLED "AN ORDINANCE ESTABLISHING TWO ELECTIVE TERMS FOR CITY COUNCIL" THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS: SECTION 1. ADDITION OF CHAPTER 2.16 TO THE SOUTH SAN FRANCISCO MUNICIPAL CODE Chapter 2.16 is hereby added to the Municipal Code of the City of South San Francisco and shall read as follows: "MUNICIPAL ELECTIONS Sections: 2.16.010 2.16.020 2.16.030 General Municipal Elections Designated City Council - Terms Penalty for Violations 2.16.010 General Municipal Elections Designated. The general municipal election of the City of South San Francisco shall be held on the same day as the day of the school district elections as set forth in Section 2602 of the Elections Code. 2.16.020 City Council - Terms. A person elected to the Council shall be eligible to serve only two successive elective terms after being so elected. 2.16.030 Penalty for Violation. Any person violating any of the provisions of this Chapter is guilty of an infraction, and upon conviction such person shall be punished as provided in Section 36900 of the Government Code." CENTRAL RECORDS SECTION 2. SEVERABILITY. If any section, subsection, phrase or clause of this Ordinance is for any reason held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance and each section, subsection, phrase or clause thereof irrespective of the fact that any one or more sections, subsections, clauses or phrases be declared uncon- stitutional or invalid. SECTION 3. REPEAL OF PRIOR CHAPTER 2.16 OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE AND PRIOR ORDINANCE N0.'635 Chapter 2.16 of the South San Francisco Municipal Code and Ordinance No. 635, entitled "An Ordinance Establishing Two Elective Terms for City Council" is hereby repealed, except that this repeal shall not affect or pre- vent the prosecution or punishment of any person for any act done or committed in violation of any Ordinance or Municipal Code Chapter hereby repealed prior to the effective date of this Ordinance. SECTION 4. EFFECTIVE DATE. In accordance with Section 36503.5 of the Government Code, this Ordinance shall become effective upon the approval of the San Mateo County Board of Supervisors. SECTION 5. PUBLICATION DATE. This Ordinance shall be published once in the Enterprise-Journal, a newspaper of general circulation in the City of South San Francisco as re- quired by law and the City Clerk shall insure that the notice required in Section 36503.5 of the Government Code is accomplished.
