HomeMy WebLinkAboutOrd 900-1982 ORDINANCE NO. 900-82 AN ORDINANCE ADDING SECTIONS 20.08.025 AND 20.08.105 DEFINING "AMUSEMENT ARCADE" AND "COIN OPERATED AMUSE- MENT DEVICE", AND AMENDING SECTION 20.28.040 OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE AND SECTION 3.43 OF ORDINANCE NO. 353 ENTITLED "ZONING ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO, AS AMENDED BY ORDINANCE NO'S. 365.and 490. THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS: SECTION 1. SECTIONS 20.08.025 AND 20.08.105 ADDED There are hereby added Sections 20.08.025 and 20.08.105 to the South San Francisco Municipal Code which shall read as follows: "20.08.025 Amusement Arcade. 'Amusement Arcade' means any public place of amusement or public place of business in which three (3) or more coin operated amusement devices are installed and includes any place open to the public whether or not the primary use of the premises is devoted to the operation of such coin operated amusement devices." "20.08.105 Coin Operated Amusement Device. 'Coin Operated Amusement Device' means any device, machine, apparatus or other instrument (includ- ing but not limited to electronic games, marble games and pinball games) the operation of which is permitted, controlled, allowed or made possible by the deposit or placing of any coin, plate, disk, slug or key into any slot, receptacle, crevice or other opening, or by the payment of any fee or fees, for its use as a game or contest of any description, or which may be used for any such game or contest, and the use or possession of which is not prohibited by any laws of the State of California." SECTION 2. SECTION 20.28.040.B OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE AND SECTION 3.43(b) OF ORDINANCE NO. 353 AMENDED Section 20.28.040.B of the South San Francisco Municipal Code and Section 3.43(b) of Ordinance No. 353, as amended by Ordinance Nos. 365 and 490, are hereby amended to read as follows: "B. Other stores within a building, mortuaries, service stations, theaters, amusement arcades, drive-in banks, drive-in restaurants, any "on sale" establishment where liquor is served, used car lots, and other uses which, in the opinion of the Planning Commission, are of a similar nature." SECTION 5. SEVERABILITY. If any section, subsection, phrase or clause of this Ordinance is for any reason held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance and each section, subsection, phrase or clause hereof, irrespective of the fact that any one or more sections, subsections, clauses or phrases be declared uncon- stitutional or invalid. SECTION 6. PUBLICATION AND EFFECTIVE DATE. This Ordinance shall be published once in the Enterprise-Journal, a newspaper of general circulation in the City of South San Francisco, as required by law, and shall become effective thirty (30) days from and after its adoption.
