HomeMy WebLinkAboutOrd 907-1982ORDINANCE NO. 907-82 AN ORDINANCE ADDING TO THE SOUTH SAN FRANCISCO MUNICIPAL CODE CHAPTER 2.50 ENTITLED "SCOPE OF AUTHORITY OF CODE ENFORCEMENT OFFICER" THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS: SECTION I. CHAPTER 2.50 ADDED TO THE SOUTH SAN FRANCISCO MUNICIPAL CODE There is hereby added to the South San Francisco Municipal Code Chapter 2.50, which shall read as follows: "Chapter 2.50 SCOPE OF AUTHORITY OF CODE ENFORCEMENT OFFICER Sections: 2.50.010 Powers of Arrest delegated. 2.50.020 Limitation. 2.50.010 Powers of Arrest delegated. Each and every individual employed by the City of South San Francisco in the classified position of Code Enforce- ment Officer, after having been administered the Oath of Office as required elsewhere in this Code, is hereby delegated the power to arrest a person with- out a warrant whenever said Code Enforcement Officer has reasonable cause to believe that the person to be arrested has committed a misdemeanor in his presence which is a violation of any Section of the South San Francisco Municipal Code or of any of the Ordinances of the City of South San Francisco." 2.50.020 Limitation. The delegation of arrest power-contained in Section 2.50.010 is made pursuant to Penal Code Section 836.5 and is not intended to give a Code Enforcement Officer of this city the general powers, duties and responsibilities of a Police Officer of this city or of a Peace Officer of the State of California." SECTION II. SEVERABILITY If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such decision shall -l= not affect the validity or constitutionality of the remaining portion of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. SECTION III. PUBLICATION AND EFFECTIVE DATE This Ordinance shall be published once in the Enterprise-Journal, a newspaper of general circulation in the City of South San Francisco, as required by law, and shall become effective thirty (30) days from and after its adoption. Introduced this 15th day of October , 1982. Passed and adopted as an Ordinance of the City of South San Francisco at the regular meeting of the City Council of the City of South San Francisco this 6th day of October , 1982, by the following vote: AYES: Councilmembers Ronald G. Acosta, ~ark N. Addiego, Emanuele N.
