HomeMy WebLinkAboutOrd 911-1982ORDINANCE NO. 911-82 AN ORDINANCE AMENDING VARIOUS SECTIONS OF CHAPTER 6.16 OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE AND VARIOUS SUBSECTIONS OF SECTION 4 OF ORDINANCE NO. 720 ENTITLED "AN ORDINANCE LICENSING THE TRANSACTIONS AND CARRYING ON THE CERTAIN BUSINESSES, TRADES, PROFESSIONS, CALLINGS AND OCCUPATIONS IN THE CITY OF SOUTH SAN FRANCISCO, FOR THE PURPOSE OF RAISING MUNICIPAL REVENUE AND PROVIDING FOR THE VIOLATION THEREOF" AS AMENDED BY ORDINANCE NO. 751, ALL PROVIDING FOR INCREASES IN CERTAIN BUSINESS LICENSE TAXES. THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS: SECTION 1. SUBSECTION 6.16.030B OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE AND SUBSECTION 4.2.1 OF ORDINANCE NO. 720 AMENDED Subsection 6.16,030B of the South San Francisco Municipal Code and Subsection 4.2.1 of Ordinance No. 720 as amended by a portion of Section 1 of Ordinance No. 751 are hereby amended to read as follows: "B. The license tax is seventy five dollars per year plus five dollars for each employee with a maximum tax of one thousand dollars, unless the business or personal service is specifically taxed by another provision of this chapter in which event such specific tax shall apply." SECTION 2. SUBSECTION 6.16.050B OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE AND SUBSECTION 4.6.1 OF ORDINANCE NO. 720 AMENDED Subsection 6.16.050B of the South San Francisco Municipal Code and Subsection 4.6.1 of Ordinance No. 720 are hereby amended to read as follows: "B. The license tax is one hundred fifty dollars for a general or prime contractor and one hundred twenty-five dollars for a subcontractor or specialty contractor." SECTION 3. SUBSECTION 6.16.080B OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE AND SUBSECTION 4.9.1 OF ORDINANCE NO. 720 AMENDED Subsection 6.16.080B of the South San Francisco Municipal Code and Subsection 4.9.1 of Ordinance No. 720 are hereby amended to read as follows: "B. The license tax is seventy-five dollars plus five dollars for each employee with a maximum tax of one thousand dollars." SECTION 4. SUBSECTION 6.16.120B OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE AND SUBSECTION 4.14.1 OF ORDINANCE NO. 720 AMENDED Subsection 6.16.120B of the South San Francisco Municipal Code and Subsection 4.14.1 of Ordinance No. 720 are here6y amended to read as follows: "B. The license tax is as follows: 1. One natural person conductingsuch a business, a tax of one hundred fifty dollars; 2. Two or more natural persons conducting such a business as an association, partnership, or professional corporation, a tax of one hundred fifty dollars plus one hundred twenty-five dollars for each natural person par- ticipating as an associate, partner or member of the professional corporation." SECTION 5. SUBSECTION 6.16.150B OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE AND SUBSECTION 4.18.1 OF ORDINANCE NO. 720 AMENDED Subsection 6.16.150B of the South San Francisco Municipal Code and Subsection 4.18.1 of Ordinance No. 720 as amended by a portion of Section 1 of Ordinance No. 751 are hereby amended to read as follows: "B. The license tax is seventy-five dollars plus six dollars per room SECTION 6. SUBSECTION 6.16.160B OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE AND SUBSECTION 4.19.1 OF ORDINANCE NO. 720 AMENDED Subsection 6.16.160B of the South San Francisco Municipal Code and Subsection 4.1~'1 of Ordinance No. 720 are hereby amended to read as follows: "B. 'The license tax is seventy-five dollars plus five dollars per employee, with a maximum tax of one thousand dollars." SECTION 7' SUBSECTION 6.16.200B OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE AND SUBSECTION 4.23.1 OF ORDINANCE NO. 720 AMENDED Subsection 6.16.200B of the South San Francisco Municipal Code and Subsection 4.23.1 of Ordinance No. 720 as amended by a portion of Section 1 of Ordinance no. 751 are hereby amended to read as follows: -2- 'lB o per space." SECTION 8. The license tax is seventy-five dollars plus six dollars SUBSECTION 6.16.210B OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE AND SUBSECTION 4.24.1 OF ORDINANCE NO. 720 AMENDED Subsection 6.16.210B of the South San Francisco Municipal Code and Subsection 4.24.1 of Ordinance No. 720 as amended to read as follows: "B. The license tax is seventy-five dollars per vehicle plus five dollars for each employee." SECTION 9. SUBSECTION 6.16.220B OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE AND SUBSECTION 4.25.1 OF ORDINANCE NO. 720 AMENDED Subsection 6.16.220B of the South San Francisco Municipal Code'and Subsection 4.25.1 of Ordinance No. 720 are hereby amended to read as follows: "B. The license tax is seventy-five dollars plus five dollars per employee." SECTION 10. SUBSECTION 6.16.230B OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE AND SUBSECTION 4.26.1 OF ORDINANCE NO. 720 AMENDED Subsection 6.16.230B of the South San Francisco Municipal Code and Subsection 4.26.1 of Ordinance No. 720 as amended .to read as follows: "B. The license tax is seventy-five dollars plus five dollars for each employee, with a maximum tax of one thousand dollars." SECTION 11. SECTION 6.16.240 OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE AND SUBSECTION 4.3 OF ORDINANCE NO. 720 AMENDED Section 6.16.240 of the South San Francisco Municipal Code and Subsection 4.3 of Ordinance No.720 are hereby amended to read as follows: "6.16.240 Other businesses~ callings, occupations~ professions and trades. Businesses, callings, occupations, professions and trades not specifi- cally licensed by this chapter or exempted by the provisions of this chapter or chapters 6.04 through 6.12 shall pay a tax of sevent~ ,ive dollars plus five dollars for each employee." SECTION 12. SEVERABILITY. If any section, subsection, sentence clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions.of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance and each section, subsection, sentence, clause or phrase hereof, irrespective of'the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. SECTION 13. EFFECTIVE DATE AND PUBLICATION. This Ordinance, inasmuch as it provides for a tax levy for the usual and current expenses of the City shall be effective immediately upon adoption. This Ordinance shall be published once in the "Enterprise-Journal", a newspaper of general circulation in the City of South San Francisco,.as required by law.
