RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SOUTH SAN FRANCISCO TERMINATING THE
EXISTENCE OF A LOCAL EMERGENCY RELATED TO
THE NOVEL CORONAVIRUS ("COVID-19") EFFECTIVE
FEBRUARY 28, 2023.
WHEREAS, Section 8630, Article 14, of the California Emergency Services Act empowers the
City Council to proclaim the existence or threatened existence of a local emergency when the City of South
San Francisco ("City") is affected or likely to be affected by a public calamity; and
WHEREAS, Section 2.72.060 of the South San Francisco Municipal Code ("SSFMC") authorizes
the City Manager, serving as the Director of Emergency Services to proclaim, or to request the City Council
to proclaim, the existence or threatened existence of a local emergency; and
WHEREAS, SSFMC Section 2.72.060 authorizes the director of emergency services to make and
issue rules and regulations on matters reasonably related to the protection of life and property as affected by
such emergency; provided, however, such rules and regulations must be confirmed at the earliest practicable
time by the City Council; and
WHEREAS, on March 11, 2020, the City Council passed Resolution No. 35-2020 proclaiming a
local State of Emergency related to the Novel Coronavirus 2019 (COVID-19); and
WHEREAS, on March 16, 2020, seven health officers within six Bay Area counties, including San
Mateo County ("County"), took a unified step to slow the spread of COVID-19 and preserve critical health
care capacity across the region by issuing a legal order directing their respective residents to shelter at home
and limiting activity, travel and business functions to only the most essential needs for three weeks,
beginning March 17, 2020; and
WHEREAS, on March 19, 2020, Governor Gavin Newsom issued a statewide order ordering all
individuals living in the State of California ("State") to stay home or at their place of residence, except as
needed to maintain continuity of operation of the federal critical infrastructure sectors; and
WHEREAS, on May 13, 2020, the City Council passed Resolution No. 57-2020 amending and
updating the Emergency Proclamation; and
WHEREAS, Resolutions No. 35-2020 and 57-2020 declared that the local emergency shall be
deemed to continue to exist until its termination is proclaimed by the City Council; and
WHEREAS, the City rapidly responded and supported the protection of public health and safety
during the highly uncertain time as well as proactively managed the subsidiary issues caused by the
COVID-19

pandemic including rapidly changing economic conditions and adjusting City operations to meet the safety
needs of the public and workforce; and
WHEREAS, with the availability of vaccines and boosters, testing, anti-viral medications and
masking, COVID-19 has become less of a burden on day-to-day lives and the City can continue to operate
safely as COVID-19 protections have become part of regular City operations; and
WHEREAS, the City Council has reviewed the conditions that necessitated the proclamation of a
local emergency issued on March 11, 2020; and
WHEREAS, although the City will continue to comply with the State of California's COVID-19
non -emergency regulations, adopted by the California Occupational Safety and Health Standards Board, as
part of daily operations, the prior conditions of extreme peril and threat of peril to the safety of people and
property in the City caused by the global spread of the COVID-19 pandemic are no longer present; and
WHEREAS, On October 17, 2022, Governor Gavin Newsom announced that the State of
California's COVID-19 state of emergency will end on February 28, 2023, citing that California has the
tools needed to continue fighting COVID-19 when the State of Emergency terminates, including vaccines
and boosters, testing, treatments, and other mitigation measures such as masking and indoor ventilation; and
WHEREAS, pursuant to Government Code Section 8630(c), the South San Francisco City Council
has determined that the situation resulting from said condition of extreme peril is now deemed not to be
beyond the control of normal protective services, personnel, equipment, and facilities of and within said City
of South San Francisco; and
WHEREAS, it is therefore appropriate to terminate the local emergency related to the COVID-19
pandemic.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of South San Francisco
does hereby proclaim that the local emergency related to the COVID-19 pandemic, as previously set forth in
Resolution Nos. 35-2020 and 57-2020, is hereby terminated effective on February 28, 2023 or upon such
date that the State of California's COVID-19 state of emergency ends, whichever is later.
BE IT FURTHER RESOLVED that this resolution shall not impact or terminate the local state of
emergency initially ratified and declared by the City Council on January 11, 2023 via Resolution No.
01-2023 relating to severe storm weather events. Said local emergency shall continue until separately
terminated by the City Council, and shall be separately reviewed and acted upon by the City Council in
accordance with Section 8630, Article 14, of the California Emergency Services Act.

At a meeting of the City Council on 2/22/2023, a motion was made by Vice Mayor Nagales,
seconded by Councilmember Addiego, that this Resolution be approved. The motion passed.
