AN ORDINANCE ADDING SECTION 4.04.095 TO THE SOUTH
SAN FRANCISCO MUNICIPAL CODE AND AMENDING THE FIRST
SENTENCE OF SECTION 4.04.100, THE FIRST SENTENCE OF
SUBSECTION 4.04.100B AND SECTION 4.04.110 OF SAID
CODE AND AMENDING THE CORRESPONDING PORTIONS OF
ORDINANCE NO. 857 ENTITLED, "AN ORDINANCE OF THE
CITY OF SOUTH SAN FRANCISCO PROVIDING FOR THE PRO-
CEDURE FOR THE PURCHASE AND SALE OF SUPPLIES, SER-
VICES AND EQUIPMENT AND REPEALING ORDINANCE NO. 467"
THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS:
SECTION 1. SECTION 4.04.095 ADDED TO THE MUNICIPAL CODE
Section 4.04.095 is hereby added to the South San Francisco Municipal Code
and shall read as follows:
"4.04.095 Written Contract Required for Public Works Projects and Major
Acquisitions and Sales. Purchases and contracts for supplies, services,
equipment and the sale of personal property in an amount exceeding the
limits set forth in Section 4.04.110 and those associated with a Public
Project as defined in Public Contract Code Section 20160 et seq., shall
be by written contract with the lowest responsible bidder (or in the case
of sales by the City, the highest responsible bidder) pursuant to the
procedures set forth in this Chapter."
SECTION 2. THE FIRST SENTENCE OF SECTION 4.04.100 OF THE MUNICIPAL CODE
AND THE FIRST SENTENCE OF SECTION lO OF ORDINANCE NO. 857 AMENDED.
The first sentence of Section 4.04.100 of the South San Francisco Municipal
Code and the first sentence of Section 10 of Ordinance No. 857 are hereby amended
to read as follows:
"Purchases of equipment, supplies, services and the sale of personal property
in an amount exceeding the limits set forth in Subsection 4.04.110 (a) shall
be accomplished using the bidding procedure described in this Section:"
SECTION 3. THE FIRST SENTENCE OF SUBSECTION 4.04.100B OF THE MUNICIPAL
CODE AND THE FIRST SENTENCE OF SUBSECTION lO(b) OF ORDINANCE
NO. 857 AMENDED.
The first sentence of Subsection 4.04.100B of the South San Francisco
Municipal Code and the first sentence of Subsection lO(b) of Ordinance No. 857
are hereby amended to read as follows:
"All bids presented in connection with a public project as defined in
Public Contract Code Section 20160 et seq., shall be accompanied by
bidder's security in the form and amount prescribed by Public Contract
Code Section 20170 et seq., which security shall be dealt with as
prescribed therein."
SECTION 4. SECTION 4.04.110 OF THE MUNICIPAL CODE AND SECTION ll OF
ORDINANCE NO, 857 AMENDED.
Section 4.04.110 of the South San Francisco Municipal Code and Section ll
of Ordinance No. 857 are hereby amended to read as follows:
"4.04.110 Open Market Procedure.
(a) Purchases of supplies, equipment and services and sales of personal
property may be made by the Purchasing Officer in the open market without
observing the procedure prescribed by Section 4.04.100 where the estimated
value, exclusive of sales tax and freight, does not exceed:
(1) Five thousand dollars ($5,000.00) in the case of public
projects as defined in Public Contract Code Section
20160 et seq.; or
(2) Ten thousand dollars ($10,000.00) in the case of all other
purchases not otherwise specifically governed by state or
federal law.
(b) Open market purchases shall, whenever possible, be based on at least
three bids, and shall be awarded to the lowest responsible bidder.

(c) The Purchasing Officer shall solicit open market bids by written
requests to prospective vendors, by telephone, and by public notice
posted on a public bulletin board in the City Hall.
(d) Sealed written bids shall be submitted to the Purchasing Officer
who shall keep a record of all open market orders and bids for a period
of one year after the submission of bids for a period of one year after
the submission of bids or the placing of orders. Said record, while so
kept, shall be open to public inspection."
SECTION 5. PUBLICATION AND EFFECTIVE DATE.
This Ordinance shall be published once in the Enterprise-Journal, a newspaper
of general circulation in the City of South San Francisco, as required by law, and
shall become effective thirty (30) days from and after its adoption.
