HomeMy WebLinkAboutOrd 1066-1989ORDINANCE NO. 1066-89 AN ORDINANCE AMENDING CHAPTER 4.20 OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE TO INCREASE THE TRANSIENT OCCUPANCY TAX TO FUND A CONFERENCE CENTER THE PEOPLE OF THE CITY OF SOUTH SAN FRANCISCO DO HEREBY ORDAIN AS FOLLOWS: SECTION 1. Section 4.20.035 of the South San Francisco Municipal Code added A new section, Section 4.20.035 is hereby added to the South San Francisco Municipal Code to read: Section 4.20.035 Conference Center tax imposed Notwithstanding any fee, tax, assessment or other charge for the privilege of occupancy in any hotel, each transient is subject to and shall pay a two dollars and fifty cents tax, the proceeds of which shall be devoted to the acquisition, renovation, maintenance, and operation of a conference center facility in the city. The tax constitutes a debt owed by the transient to the city which is extinguished only by payment to the operator or to the city. The transient shall pay the tax to the operator of the hotel at the tin!e the rent is paid. If the rent is paid in installments, a proportionate share of the tax shall be paid with each installment. The unpaid tax shall be due upon the transient's ceasing to occupy space in the hotel. If for any reason the tax due is not paid to the operator of the hotel, the tax administrator may require that such tax shall be paid directly to the tax administrator. SECTION 2. SEVERABILITY In the event any section or portion of this ordinance shall be determined invalid or unconstitutional, such section or portion shall be deemed severable and all other sections or portions hereof shall remain in full force and effect. SECTION 3. EFFECTIVE DATE This ordinance shall be adopted, if approved by two-thirds of the voters voting on the measure, at an election to be held November 7, 1989, and shall go into effect ten (10) days after the City Council has by resolution declared that such ballot measure was approved by two-thirds of the voters voting thereon. This ordinance was introduced and approved at a regular meeting of the City Council of the City of South San Francisco, held on July 12, 1989, for submission to the voters at an election to be held on November 7, 1989, by the following vote: AYES: Councilmembers Mark N. Addieqo, Jack Dra§o, Richard A.
