AN ORDINANCE AMENDING CHAPTER 15.16 OF THE SOUTH SAN
FRANCISCO MUNICIPAL CODE TO ADOPT THE UNIFORM MECHANICAL
CODE, 1988 EDITION, AND TO REPEAL THE UNIFORM MECHANICAL
CODE, 1976 EDITION
THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN
AS FOLLOWS:
SECTION 1.
Uniform Mechanical Code, 1976 Edition,
Repealed.
The Uniform Mechanical Code, 1976 Edition (South San
Francisco Municipal Code Sections 15.16.010 through 15.16.090),
as enacted by Ordinance 758-78, and other ordinances or parts of
ordinances in conflict herewith is hereby repealed. This repeal
shall not effect or prevent the prosecution or punishment of any
person for any act done or omitted in violation of this chapter
prior to the effective date of this ordinance.
SECTION 2. Chapter 15.16 of the South San Francisco
Municipal Code is hereby amended to read as follows:
Section 15.16.010
Uniform Mechanical Code, 1988 Edition,
adopted by reference.
The Uniform Mechanical Code, 1988 Edition, published by the
International Association of Plumbing and Mechanical
Officials, and the International Association of Building
Officials as modified by the amendments, additions and
deletions set forth hereinafter, is hereby adopted by
reference as the Mechanical Code of the City of South San
Francisco, and may be cited as such.
Section 15.16.020 Amendments, General.
Set forth below are the amendments, additions and deletions
to the Uniform Mechanical Code, 1988 Edition. Section
numbers used herein are those of the Uniform Mechanical
Code.
Section 15.16.030 Violations.
Section 204. It shall be unlawful for any person, firm or
corporation to erect, construct, enlarge, alter, repair,
move, improve, remove, convert or demolish, equip, use or
maintain any mechanical systems or equipment or cause or
permit the same to be done in violation of this code. Each
day during any portion of which any violation of this code
is committed or continued by any person, firm or corporation
shall constitute a separate offense and shall be punishable
as herein provided.
Section 15.16.040 Penalties.
Section 205. Any person, firm or corporation violating any
of the provisions of this code shall be punished as provided
for in Section 15.06.040.
SECTION 3.
SEVERABILITY.
In the event any section or portion of this ordinance
shall be determined invalid or unconstitutional, such section or
portion shall be deemed severable and all other sections or
portions hereof shall remain in full force and effect.
SECTION 4.
PUBLICATION AND EFFECTIVE DATE.
After the introduction of this ordinance, pursuant to
Government Code Section 50022.3, notice of a public hearing to be
held on December 13, 1989, shall be published once a week for two
successive weeks in the Enterprise-Journal, a newspaper of
general circulation in the City of South San Francisco.
Pursuant to the provisions of the Government Code Section
36933, a summary of this ordinance shall be prepared by the city
attorney. At least five (5) days prior to the Council meeting at
which this ordinance is scheduled to be adopted, the city clerk
shall (a) publish the summary, and (2) post in the city clerk's
office a certified copy of this ordinance. Within fifteen (15)
days after the adoption of this ordinance, the city clerk shall
(1) publish the summary, and (2) post in the city clerk'S office
a certified copy of the full text of this ordinance along with
the names of those City Council members voting for and against
this ordinance or otherwise voting.
This ordinance shall become effective thirty (30) days from
and after its adoption.
Introduced at a regular meeting of the City Council of the
City of South San Francisco, held the 8th day of
November , 19 89 .
Adopted as an Ordinance of the City of South San Francisco
at a regular meeting of the City Council of the City of
South San Francisco, held on the 13th day of December ,
19 89 , by the following vote:
AYES: Councilmembers Jack Drago, Gus Nicolopulos, John R. Penna,
Roberta Cerri Teqlia, and Mayor Richard A. Haffey
