HomeMy WebLinkAboutOrd 1104-1991ORDINANCE NO. 1104-91 A REINTRODUCTION OF ORDINANCE AMENDING TITLE 20 OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE REGARDING RESIDENTIAL CARE FACILITIES, AND REPEALING ORDINANCE NO. 1099-91 THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS: SECTION 1. Ordinance No. 1099-91 Repealed. Ordinance No. 1099-91, adopted March 27, 1991, to amend various sections of Title 20 of the South San Francisco Municipal Code is hereby repealed in its entirety. SECTION 2. Chapter 20.06 Amended. Subsection 20.06.220(g) of the South San Francisco Municipal Code is hereby added to read: "(g) Group Care. The Group Care use type refers to services provided in residential facilities licensed by the Director of the State Department of Social Services to serve seven or more persons, but excludes those uses classified under Day Care Services and Major Public Services. Typical uses include halfway houses and intermediate care facilities." SECTION 3. Chapter 20.06 Amended. Subsection 20.06.220(i) of the South San Francisco Municipal Code is hereby added to read: "(i) Residential Care Facilities for Elderly. A group housing arrangement, licensed by the State Department of Social Services to serve seven or more persons, chosen voluntarily by residents who are over 62 years of age and who are provided varying levels of support service or care, but not skilled nursing." SECTION 4. Residential Care Facilities for the Elderly Subject to a Use Permit. "Residential Care Facilities for the Elderly" is hereby added as a use permitted subject to a use permit in the R-3, C-1, P-C, D-C, M-l, and P-I zone districts by adding the use to the list of uses under (a) Residential Use Type in Sections 20.20.030, 20.22.040, 20.24.030, 20.26.030, 20.30.030, 20.32.030 of the South San Francisco Municipal Code. SECTION 5. Chapter 20.74 Amended. Subsection (e) is added to Section 20.74.040 of the South San Francisco Municipal Code to read: "(e) Residential Care Facilities for the Elderly. (1) Buildings constructed as residential care facilities serving from seven to fifteen residents shall be required to provide one parking space for each seven residents, in addition to one parking space for each live-in caregiver. At least two of the parking spaces shall be enclosed, one of which may be tandem. (2) Buildings constructed as residential care facilities serving more than fifteen residents shall be required to provide one parking space for each seven residents in addition to one parking space for each caregiver, employee, and doctor to be on-site at any one time. (3) Existing single-family residences to be converted into residential care facilities shall maintain existing covered parking; additional parking to meet the requirement of Subsections (a) or (b) above, as applicable, may be enclosed or uncovered." SECTION 6. Chapter 20.74 Amended. Section 20.74.050(e) of the South San Francisco Municipal Code is amended to read: "(e) Group Care. Two spaces for every three beds. The planning commission may require additional parking spaces for guest parking when the commission finds such additional parking is necessary to serve the development, after taking into consideration the non-availability or limited availability of on-street parking facilities in and adjacent to the development." SECTION 7. Publication and Effective Date. This ordinance shall be published once, with the names of those City Council members voting for or against it, in the Enterprise-Journal, a newspaper of general circulation in the City of South San Francisco, as required by law, and shall become effective thirty (30) days from and after its adoption.
