HomeMy WebLinkAboutOrd 1105-1991ORDINANCE NO. 1105-91 AN ORDINANCE AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS: SECTION 1. Amendment to agreement authorized. An amendment to the contract between the City Council of the City of South San Francisco and the Board of Administration, California Public Employees' Retirement System is hereby authorized. A copy of the amendment is attached and incorporated as Exhibit "A". SECTION 2. City Manager authorized to execute. The City Manager is hereby authorized, empowered, and directed to execute the amendment for and on behalf of the City. SECTION 3. Publication and Effective Date. This ordinance shall be published once, with the names of those City Councilmembers voting for or against it, in the Enterprise Journal, a newspaper of general circulation in the City of South San Francisco, as required by law, and shall become effective thirty (30) days from and after its adoption. Introduced at a reqular meeting of the City Council of the City of South San Francisco, held the llth day of September , 1991. Penna, Gus Nic0]0pu]0s, Roberta Cerri Teqlia, and Ma.¥or Jack Draqo NOES: None ABSTAIN: None ABSENT: None As Mayor of the City of South San Francisco, I do hereby approve the foregoing Ordinance this 25th day of September 1991. -'* * * C 0 P ¥ * * * Exhibit "A" ORDINANCE NO. 1105-91 The Board of Administration, Public Employees' Retirement System, hereinafter referred to as Board, and the governing body of above public agency, hereinafter referred to as Public Agency, having entered into a contract effective September 1, 1945, and witnessed September 12, 1945, and as amended effective September 1, 1949, December 1, 1953, January 1, 1960, January 1, 1963, February 1, 1967, January 1, 1968, January 1, 1969, November 1, 1973, April 19, 1974, January 21, 1977, November 11, 1977, December 19, 1980, August 23, 1985, January 23, 1987 and December 22, 1989, which provides for participation of Public Agency in said System, Board and Public Agency he~eb¥ agree as follows: Paragraphs 1 through 11 are hereby stricken fro~ said contract as executed effective December 22, 1989, and hereby replaced by the following paragraphs numbered 1 through 12 inclusive= All words and terms used herein which are defined in the Public Employees* Retirement Law shall have the meaning as defined therein unless otherwise specifically provided. 'Normal retirement age' shall mean age 60 for local miscellaneous members and age 50 for local safety members. Public Agency shall participate in the Public Employees* Retirement System from and after September 1, 1945 making its employees as hereinafter provided, members of said System subject to all provisions of the Public Employees* Retirement Law except such as apply only on election of a contracting agency and are not provided for herein and to all amendments to said Law hereafter enacted except those, which by express provisions thereof, apply only on the election of a contract- in9 agency. ® Employees of Public Agency in the foil.win9 classes shall become members of said Retirement System except such in each such class as are excluded by law or this agreement= a. The percentage of final compensation to be provided for local miscel- laneous members for each year of credited prior and current service shall be determined in accordance with Section 21251.13, subject to the reduction provided therein for service on and after &ugust 18, 1959 for members whose service has been included in Federal Social Security (2% at age 60 Full and Modified). The percentage of final compensation to be provided for each year of credited prior and current service as a local safety member shall be determined in accordance with Section 21252.01 of said Retirement Law (2% at age 50 Full).
