HomeMy WebLinkAboutOrd 1128-1993ORDINANCE NO. 1 lPR-q3 AN ORDINANCE OF THE CITY COUNCIL OF SOUTH SAN FRANCISCO REZONING A 0.38 ACRE PARCEL AT 830 TENNIS DRIVE FROM OPEN SPACE TO R-1-E THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS: SECTION 1. Findings. The subject property is being created through Parcel Map PM- 93-300 and is a .038 acre parcel containing an existing single- family residence. The lot abuts the Circle Court single-family subdivision on the north and access is provided by Tennis Drive which is a public street. Originally, this property was part of a larger parcel that was acquired by the City for the expansion of Orange Memorial Park. In order to maintain the Mazzanti family residence, the City is proposing the tentative parcel map to subdivide the property to create a parcel for the dwelling. The rezoning is consistent with the City's General Plan. An Environmental Impact Report, EIR 92-16, has been prepared for the Orange Memorial Park and the expansion. This rezoning has been addressed in the document and mitigation measures have been included in the conditions of the tentative parcel map which is being processed in conjunction with the rezoning. The proposed Rezoning will ensure the Zoning Ordinance and the General Plan are consistent for this property and that the proposed land uses are compatible with the policies and codes in these documents. Additionally, the existing land use patterns of the community will not be affected substantially. SECTION 2. Rezoning. The parcel described in Exhibit "A" and identified as a .038 parcel containing a single family home at the westerly terminus of Tennis Drive (820 Tennis Drive) is hereby rezoned from Open Space to R-i-E, Single Family Residential. SECTION 3. Severability. In the event any section or portion of this ordinance shall be determined invalid or unconstitutional, such section or portion shall be deemed severable and all other sections or portions hereof shall remain in full force and effect. SECTION 3. Publication and Effective Date. This ordinance shall be published once, with the names of those City Councilmembers voting for or against it, in the Enterprise-Journal, a newspaper of general circulation in the City of South San Francisco, as required by law, and shall become effective thirty (30) days from and after its adoption. Introduced at a re.qu]ar meeting of the City Council of the City of South San Francisco, held the 28th day of April , 1993.
