AN ORDINANCE OF THE SOUTH SAN FRANCISCO CITY
COUNCIL AMENDING SECTION 20.97.070 -
ABANDONMENT - OF THE SOUTH SAN FRANCISCO
MUNICIPAL CODE RELATED TO EXTENDING THE TIME
PERIOD AFTER A NONCONFORMING USE HAS CEASED
USE OF A BUILDING BEFORE IT IS CONSIDERED
ABANDONED FROM SIX MONTHS TO ONE YEAR AND
PROVIDING FOR ONE ADDITIONAL YEAR, IF APPROVED
BY THE PLANNING COMMISSION, BEFORE ABANDONMENT
OCCURS
The City Council of the City of South San Francisco does ordain
as follows:
SEC?ION ~. Section 20.97.070 of the South San Francisco
Municipal Code is hereby amended to read as follows:
20.97.070 Abandonment
If the nonconforming use of a building or
structure, or a portion of a building or structure
ceases for a'continuous period of one year, it shall be
considered abandoned and shall thereafter be used only
in accordance with the regulations for the district in
which it is located. The one year period shall
commence whenever any one of the following
circumstances first occurs: the use ceases and (a) the
site is vacated, or (2) the utilities are terminated,
or (3) the lease is terminated. The Planning
Commission may approve an additional one year time
period during which the use will not be considered
abandoned provided that the Planning Commission finds
that economic conditions warrant the additional time.
In the event that such additional time period is
approved, the total period during which the use will
not be considered abandoned shall not exceed two years
from the date the use ceased to operate.
SECTION 2:
SEVERABILITY.
In the event any section or portion of this ordinance shall
be determined invalid or unconstitutional, such section or
portion shall be deemed severable and all other sections or
portions hereof shall remain in full force and effect.
SECTION 3:
PUBLICATION AND EFFECTIVE D~TE.
This ordinance shall be published once, with the names of
those City Councilmembers voting for or against it, in the San
Mateo Times, a newspaper of general circulation in the City of
South San Francisco, as required by law, and shall become
effective thirty (30) days from and after its adoption.

regular meeting of the City Council of the City of South San
Francisco, held the 9th day of Auqust , 1995, by the
following vote:

Roberta Cerri Teqlia and Mayor Robert Yee
