HomeMy WebLinkAboutOrd 1173-1995ORDINANCE No. 1173-95 AN ORDINANCE OF THE SOUTH SAN FRANCISCO CITY COUNCIL AMENDING CHAPTER 20.84 - PLANNED UNIT DEVELOPMENT PERMIT PROCEDURE - OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE RELATED TO ADDING FINDINGS OF APPROVAL, ENABLING THE PLANNING COMMISSION TO ESTABLISH DESIGN GUIDELINES The City Council of the City of does ordain as follows: South San Francisco SECTION 1. Section 20.84.020 - Scope - of the South San Francisco Municipal Code is hereby amended to read as follows: 20.84.020 Scope. The PUD permit procedure shall be optional for development projects in all districts and mandatory for projects within a district containing a up, suffix designator. For the purpose of this section, a development project is defined as the development, or modification of a parcel of land under one ownership or under unified control and which is not subject to a specific plan as defined in the California Planning and Zoning Law. SECTION 2. Section 20.84.045 - Required Findings - of the South San Francisco Municipal Code is hereby added to read as follows: 20.84.045 Required Findings. Prior to the approval of a Planned Unit Development Permit the approving body shall make the following findings in the affirmative: (a) The subject site is physically suitable for the type and intensity of the land use being proposed. (b) Exceptions from the general development standards of the underlying zone district proposed by the project shall be warranted as follows and such finding for an exception shall be supported by citing the grounds for this determination. (1) The planned unit development is of a superior quality which offsets any adverse impacts of the requested exception from general development standards; or (2) The exception will result in a project of superior design or otherwise be of general benefit to the community or neighborhood, and (3) The exception will not be unreasonably detrimental to the health, safety, welfare, comfort or convenience of persons working or residing in the vicinity of the property. (4) The additional findings of Section 20.84.070(a) must be made for projects requesting a reduction in required parking or loading spaces. (c) For residential projects: (1) the development will create a residential environment of sustained desirability and stability, and (2) the development will result in an intensity of land utilization no higher than that permitted or required for similar development by this Title. (d) Where a minor residential addition or infill residential development is required by this Title to obtain a Planned Unit Development permit, finding (b) shall not apply. Rather, the project shall be found to conform to previously established standards for setbacks, lot coverage, height, bulk and general compatibility with the neighborhood. (e) The project complies with the provisions of the California Environmental Quality Act (CEQA). (f) The proposed development is consistent with the General Plan. (g) The proposed development will not be unreasonably adverse to the public health, safety, or general welfare of the community, 'nor unreasonably detrimental to the surrounding properties or improvements. (h) The development generally complies with adopted design guidelines. SECTION 3. Section 20.84.170 of the South San Francisco Municipal Code is hereby added to read as follows: 20.84.170 Design Guidelines. The Planning Commission may, by resolution, adopt and periodically update Planned Unit Development design guidelines to more fully define the design elements or project qualities which the City wishes to encourage. SECTION 4. SEVERABILITY In the event any section or portion of this ordinance shall be determined invalid or unconstitutional, such section or portion shall be deemed severable and all other sections or portions hereof shall remain in full force and effect. SECTION 5. EFFECTIVE DATE: PUBLICATION: POSTING This ordinance shall be published once, with the names of those City Councilmembers voting for or against it, in the San I I I Mateo Times, a newspaper of general circulation in the City of South San Francisco, as required by law, and shall become effective thirty (30) days from and after its adoption. Introduced at a regular meeting of the City Council of the City of South San Francisco held on the 27th day of September 1995.
