PUBLIC COMMENTS Mr. Frank Lapetina, Executive Vice President and COO, Guckenheimer, expressed opposition to the Code of Conduct. He stated that Gukenheimer is believed to provide 95 percent of the corporate food service jobs in South San Francisco. He described benefits and wages Guckenheimer employees receive, and that previous statements made about other corporations do not apply to Guckenheimer. Ms. Catherine Cusic explained that the Code of Conduct is meant to raise the standards for low income workers so that they receive affordable healthcare and livable wages, job retention and job security. Resolution No. 22-2007 endorsing the adoption of the "Socially Responsible Contractor's Code of Conduct" Councilman Fernekes explained the changes made to "Socially Responsible Contractor's Code of Conduct" and that it now incorporated all workers in the City. Vice Mayor Gonzalez stated that he was not completely satisfied with the Code of Conduct, adding that he would like the following wording included: "Furthermore, all companies who subcontract these food services to show leadership in their contracting promises." Councilman Addiego disclosed that he did meet with Mr. Lapetina and was impressed by the commitment between Mr. Lapetina and his workers. He stated support for the Code of Conduct as a means to improve the level of living for food service workers on a larger social scale. Vice Mayor Gonzalez stated that he too met with Mr. Lapetina. Councilwoman Matsumoto disclosed that she had telephone conversations with both Ms. Cusic and Mr. Lapetina. She stated that as long as Council was passing only a Code of Conduct and not forcing Gukenheimer to become union, she would support the Code of Conduct. Councilwoman Matsumoto distributed copies of grammatical changes she made to the Code of Conduct and requested that Council include the changes if the resolution was passed. Councilman Fernekes disclosed that he worked with Ms. Catherine Cusic to revise the Code of Conduct. He also spoke with Mr. Lapetina and met with Mr. Richie. He stated his support of the Code of Conduct. REGULAR CITY COUNCIL MEETING MINUTES APRIL 11, 2007 PAGE 2 Mayor Garbarino disclosed that he too spoke with Ms. Cusic and Mr. Lapetina. He stated his support for the Code of Conduct. Mayor Garbarino stated the intent of the Council was that this Code of Conduct include all businesses, rather than singling out a particular industry or employer. City Attorney Mattas commented that a motion should reflect the changes recommended by Councilwoman Matsumoto. Motion: Gonzalez/Fernekes: to approve the Resolution No. 22-2007 endorsing the adoption of the "Socially Responsible Contractor's Code of Conduct" (including the changes recommended); unanimously approved by voice vote. (5-0) (Recess 8:45 p.m. - 9:15 p.m.) ITEMS FROM COUNCIL Announcements and Committee Reports: Councilmembers reported on attendance at community and regional meetings and events, announced upcoming events and fundraisers, and acknowledged members of the community for their contributions. Councilwoman Matsumoto requested the meeting be adjourned in memory of Roberta Nieto. She met with ad hoc committee Improving Public Places and was asked to be Samtrans nonvoting representative on CCAG. Councilwoman Matsumoto inquired if a renter was selected for 380 Alta Vista. Also she said she had attended the Easter egg hunt, and thanked the Easter Bunny. In recognition of Volunteer Week, Councilwoman Matsumoto thanked all the members of the community who volunteer for City services. She attended a countywide meeting sponsored by several regional groups (ABAG, Metropolitan Transportation Commission and the Bay Area Air Quality Management District). She congratulated employees of South San Francisco's Fire and Police Departments for the recognition they received at a recent Awards Banquet. Councilman Addiego announced the April 21 Earth Day Restoration and Clean up on Half Moon Bay State Beach from 9 a.m. to noon. He also reported on meeting with the Historical Society with Councilman Fernekes at 80 Chestnut, hopefully the future home of the Historical Society as a museum. Councilman Fernekes announced that he and Councilwoman Matsumoto met with the budget subcommittee, he also toured site for the Historical Society Museum. He met with the Gala Committee for the centennial celebrations and the Centennial Subcommittee with Councilwoman Matsumoto. He announced that first would be the New Years gala, followed by a multi-cultural event--a 4th of July celebration. Councilman Fernekes mentioned that the Historical Society will have a special annual dinner at the conference center and will be having a fashion show. He also stated that PAL is celebrating its 50th anniversary in September. Vice Mayor Gonzalez announced that April is Environmental Month. He also reminded people to bring their thermometers to the fire station. He recognized the Police Department for their work against gangs within the city. REGULAR CITY COUNCIL MEETING MINUTES APRIL 11, 2007 PAGE 3 Mayor Garbarino attended the League of Cities Community Development Policy Committee meeting. He also participated in the classroom science project on April 4 with 90 students at Spruce School. He spoke to senior citizen residents at the Westborough Royale Assisted Living Facility. He attended the reception fc)r the Legion of Honor medal recipient aboard a visiting French Navy vessel. Mayor Garbarino attended the Kiwanis one day event at the Gateway Childcare Center where volunteers cleaned. The Childcare Center is looking for volunteer readers and interested people can contact Lisa at the Childcare Center. He gave a presentation to San Mateo County Association of Realtors. The Mayor also recognized several people who were involved in the making of "Every Fifteen Minutes." CONSENT CALENDAR 1. Motion to approve the minutes of March 14,21, and 28, 2007 2. Motion to confirm expense claims of April 11, 2007 in the amount of$7,557,990.68 3. Resolution No. 27-2007 accepting a donation from Genentech in the amount of$lO,OOO to apply towards the 2006-07 Fire Prevention Week Program 4. Resolution authorizing execution of an agreement with Kleinfelder, Inc. to perform a feasibility study and cost analysis for the high intensity redevelopment concept plan for the Oyster Point Marina Councilwoman Matsumoto requested the item be pulled from the Consent Calendar. 5. Motion to accept the petition for annexation of 515 Airport Boulevard (APN 012-177-030) into Parking District #1 and to forward it to the Parking Place Commission for consideration 6. Consideration of options to preserve below market rate units within South City Lights development project (formerly the Marbella Project) Vice Mayor Gonzalaz requested the item be pulled from the Consent Calendar. Motion-Fernekes/Second-Gonzalez: To approve Consent Calendar Item Nos. 1,2,3, and 5; unanimously approved by voice vote. Item No.4: Councilwoman Matsumoto requested clarification regarding the scope of work and cost magnitude for the analysis. Chief Planner Calking explained that the company would be estimating the price of various factors, but would not give the full construction cost details, this analysis being preliminary. Assistant City Manager Van Duyn recalled that when the consultant had made a presentation to Council in the study session, the consultant had been somewhat cautious in his explanation of the high intensity option at the site. He indicated it might be very costly, providing infrastructure cleanup costs and construction technicalities to do high intensity buildings. Mr. Van Duyn stated this analysis will not include what it is going to cost to construct a building there. He stated the report will state certain likely equations given the site information available, in order to give Council a degree of the magnitude of whether it is doable. REGULAR CITY COUNCIL MEETING APRIL 11,2007 MINUTES PAGE 4 Motion-Matsumoto/Second-Addiego: To approve Resolution No. 28-2007 authorizing execution of an agreement with Kleinfelder, Inc. to perform a feasibility study and cost analysis for the high intensity redevelopment concept plan for the Oyster Point Marina; approved unanimously by voice vote. (5-0) Item No.6: Vice Mayor Gonzalez asked staff how moderate units lost due to price can be replaced to comply with the 20% inclusionary housing. Councilwoman Matsumoto also asked for the current percentage of inclusionary housing. Manager of Housing and Redevelopment Fragoso stated that she believed that South City Lights was still above the 20 % requirement because their original intent was 25%. She commented on perspectives concerning the units involved, qualifying buyers and resale restrictions. City Attorney Mattas explained some of the funding and negotiating processes. Motion-Gonzalez/Second-Addiego: To allow the City Manager to negotiate below Market Rate unit trades with the developer to lower the cost of a portion of the moderate-income units by releasing others from price restrictions (to proceed with Option 3 and have further communication concerning the buy down); unanimously approved by voice vote. Before moving to the next item, Mayor Garbarino reminded Council that on April 16th there will be a basketball game between the Harlem All Stars and "some of us." It will be at South San Francisco High School Gym, costing $10, benefiting the Vocational Music Arts and Science programs for the two high schools. PUBLIC HEARING 7. Consideration of resolution authorizing submittal of one year action plan and statement of objectives and projected use of funds for the Community Development Block Grant Program for Fiscal Year 2007-08; authorizing a budget transfer to incorporate CDBG and HOME funds into the 2007-08 operating budget; and authorizing the execution and submittal of all documents to the Department of Housing and Urban Development that are required to secure and allocate federal CDBG funds (public hearing continued from February 28, 2007 and March 28, 2007) Public hearing opened. City Attorney Mattas asked that councilmembers who have conflicts of interest with any of the agencies to state their roles and recuse themselves from discussion. Vice Mayor Gonzalez recused himself due to a conflict as a member of the Board for the North Peninsula Neighborhood Services Center and the Boys & Girls Club. Councilman Addiego recused himselfas a member of the Board of the Boys & Girls Club. City Attorney Mattas advised Council on options for proceeding with discussion of this item, stating the appropriateness of taking action on the North Peninsula Neighborhood Services Center and Boys & Girls Club funding requests as separate actions, then returning as a full Council to act on the remaining requests. There was consensus to proceed in such manner. REGULAR CITY COUNCIL MEETING MINUTES APRIL 11, 2007 PAGE 5 There were no speakers for the Boys & Girls Club item; the public discussion was closed. Motion-Fernekes/Second-Matsumoto: To approve of the funding recommendation of the sub-committee ($5,000) for the Boys & Girls Club; approved unanimously by voice vote (3-0). Councilman Addiego rejoined the Council. There were no speakers for the North Peninsula Neighborhood Services item; discussion was closed. Motion-Fernekes/Second-Matsumoto: To approve funding for $24,000; approved unanimously by voice vote (4-0). Councilman Gonzalez rejoined the Council. City Attorney Mattas advised the Public Hearing is still open and a staff report was available. Manager of Housing & Redevelopment Fragoso provided the staff report stating this is the second and final hearing for the CDBG program. She stated that approval of the resolution would solidify the recommendations made. She commented that there are two other funding sources incorporated by this action: the Home Administrative Funds received from San Mateo County which Council has targeted for Fair Housing activities, and the Redevelopment Funds. SPEAKERS: Kristina Knudsen, Rebuilding Together, thanked Council for allocating funding and invited Council to April 28th Rebuilding Day. She stated there are five homes in South San Francisco to be sponsored with the expected amount going back into the community estimated at $200,000-$250,000. She thanked Council for its role with Genentech which has donated $5,000 to sponsor two homes. She said an efficiency grant with PG&E is under review. She estimated there will be 200-300 people volunteering in this Rebuilding effOlt on April 28th. Sue Digre, Peninsula Association for Retarded Children & Adults, summarized the goals of P ARCA. She mentioned a support group of long-standing in South San Francisco through the Recreation Department. She stated meetings are scheduled to talk about the success or lack of success of inclusion, along with discussion of many ideas to help people with special needs participate more in the community. Julie Bou, Samaritan House (Safe Harbor Shelter), thanked Council for their support of Safe Harbor in the past. She said that because they are not being recommended for funding this year, she wanted to offer to meet with Council to see if the Safe Harbor Shelter can be reconsidered. She explained that while the funding for the renovation of the shelter is significant, it does not help the general operation funding. She reported that the Shelter serves about 90 South San Francisco clients per year, for $7,000, (about $77 per each person) for varying lengths of stay. She urged reconsideration, if not for this year, then in years to come. REGULAR CITY COUNCIL MEETING MINUTES APRIL 11, 2007 PAGE 6 Rosa Guerra, Shelter Network, thanked Council for on-going support. She stated the City's financial assistance allows the Shelter Network to obtain additional government funds. She described the Shelter's mission and accomplishments. Bruce Hamilton, HIP Housing, referred to his letter of April 5, 2007, authorized by the Board of Directors of HIP Housing. He said that South San Francisco has been involved in this program for the last fifteen years. He commented that for the last four years, the City has provided $22,500, and for the eight years prior, funded $25,000. He stated the sub-committee has recommended -$.00- funding for the Home Sharing Program. He commented on the City having approached HIP Housing about the possible purchase of an apartment building and HIP has been working with staff. He believes there is no relationship between the possible purchase of the apartment building and the Home Sharing Program. He detailed the ramifications of loss of this funding, asking Council to reconsider funding for this next year. Public hearing closed. Councilman Addiego asked the subcommittee to help Council understand why HIP and the Safe Harbor had not been recommended for funding. Councilwoman explained that funds have decreased and Council is fully cognizant of the difference between capital and services. This is for 2007 and she encouraged Safe Harbor to come back. With reference to HIP Housing, because of the differentiation between capital and operations, the money not going to HIP Housing will be used to supply a need internally. She stated the subcommittee understands the value of services these agencies provide and that recommendations were based on economic considerations. Councilman Addiego stated that the source of the funds is Redevelopment and asked the mechanism that sets the dollar amount available to Council. Manager of Housing & Redevelopment Fragoso stated the Redevelopment Funds are allocated at the discretion of the Agency. Councilman Addiego stated that knowing the general picture that funds are shrinking for probably 90% of what Council is dealing with, he felt that those programs that are eligible for Redevelopment funds could be considered differently because of the enormous success of the Redevelopment Agency. He felt this is not a large amount of money. He stated his support for both HIP Housing and Safe Harbor. Vice Mayor Gonzalez would like to know how to come up with more money. Councilman Addiego asked if when the budget was set for the Redevelopment Agency, the amount of $40,800 was locked in at that time. Assistant City Manager Van Duyn stated this is the time for discussion of how to allocate the funds. Councilman Addiego commented he would like to fully fund the Safe Harbor and HIP Housing because the Redevelopment budget has the ability to do so. Councilwoman Matsumoto stated the monies would not be idle but would be invested in South San Francisco. Director Fragoso said there are a number ofprojects under discussion. Councilman Addiego believes HIP Housing is tried and true and the City does not duplicate that effort. Motion-Addiego/Second-Gonzalez: To accept the sub-committee's recommendation as it stands with the exception of fully funding HIP Housing at $27,800 and Safe Harbor at REGULAR CITY COUNCIL MEETING MINUTES APRIL 11, 2007 PAGE 7 $7,000, knowing that the Redevelopment Agency funding will be set at $70,000; AYES, Addiego and Gonzales; NOES, Fernekes, Matsumoto, Garbarino. Motion failed (2-3). Motion-Fernekes/Second-Matsumoto: To accept the sub-committee's recommendation; unanimously approved by voice vote (5-0). City Attorney Mattas asked Council to act upon the Resolution that authorizes the City to transfer the necessary reports and enter into the agreements for the CDBG. He said if Council approves the Resolution, incorporatt~d as its attachment would be the decision for funding made by Council. Motion-Fernekes/Second-Matsumoto; Approval of Resolution No. 42 authorizing submittal of one year action plan and statement of objectives and projected use of funds for the Community Development Block Grant Program for Fiscal Year 2007-08; authorizing a budget transfer to incorporate CDBG and HOME funds into the 2007-08 operating budget; and authorizing the execution and submittal of all documents to the Department of Housing and Urban Development that are required to secure and allocate federal CDBG funds; approved unanimously by voice vote (5-0).
