HomeMy WebLinkAboutOrd 1202-1997ORDINANCE NO. 1202-97 AN ORDINANCE REPEALING CHAPTER 2.12 AND ADDING A NEW CHAPTER 2.12 TO THE SOUTH SAN FRANCISCO MUNICIPAL CODE RELATING TO CITY COUNCIL COMPENSATION THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS: SECTION 1 COMPENSATION Chapter ~.12 of the South San Francisco Municipal Code is hereby repealed and readopted to read as follows: "Chapter 2.12 City Council Compensation. 2.12.010 Purpose of Provisions The ordinance codified in this chapter is enacted pursuant to Section 36516 of the Government Code, as amended, authorizing the council to provide by ordinance that each member of the council shall receive a prescribed salary, the amount of which is based upon the population of the city as determined by estimates made by the State Department of Finance, and prescribing the methods by which council salaries may be increased or decreased in the future. 2.12.020 Salaries Each member of the City Council of the city shall receive as salary the following: A. The sum of five hundred dollars per month, as prescribed in said Section 36516 of the Government Code for cities over fifty thousand up to and including seventy-five thousand in population, which shall be payable at the same time and in the same manner as salaries are paid to other officers and employees of the City. 2.12.030 Increase or Decrease The salaries provided in this chapter may be increased or decreased as follows: A. Following any new and later estimate of population made by the Department of Finance, placing the city in a population group other than that set forth in Section 2.12.030, the salary payable to each member of the Council may be increased or decreased by resolution of the City Council to equal the sum prescribed for that population group in Section 36516 of the Government code as amended. I'll B. An amount equal to five percent for each calendar year from the operative date of the last adjustment of the salaries in effect, in accordance with Government Code Section 36516(c) and as approved by City Council resolution. c. In accordance with Government Code Sections 36516(b), by a majority of the electors voting at any municipal election. The salaries as so increased or decreased shall become payable only on and after the date upon which one or more members of the Council becomes eligible therefor by virtue of beginning a new term of office following a general municipal election held in the City. 2.12.040 Reimbursement The salaries prescribed in this chapter are and shall be exclusive of any amounts payable to each member of the council as reimbursement for actual and necessary expenses incurred by him or her in the performance of official duties for the city. 2.12.050 Operative Date The ordinance codified in this chapter shall become operative only on and after the date upon which one or more members of the council of the city becomes eligible for the salary prescribed in this section by virtue of beginning a new term of office following the general municipal election next succeeding its effective date, and prior to said operative date, councilmembers' salaries shall be five hundred dollars per month." SECTION 2 SEVERABILITY In the event any section or portion of this ordinance shall be determined invalid or unconstitutional, such section or portion shall be deemed severable and all other sections or portions hereof shall remain in full force and effect. SECTION 3 PUBLICATION AND EFFECTIVE DATE This Ordinance shall be published once, with the names of those City Councilmembers voting for or against it, in the San Mateo Times, a newspaper of general circulation in the City of South San Francisco, as required by law, and shall become effective thirty (30) days from and after its adoption.
