HomeMy WebLinkAboutOrd 1213-1997 ORDINANCE NO. 1213-97 AN ORDINANCE ADDING SECTION 15.08.055 TO THE SOUTH SAN FRANCISCO MUNICIPAL CODE AMENDING THE UNIFORM BUILDING CODE RELATING TO SECURITY BARS ON BEDROOM WINDOWS WHEREAS, Health & Safety Code § 1758.4 permits cities to establish a date by which all residential property with security bars on bedroom windows shall comply with the applicable standards in the Uniform Building Code that requires release mechanisms for emergency evacuations; and WHEREAS, the Fire Department has conducted a survey and has determined that there are 259 bedroom windows in occupied dwellings in South San Francisco with non- releasable bars that pose a serious life-safety risk to residents who may need to evacuate the dwellings in the event of a fire. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: Section 15.08.055 is hereby added to the South San Francisco Municipal Code, amending Section 310.4 of the Uniform Building Code, entitled Access and Exit Facilities and Emergency Escapes, by adding the following at the end of the Section: Pursuant to Health & Safety Code §17958.4, all existing bars, grilles or similar devices on bedroom windows that would be used for escape or rescue in the event of an emergency must be brought into conformance with the requirements set forth in this Section by no later than September 1, 1998. The property owner of the building shall be responsible for the maintenance and proper operation of any security bars, grilles or similar devices on windows and exits at all times. SECTION 2: SEVERABILITY In the event any section or portion of this ordinance shall be determined invalid or unconstitutional, such section or portion shall be deemed severable and all other sections or portions hereof shall remain in full force and effect. SECTION 3: PUBLICATION AND EFFECTIVE DATE This Ordinance shall be published once, with the names of those City Councilmembers voting for or against it, in the San Mateo Times, a newspaper of general circulation in the City of South San Francisco, as required by law, and shall become effective thirty (30) days from and after its adoption. Introduced at a regular meeting of the City Council of the City of South San Francisco, held the 27th day of August , 1997.
