AN ORDINANCE AMENDING THE SOUTH SAN FRANCISCO MUNICIPAL
CODE SECTION 4.04.110 REGARDING THE USE OF BIDDING PROCEDURES
FOR PURCHASES OF SUPPLIES, SERVICES. EQUIPMENT
THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS
FOLLOWS:
SECTION 1.
Section 4.04.110, Subdivision A, of the South San Francisco Municipal Code
entitled, 'Open market procedure" is hereby amended to read as follows:
"4.04.110 Open market procedure.
A. Purchases of supplies, equipment and services and sales of personal property
may be made by the purchasing officer in the open market without observing the
procedure prescribed by Section 4.04.100 where the estimated value, exclusive of sales
tax and freight, does not exceed:
1. Five thousand dollars in the case of public projects as defined in Public Contract
Code Section 20160 et seq.; or
2. Twenty-five thousand dollars in the case of all other purchases not otherwise
specifically governed by state or federal law."
SECTION 2. SEVERABILITY.
In the event any section or portion of this ordinance shall be determined invalid or
unconstitutional, such section or portion shall be deemed severable and all other sections
or portions hereof shall remain in full force and effect.
SECTION 3.
PUBLICATION AND EFFECTIVE DATE.
This Ordinance shall be published once, with the names of those City
Councilmembers voting for or against it, in the San Mateo Times, a newspaper of general
circulation in the City of South San Francisco, as required by law, and shall become
effective thirty (30) days from and after its adoption.
Introduced at a regular meeting of the City Council of the City of South San
Francisco, held the 24th day of November, 1998.
Adopted as an Ordinance of the City of South Francisco at a regular meeting of the
City Council held the ~tth day of December, 1998 by the following vote:

John R. Penna end Mayor James L. Datzman
