HomeMy WebLinkAboutOrd 1295-2001 ORDINANCE NO. 1295-2001 AN ORDINANCE ESTABLISHING THE FORMATION OF THE BAYSHORE BOULEVARD UNDERGROUND UTILITY DISTRICT WHEREAS, in accordance with Chapter 13.16 of the South San Francisco Municipal Code, the City Council has held a public hearing regarding whether the public necessity, health, safety or welfare requires the removal of poles and overhead wires and associated overhead structures along Bayshore Boulevard; and WHEREAS, the City Council has determined that the public necessity, health, safety or welfare requites the removal of poles and overhead wires and associated overhead structures along Bayshore Boulevard; and WHEREAS, the establishment of an Underground Utility District will require all utility companies to ~'emove their existing aboveground utility structures along Bayshore Boulevard and underground their overhead wires and other facilities; and WHEREAS, the establishment of an Underground Utility District will require property owners along Bayshore Boulevard to underground their electrical, telephone, and cable TV services; and WHEREAS, the City will replace any streetlights currently mounted on aboveground utility poles along Bayshore Boulevard and make underground connections to the power line; NOW ~THEREFORE, the City Council of the City of South San Francisco does ORDAIN as follows: Section 1 In accOrdance with Chapter 13.16 of the South San Francisco Municipal Code, the City Council establishes the Bayshore Boulevard Underground Utility District for the portion of Bayshore BoUlevard shown on Exhibit "A" attached hereto. Establishment of the District requires the following: a. All utility companies shall underground their overhead wires and other facilities and remove eXisting utility structures along Bayshore Boulevard; and b. All property owners along Bayshore Boulevard shall underground their electrical, telephone, and cable TV services; and c. All undergrounding work and utility service connections shall be completed by April 1, 2003. ,--- Section 2. PUBLICATION AND EFFECTIVE DATE This Ordinance shall be published once, with the names of those City Councilmembers voting for or against it, in the San Mateo Times, a newspaper of general circulation in the City of South San Francisco, as required by law, and shall become effective thirty (30) days from and after its adoption. Section 3. SEVERABILITY In the event any section or portion of this ordinance shall be determined invalid or unconstitutional, such section or portion shall be deemed severable and all other sections or portions hereof shall remain in full force and effect. Introduced at the regular meeting and adopted at the special meeting of the City Council of the City of South San Francisco, held the 1 lth day of July ,2001. Adopted as an Ordinance of the City of South San Francisco at a special meeting of the City Council held the 15th day of August , 2001 by the following vote: AYES: Councilmembers Pedro Gonzalez, Karyl Matsumoto and John R. Penna, Mayor Pro Tem Eugene R. Mullin and Mayor Joseph A. Fernekes NOES: None. ABSTAIN: None. ABSENT: None.
