HomeMy WebLinkAboutOrd 1305-2002ORDINANCE NO. 1305-2002 AN ORDINANCE AMENDING THE SOUTH SAN FRANCISCO ZONING CODE TO REFLECT A CHANGE FROM C-1 COMMERCIAL TO R-3 L MULTI-FAMILY HIGH DENSITY RESIDENTIAL FOR THE MARBELLA HOUSING SUBDIVISION The City Council of the City of South San Francisco does hereby ordain as follows: SECTION 1: REZONE OF PROPERTY Chapter 20 of the South San Francisco Municipal Code is hereby amended to reflect the rezone of parcels H & J of Parcel I, and Parcels I and G-2 as indicated in the legal description of the Lands of DUC Housing dated August 13, 2001, attached hereto and incorporated herein as Exhibit A. SECTION 2: FINDINGS The findings and determinations contained herein are based on all competent and substantial evidence in the record, both oral and written, contained in the entire record relating to the project. The 5indings and determinations constitute the independent findings and determinations of the City Council and are supported by substantial evidence in the record, including the General Plan adopted in 1999, the staff reports and consultant reports submitted at the Planning Commission meetings conducted June through November 2001 and the public hearing, documents and testimony received at the City Council meeting of December 12, 2001. The Marbella Housing Subdivision Draft EIR was prepared in accordance with the provisions of the California. Environmental Quality Act (CEQA) and circulated for a 30-day public/agency review perioc beginning on October 5, 2001. Public notice of the availability of the Draft EIR was published in a newspaper of general circulation and mailed to agencies. In addition, all persons who had requested notification were mailed a notice. All public comments were responded to "_n accordance with CEQA and the Final Environmental Impact Report was certified by the City Council by Resolution No. 131-2001 on December 12, 2001. The re-zone of the property is internally consistent with the South San Francisco General Plan, as amended. Findings and related analysis are stated in Resolution No. 132-2001 wherein the City Council authorized an amendment to the General Plan and approved a Vesting Tentative Map and a PUD permit. SECTION 3: SEVERABILITY In the event any section or portion of this ordinance shall be determined invalid or unconstitutioral, such section or portion shall be deemed severable and all other sections or portions hereof shall remain in full force and effect. I SECTION 4: PUBLICATION AND EFFECTIVE DATE. This Ordinance shall be published once, with the names of those City Councilmembers voting for or against it, in the San Mateo Times, a newspaper of general circulation in the City of South San Francisco, as required by law, and shall become effective thirty (30) days from and after its adoption. Introduced at a regular meeting of the City Council of the City of South San Francisco, held the 12th day of December 2001, by the following vote: Adopted as an Ordinance of the City of South San Francisco at a regular meeting of the City Council held the 9th day of January 2002: AYES: Councilmember Joseph A.
