HomeMy WebLinkAboutReso 3626-1962 RESOLUTION N0.3626 A RESOLUTION AUTHORIZING SALE OF EXCESS LAND, THE TERMS OF SALE AND PUBLICATION OF NOTICE LOWRIE-BOTHiN-SWANSON PROJECT PERSON AND SWANSON INDUSTRIAL TRACT RESOLVED, by the City Council of the City of South San Francisco, California, that WHEREAS, certain land situate in the City of South San Francisco, County of San Mateo, State of California, has been ac- quired by the City of South San Francisco in excess of the land actually needed, or used, for public purposes in connection with the establishing and laying out of San Mateo Avenue and Lowrie Avenue in said City, and it is the intention of said City to sell said land; NOW, THEREFORE, IT IS FOUND, DETERMINED and ORDERED, as follows: 1. That the certain parcel of land bounded on the west by the properties of Ken Royce, Inc., a corporation, on the east by San Mateo Avenue, and on the north by Lowrie Avenue, excluding therefrom, however, the lands owned by Oscar F. Person and Marshall Vo Swanson, and also the lands described in Paragraph 3 subparagraph (c) hereof, are in excess of the land actually needed, or used, for public purposes in connection with the establishing and laying out of San Mateo Avenue and Lowrie Avenue aforesaid. 2. That it is in the public interest that said parcel be sold subject to the terms and conditions hereinafter set forth. 3. The terms of said sale and purchase are as follows: (a) That no structure shall be constructed on said parcel which will obstruct the view of Lowrie Avenue from San Mateo Avenue or vice versa. (b) Said parcel shall be sold "as is" without warranty of title of any kind and be subject to public easements for the construction or reconstruction, im- provement, maintenance and operation of water mains, sewer mains and other utilities and, without limiting the generality of the foregoing exception, there is :1 I II;~ : I I II specifically reserved to the City and County of San Francisco, a municipal corporation, an easement for water mains and appurtenances and for the construc- tion, reconstruction and maintenance of the same in, over, across, and upon said parcel. (c) The, or one of the, considerations for the purchase of said parcel shall be the conveyance to this City of the following parcels of land, situated in the City of South San Francisco, and more particularly de- scribed as follows: PARCEL i Description of a portion of that certain property deeded by Ken Royce to Ken Royce Inc., described in deed recorded September ll, 1948 in Volume 14y? of Official Records at Page 2.52., San Mateo County Records (Serial No. 50907-H) and being more particularly described as follows: BEGINNING at the most Southerly corner of the above described property, said point being the intersection of the Northerly right of way line of Linden Avenue 60 feet wide) and the Westerly line of San Bruno Road 66 feet wide}; thence from said point of beginning North 0° 56' 2.8" West 2.2..68 feet and North 1~ 2.5' 2.0" East 45.05 feet along said Westerly line of San Bruno Road; thence leaving said Westerly line on a curve to the right, with a radius of 45.00 feet (a radial line at the point of beginning of said curve bears North 42.° 43' 06" West), through a central angle of 61° 49' 53" an arc distance of 48.56 feet to a point on the afore- mentioned Northerly right of way line of Linden Avenue; thence Southeasterly along last said Northerly line on a curve to the right, with a radius of 430.00 feet ( a radial line at the point of beginning of said curve bears South 4?° 43' 2.4" West) through a central angle of 9° 46' 51" an arc distance of Y3.40 feet to the point of beginning. Containing 0.029 acres, more or less. PARCEL Beginning at a point on the Wly line of San Bruno Road, which point is the SEly corner of tha. t certain tract of land conveyed by James F. Lowrie and Elsie Rose Lowrie to The Lowrie Paving Company by deed dated May 10, 1954 and recorded May 26, 1954 in Book 2589 of Official Records of San Mateo County at page 55; thence from said point of beginning along said Wly line of San Bruno Road S 4° ll' 38" W 48o91 feet and S 1° 22' 54" W 12..2.2. feet; thence leaving said line from a tangent that bears N 2.5° 2.5' 35" W along the arc of a curve to the right having a radius of 150 feet and a central angle of 23° 54' 2.8", an arc distance of 62..59 feet to the Sly line of said parcel conveyed to The Lowrie Paving Company; thence along said line N 88° lB' 2.0" E 18.36 feet to the point of beginning. Together with a slope easement over a strip of land lying Wly and contiguous to the curved Wly line of the above-described parcel, and being l0 feet wide measured radially from said Wly line; said strip being cotiguous for its full width at its Nly extremity to a line bearing N 88° lB' 2.0" E and being contiguous for its full width at its SEly extremity with a line bearing N 1° 22' 54" E. M. January 12, 1963.
