HomeMy WebLinkAboutReso 3671-1963RESOLUTION NO. 3671 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO ABANDONING SANITARY SEWER EASEMENTS THROUGH THE PROPERTY OF THE SANTO CRISTO SOCIETY WHEREAS, public utility easements were dedicated to the City of South San Francisco as follows: Parcel "A", a portion of that certain 10'foot right of way for sanitary sewer purposes as said right of way is des- cribed in tb~t certain indenture made on September 30, 1999, by and between the South San Francisco Land and Improvement Company, a California corporation, and the City of South San Francisco, a municipal corporation, in the County of San Mateo, State of California, and recorded on October 20, 1919, in Volume 285 of Deeds at page 423, Official Records of San Marco County, the description of which is more particularly set out hereafter..and Parcel "B", all of parcel 1 as described in Deed con- veyed t° the CiKy of South San Francisco by the South San Fran- cisco Land and Improvement Company dated May 5, 1923, and re- corded August 31, 1923, in Volume 85 of Deeds at page 334, Official Records of San Mateo County, State of California, which parcel is hereafter more particularly described, and, WHEREAS, said easements have not been used for the pur- poses for which they were dedicated or acquired and are un- necessary for present and prospective public use by said City. NOW, THEREFORE, BE 'IT RESOLVED that the City of South San Francisco, not having used said easements, to wit: Par- cel "A", a portion of that certain lO-foot right of way for sanitary sewer purposes as said right of way is described in that certain indenture made on September 30, 1919, by and between the South San Francisco Land and Improvement Com- party, a California corporation, and the City of South San Francisco, a municipal corporation, in the County of San Mateo, State of California, and recorded on October 20, 1919, in Volume 285 of Deeds at page 423, Official Records of San Marco County, said portion of said right of way being des- cribed as follows: A strip of land ten (10) feet wide, five (5) feet each side of the following described line: BEGINNING at a point on the northerly right of way line of Oak Avenue, an 80-foot wide street~ said POINT OF BEGINNING being distant S 53° 15' W 4.90 feet from the most southerly corner of the lands described in deed from Santo Cristo Society of San Mateo County, a California cor- poration, to W. A. Haanen, Alford D. Ellis and William A. Riggat, as Trustees in behalf of the South San Francisco Congregation of Jehovah Witness dated January 11, 1955, and recorded January 21, 1955, in Volume 2730 at page 224, Official Records of San Marco County; thence from said POINT OF BEGINNING N 36° 46' 40" W 86.58 feet; thence N 450 31' 55" W 38.88 feet to the southerly line of the Guiseppe Ucelli lO- acre tract, the last mentioned line being the southerly line of the lands described in deed conveyed by Elizabeth C. Ashton to Guiseppe Ucelli dated September 27, 1905, and recorded September 27, 1905, in Book 115 of Deeds at page 582, Offi- cial Records of 'San Marco County. and Parcel "B" all of Parcel One as described in Deed conveyed to the City of South San Francisco by the South San Francisco Land and Improvement Company dated May 5, 1923, and recorded August 31, 1923, in Volume 85 of Deeds at page 334, Official Records of San Marco County, California; said Parcel One bein~ more particularly described as follows: Being a strip of land ten (10) feet wide, five (5) feet on each side of the following described line: e " " : 'M/$ S ION R.. Ucelli and South San Fran- cisco Land and Improvement Company, from which point a granite monument on the northerly side of Grand Avenue in the City of South San Fran- cisco bears North 53 degrees 15 minutes East 545.88 feet distant; said monument being desig- nated as "L-?" on a "Map of a survey made for P. E. Iler", which map was filed for record March 10, 1891, in Book "E" of Maps at page ?9, in the office of the County Recorder of the Coun- ty of San Hateo, California; ~unning thence from said POINT OF BEGINNING South 69 degrees 15 minutes East 45.98 feet. and further determining that said easements are unnecessary for present or prospective public use by said City, do here- by abandon the said easements as hereinabove more particular- ly described.
