BT02 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO APPROVING RULES AND REGUL- ATIONS FOR PRIVATE PATROL BE IT RESOLVED BY the City Council of the City of South San Francisco that: 1. The Rules and Regulations for private patrols, Police Department-City of South San Francisco, attached hereto as "Exhibit A", are hereby approved. 2. Applicants for a private patrol license shall com- plete the application in the form attached hereto as "Ex- hibit B" and shall furnish all documents and other material required by said application. Jo Rozzi Attest: ~~ City Clerk R~ ~D REGULATIOn3 FO~ P~V~TK P~TROL~ POLICE DEPARTMENT-CITY OF 50UTH' SAN FRANCISCO SECTION A - REGISTRATION OF EMPLOYEES OR OPERATORS No employee of a private patrol service shall be pe _r~itted. by the. . operator to perform any services pertaining ~o said patrol servxce wlthou~ first determining that said employee has been cleared and registered wi~h the Police Department. SECTION B - UNIFORMS Uniforms worn in connection with the performance of the duties of a rivate patrol service shall in nO way resemble those worn by the Police fficers, pOlice Reserves and School Crossing Guards of the City of South San Francisco, or by the police force of any other government or govermaental agency, nor shall they be designed in any way whatsoever calculated to indicate an official connection wi~h any such agency. British Green, 19~ oz. - #$662-943 3- Forest Green Elastique, 19~ oz. - ~13507-168 SECTION C - SHIELDS AND'CAP EMBLEMS All private patrol employees shall wear shields and cap emblems as approved by the Chief of Police and shall in no way resemble those of Regular Officers, Police Reserves or School Crossing Guards of the City of South San Francisco. The shields and emblem shall be of a metal, silver in color. Ail lettering shal~ be in black and shall designate the name of the. · private patrol service and/Or "Private Patrol," "Private Patrol Service" or "Private Patrolman." ~ (Refer ~o attached sample or design) SECTION D - VEHICLES 1. Color - No combination of black and white will be permitted on vehicles used for private patrol services. ~hi~e door panels, on a black vehicle are expressly prohibited. 2. Identification = Following lettering of distinctive or contrasting color, painted or printed on both sides across doors lines. First Line: Name of Firm - 3 inch letters Second Line: "Private Patrol ServiCe"- ~ inch letters The words "Police" - "Police Officer" - "Police Department" - "Traffic Patrol" - "Special Police" - "Special Police Patrol" - "Reserve Police" - "Auxiliary Police" - "Sheriff" - "Deputy Sheriff" - "Sheriff's Office" - "Special Deputy Sheriff", are prohibited for such purpose. The word "Private" is required to be included in the business firm Or operating business name or title. The telephone number,' if any, shall be the business phone number of the private patrol service. Lighting - The use of ot~pl:].ementary colored lighting other than standard manufacturers .equipment originally installed on the vehicle and/or fog lamps, is prohibited for emergency , or any other use on private patrol vehicles. All other requirements shall conform in accordance to the Vehicle Code, State of California. Inspection The Chief of Police shall have the right of inspection of any private patrol vehicle to insure that it is safe for operation and conforms t.o the requirements of these rules and regulations. " 1. Business Cards, Newspapers, Magazines and other advertising media. ~ : No private patrol operator nor any of his employees shall use the~ ' ~ words: "Police" - "Police Officer" - "Police Department"- "Traffic' Patrol" - "Special Police" - "bpecial Police Patrol" - "keserve Police" - "Auxiliary Police" - "Sheriff" - "Deputy Sheriff" - "Sheriff's Office" or "Special Deputy Sheriff", in their advertising. The address of any police agency for any jurisdiction within ~he county shall not be used by any private patrol service. 2. Telephone Listings - No private patrol operator nor his employees shall place or cause to be placed in any telephone company's listings. or in any other source their telephone designated as representing any police agency for any jurisdiction within the city or county. SECTION F - INOUkANCES !. Applicant or operator of the private patrol service shall file annually the required insurance certificates with th~ City Clerk, and said certificates shall be approved by the City Manager and City Attorney. SECTION G - U~h OF CO~.~NICaTION~ E~UIP~v~NT 1. No private patrol operator or employee shall operate any type of radio communications equipment that has not prewiously been inspected and approved by the County Communications Engineer and Chief of Police. 2. No private patrol operator or his employees shall at any time violate any FCC regulation or any regulation of the Communications Code and Procedures of the Police Department or any other Jurisdiction within the county relRting to the reception and transmission of radio me ssage s. -- $EGTION H - REPORTS '~ 1. l~ shall be the responsibility of all private patrol opera~ors . and/or ~hei~mployee~ }o repor~ ~o the P,lice Dg~ar~en~~ or ~her public ~aw mnx-orcemen~ Agency of Jurisdiction, aAA unuauaA inciden~s' or circumstances of a possible criminal nature, which they observe during the performance of their duties as members of a private patrol service. Such incidents or circumstances shall be reported immediately at the time of occurrence or discovery. 2. Private patrol operators and/or their employees shall participate in the investigation of public offenses R~tf directed to do so by the Chief of Police, his authorised representative or by another peace~ officer having ~urisdtction. SECTION I - COLLECTIONS 1. No person shall, in connection with the ol~ration of a private l~grol business, use any sign, badge, title or designation, or make any ' express or implied representation, calculated to induce the belief that he is a member of the Police Department, or connect therewith in any way, in connection with any activity directed ~oward the collection of any money or debt, or the repossession, recoverin~. or taking of anything of value, or for any purpose of private gain. what so ever. SECTION J - TITLF~ 1. No person shall, in connection with the operation of the private patrol service, use the title of Chief of Police, Police Officer, or any other title or designation whatsoever designated to indicate an official connection with the Police Department, Sheriff's Office or other public Law Enforcement of any Jurisdiction. SECTION K - OPERATIONS 1. No person shall, in connection with the operation of the private patrol service, represent himself, or falsely represent anoSher, ~o be a. m~.mber .of _the P_olio.e D. eparmae, n.~ or use.any sign. word. language or aevxce eaAculated to xnauce a raAse o~ mxs~ken-b&lief ~hat He xs acting or F~.rporting_~o act on behalf of the Police Department within the scope or any real or purported duty'thereof. L. The Chieff of Police shall have the right in hie discretion t~ ~'i , such private patrol e~ployees sworn for the purpose o£ carrying firearms within the provisions off certain type of firearms and tha~ the private patrol employee is so qualified to carry firearms. SECTIO~ M - Accounts, Customers or Routes The private patrol operator shall on the 1st day of July and the 2nd day of January file with the Chief of Police the true names and: addresses of all accounts and customers for whom the private patrol provides service. Exhibit B APPLICATION Pr~va~ ~, ,,pa, t_rol THE UNDERSIGNED hereby applies for a license to operate a Private Patrol in the City of South San Francisco and in a~ord, ante with the additional terms and conditions prescribed by the City Council agrees to: 1. File the required insurance certificates with the City Clerk 2. Hold the City, its officers and employees harmless from any claims occasioned by his actions or the. actio~s of his employees or agents, and further agree8 to defend any and all such claims against City, its officers amd employees. 3. File a false arrest bond approved by the Chief of Police 4. Register with the Chief of Police all names or ~art- hers, employees and agents together with the number of their' State license prior to placing them on the patrol 5. Obtain approval of the Chief of Police of the patrol's operating plan 6. Obtain the required State licenses 7. This license shall be subject to review and renewal annually and shall be subject to revocation upon viol- ation of any of the terms and conditions contained there- in or the Rules and Regulations or the terms of Division 3, Chapter 11, 7500 et.seq, of the Business and Professions Code, State of California.
